THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on August 6 , 1985 , by the following vote:
AYES: Supervisor Powers , Schroder, McPeak, Torlakson and Fanden

SUBJECT: --Hearing on recommendation of the County Planning Commission
with respect to rezoning application 2619-RZ and Development
Plan 3057-84 filed by Somar Development Company ' (applicant
and owner) to rezone land in the Martinez area,
This being the time for hearing on the recommendation of
the County Planning Commission with respect to rezoning application
2619-RZ filed by Somar Development Company (applicant and owner) to
rezone 9 . 89 acres located on the westerly side of Pacheco Boulevard,
approximately 300 feet south of the Santa Fe Railroad Overcrossing
at Pacheco Boulevard or approximately 2, 600 feet North of Arnold Drive
in the Martinez area, from multiple family residential (M-12) and
General Agricultural District (A-2) to Planned Unit Development
District (P-1) and final development plan 3057-84, for a multiple
family complex; and
Harvey Bragdon, Assistant Director of Planning, described
the property site and advised that a Negative Declaration of Environ-
mental Significance was filed for the proposal; and
The Chairwoman opened the public hearing and, no one
appearing in opposition, the public hearing was closed; and
IT IS BY THE BOARD ORDERED that the recommendation of the
County Planning Commission is APPROVED and that rezoning- application
2619-RZ and Development Plan No. 3057-84 are APPROVED subject to
revised conditions (Exhibit A attached hereto and by reference made
.a part hereof) , and the Board hereby adopts .the Planning Commission' s
reasons as set forth in its Resolution No . 34-1985 as its determinations
for this decision.
IT IS FURTHER ORDERED that Ordinance No. 85-48 giving effect
to the aforesaid rezoning is INTRODUCED, reading waived and August 20,
1985 , is set for adoption of same.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3057-84:
1. This approval is based upon plans submitted with the application, as follows:
A. Final Development Plan labeled Subdivision 6525, scale 1"=401, received by the
Community Development Department May 16, 1985.
B. Soil Stability Plan, scale 1"=401, received by the Community Development
Department May 8, 1985.
C. Master Landscape Plan, scale I"=401, received by the Community Development
Department May 23, 1985.
D. Building Elevation Drawings and Floor Plans, received by the Community
Development Department November 13, 1984.
2. Prior to issuance of a grading or building permit, revised plans shall be submitted for
review and approval by the Zoning Administrator, as follows:
A. Relocate the project driveway westerly away from Buildings 1 through 3 to be
more evenly located between the buildings at that area and provide additional
curve distance opposite Building 1 of an approximately 75-foot radius,
maintaining a minimum distance of 15 feet between the driveway and the south
boundary. A sound barrier fence shall be installed at the south boundary
adjacent to the driveway including a 6-foot high decorative masonry wall in the
immediate vicinity of the existing residence on the adjacent property to the
south.
3. Prior to issuance of a building permit, building elevations and architectural design of
buildings and structures shall be subject to final review and approval by the Zoning
Administrator. This shall include matters such as refuse enclosures, retaining walls,
fencing and walls, signs and other accessory structures. The roof and exterior walls
shall be free of such objects as air conditioning equipment, television aerials, etc., or
screened from view. All units shall have house numbers or unit identification visible
at all times which may requie illumination.
4. The guide for development shall be the Multiple Residential District (M-12). Any
request for modification to the M-12 requirements shall be as determined by the
Zoning Administrator.
5. Comply with the landscape and irrigation requirement as follows:
A. Prior to issuance of a building permit, a landscape and irrigation plan shall be
submitted for review and approval by the County Zoning Administrator and the
County Public Works Department. A cost estimate or copy of contract for
landscaping improvements shall be submitted with the plan. Landscaping and
irrigation shall be completed prior to occupancy.

B. Significant landscaping shall be provided at the frontage and boundaries of the
site. All initial landscaping shall be of a size so that a mature appearance will
be attained within approximately three years of planting.
C. Adequate sight distance shall be maintained at the driveway, ingress-egress on
Pacheco Boulevard.
6. Development shall be in a manner consistent with the geologic reconnaissance report
submitted with the application. A detailed geotechnical investigation and report
providing for foundtion design and site grading shall be submitted to the Community
Development Department and Building Inspection Departments prior to issuance of a
building or grading permit. Plans shall be subject to review and approval by the
County Geologist prior to issuance of any permits.
7. If archaeologic materials are uncovered during grading, trenching or other -on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation measures.
8. Comply with the road and drainage requirements:
A. Unless exceptions are specifically granted, comply with the requirements .
of Division 1006 (Road °Dedication and Setbacks) of the County Ordinance
Code: This includes the following:
1 . Construct curb, 6-ft. , 6-inch sidewalk (width measured from curb face),
necessary longitudinal and transverse drainage, and pavement widening
on Pacheco Boulevard. The face of curb shall be located 10-ft., from
the right-of-way line. A meandering sidewalk may be required subject
to final determination by the Zoning Administrator.
B. Install street lights on Pacheco Boulevard. The final number and location
of the lights will be determined by the Traffic Engineer.

C. Relinquish abutter's rights of access along Pacheco Boulevard with the ex-
ception of one entryway.
D. The interior road system shall be constructed in accordance with the County's
private road standards. The use of dust control measures shall be provided
during construction on the site.
E. In accordance with Section 82-2.014 of the County Ordinance Code, this de-
velopment shall conform to the requirements of Division 914 (Drainage) of
the Subdivision Ordinance, unless exceptions are specifically granted.
F. The existing drainage system from the east side of Pacheco Boulevard to
the north side of Atchison, Topeka and Santa Fe Railroad embankment shall
be made adequate. This includes possible improvements to the dirt channel
and replacing the existing 24-inch pipe. The cost of the improved culvert
through the embankment will be credited against the recommended drainage
deficiency contribution.

G. The existing drainage system on the easterly side at Pacheco Boulevard to
the north side at the Atchison, Topeka and Santa. Fe Railroad embankment
shall be made adequate. As a minimum, this will require the replacement of
the 24-inch pipe thorugh the embankment with a 72-inch A.C.P. Additionally,
if this project intends to utilize the existing culvert under Pacheco Blvd. ,
immediately south of the project, its adequacy and that of the driveway
culvert to the north must be demonstrated. Improvements may be necessary
to make this portion adequate.
H. Furnish proof to Public Works Dept. , Land Development Division, of the
acquisition of all necessary rights of entry, permits and/or easements
for the construction of off-site, temporary or permanent,road and drainage
improvements.
I. Submit improvement plans prepared by a registered civil engineer to Public
Works Dept. , Land Development Division, for review; pay the inspection, plan
review and applicable lighting fees. These plans shall include any necessary
traffic signage and striping plans for review by the County Traffic Engineer.
The improvement plans shall be submitted to Public Works Dept. , Land Develop-
ment ',Division, prior to the issuance of any building permit. The review of
improvement plans and payment of all fees shall be completed prior to the
clearance of any building for final inspection by Public Works Dept. If
.final inspection is requested prior to construction of improvements, the
applicant shall execute a road improvement agreement with Contra Costa Co. ,
and post the' bonds required by the agreement to guarantee completion of
the work.
The following statements are not conditions of approval ; however, the applicant
should be aware of these comments prior to attempting to secure building permits.
A. The Contra Costa County Consolidated Fire District (see attached) .
B. The Mt.View Sanitary District (see attached).

Dear Mr. Turner:
We have reviewed the development plan to establish 128 apartments at the subject
location. The development is to consist of 16 separate buildings containing 8 units
each. This project is regulated by codes and ordinances administered by this Fire
District relative to Contra Costa County Ordinance 83/44. If approved by your office,
the following shall be included as conditions of approval:
1. The developer shall submit two (2) complete sets of plans and specifications of
the subject project, including required built-in fire protection systems, to
this office for review and .approval prior to construction to insure compliance
with minimum requirements related to fire and life safety. (2.206)C.C.C. Ord.

2. The developer shall provide an adequate and reliable water supply for fire
protection with a minimum fire flow of 3,000 GPM. Required flow shall be
delivered from not more than 3 hydrants flowing simultaneously while maintaining
20 pounds residual pressure in the main. (10.301c)UFC
3. The developer shall provide two (2) hydrants of the East Bay type. Location of
hydrants will be determined by this office upon submittal of 3 copies of a
tentative map or site plan. (10.301c)UFC
4. Access roads shall be capable of supporting the imposed loads of fire apparatus
(31 tons) and be posted to prohibit parking on both sides where the unobstructed
width is less than 28 feet. (10.207a)UFC
5. Access road's and hydrants shall be installed and in service prior to combustible
construction. (10.301d)UFC
6. Where open ,space is to be maintained for public or private use, access into
these areas from public ways small be provided. These access ways shall be a
minimum 16 foot width to accommodate fire department equipment.

The continued access and maintenance of the District's fire trail system shall
also be insured.
All open spaces, when left in their natural state, shall meet the Fire District's
weed abatement standards. Where practical, we would encourage the use of the
U.S. Department of Agriculture's Land Management Program 'utilizing livestock
grazing. This would require fencing the properties and allowing animals to
graze to approximately a 25% residual. If. this method is not utilized,
mechanical abatement shall be required. Contact Senior Inspector Emery of
this office for minimum weed abatement requirements. (10.207g,87.104)C.C.C. Ord.

be forwarded to this office when compiled by the planning agency.

There- is an existing 6" sewer main in Pacheco Boulevard fronting the
site. Sewage flows easterly in the 6" main to a manhole located 80 feet
east of the easternmost property corner, then crosses Pacheco Boulevard
to an 8" main. The 8" main flows westerly (in the opposite direction)
along the"'northernside of Pacheco Boulevard. Sewage from the project
ultimately would gravity flow to the-District's Pump Station No. 1
located on Arthur Road. , (Refer to attached sketch)
The 8" sanitary sewer on the northerly side of Pacheco Boulevard and
opposite the site presently has a slope of .0014 feet per foot, a velocity
of 1.3 feet per second and a capacity flowing full of 0.30 mgd (million
gallons per day).
The velocity of 1.3 foot per second is below current district standards.
Sewer mains with velocities of less than two' feet per second tend to
silt up and require increased maintenance. The capacity. of 0.3 mgd of
the existing 8" line will become insufficient given increased utilization
(up zoning) of the land.
The existing main line facilities are therefor deemed to be inadequate
to serve .the proposed level. of development. The District would require
the developer to mitigate the added load on, the .public sewer system One
solution would be to abandon approximately 440 feet of the 8" main and
replace it with approximately 440 feet of 12" trunk sewer. The .flow
characteristics of the 12" trunk sewer would'meet -the minimum District
standards. The District would credit estimated difference in cost
between a 6" main and a 12" trunk sewer against the developers trunk
sewer fees.

Additionally the applicant would be required to construct a new 8" public::;,
sewer main across Pacheco Boulevard opposite the manhole located 90 feet:;:'.
westerly of the easterly property corner.
2. In addition to the foregoing, the applicant would be required to
comply with the applicable sections of the Districts Sanitary System
Regulations ;Wastewater Discharge Ordinance General Regulation No. 46.." '-

6. '(a) . It is presumed that this application is for dwelling units '
under single ownership (apartments) and that the site collector
for the residential units will .be privately owned and maintained.
Grants of easement will therefor not be required for the site
collector.
(b) Plans, profiles and specifications for the .1.2" trunk sewer, in
Pacheco Boulevard, as well as for the private site collector-:"
would be required to be prepared by a licensed civil engineer- ',
and approved by the District 's Engineer. The site collector
would have to be designed to public sewer Main standards.
Sewers on slopes over 15% would require special design in
accordance with the recommendations of a licensed soil engineer.
Each building would require a 6" minimum building sewer. Each
building sewer would require a backwater overflow device per
District Standards.
(c) Plans would not be stamped or approved by the District's Engineer
until all applicable permit fees were paid.
