HomeMy WebLinkAboutMINUTES - 09101985 - 2.1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY , CALIFORNIA Adopted this Order on September 10, 1985 , by the following vote: I AYES: Supervisors Powers , McPeak , Torlakson, Fanden I NOES: None ABSENT: Supervisor Schroder i I i ABSTAIN: None SUBJECT: Proposed Clyde Park Tennis Court I The Board on August 20 , 1985 deferred to this date its decision on the recommendation of the Public Works Director to take the necessary actions to begin construction of a tennis court in a park located at Norman Avenue and Trafalgar Place , Clyde area, which is located within County Service Area M-16 . I Supervisor Sunne W . McPeak reported on the status of nego- tiations with representatives of the community of Clyde , the devel- oper , ! Carlo Zocchi , and County staff, and recommended that the Board take the following actions: i 1 . Defer action on the tennis court bid and continue item i to October 8 for progress report and action if appropriate; 2 . Support the consensus among the M-16, applicant , staff and District IV representatives that if the Planning Commission approves the pending General Plan Amendment for subject area in Clyde , that: a) the current park site will be incorporated as landscaped open space in the development project j and shall remain a County park; I b) Trafalgar Place streets will be marked historically with a walk or bike path around the park site as a demarcation of the open space and shall be constructed on the interior of the existing street right-of-way or on the exterior of the park boundary; c) an additional acre + will be dedicated and developed by the project applicant in one of three general areas (as described in the minutes of the 9/6/85 meeting) ; d) the new acre + site will be the location of the tennis court (which should not be sited on any existing rights-of-way to avoid possible title complications and delay factors in the future) ; e) a revised plan for location of the tennis court must be submitted to the State by November 1 , 1985 and title to the acre + park must be transferred to the County and/or M-16 by the date of letting the new bid; and I I i I I I I I _1_ •�;. may: f) if by cooperation with the developer the $27,000 grant from the State is jeopardized or costs are increased, the developer will pay ( 1 ) the costs in excess of $27,000 or (2) the costs over any available funding of constructing the tennis court either in the new park or in current park if the development project cannot implement its design for new park site location for the tennis court . This last provision is a guarantee from the developer t-hat the tennis court will be completed during the construction season in 1986 at the earliest possible date to guarantee an overall benefit to the Clyde community.
