CO\'TRA COSTA COUNITY WATER AGENCY It is recommended that the Board of Supervisors approve and authorize Chairman James E. Moriarty to execute Agreements for consulting services with Ray B. Krone, Ph.D. , Associate Dean of Research on the Davis Campus of the University of California; Fred H. Tarp, Ph.D. , Head of the Biology Department, Contra Costa College; and Bernard Smith, formerly consultant Faith the San Francisco Bay Conservation and Development Cormi.ssion. Consultants shall review and analyze the "DRAFT ENVIROmIENTAL IMPACT REPORT - PERIPIERAL CANAL PROJECT" (EIR) dated August 1974, and shall provide tr ittcr. comments on the adequacy of the EIR in disclosing the potential impects of the proposed project and alternatives thereto upon the Bay-Delta Ecosystem, and of the sufficiency of the u itigation measures proposed in the EIR. The 'uwk consists of removing a large fallen tree from Wilkie Creek behind 2559 may Road. The work to be done is in accordance with Section 2C of the Drainage Haintenance.Policy. This '.pork is a Class 1 Categorical Exersption from environmental impact report requirements. .(M) Item 2. SAN PABLO DAM ROAD, STATION 250, ROAD No. o96ic - WORK ORDER 6455 (SUPPTZMENT I) - E1 Sobrante Area It is recommended that the Board of Supervisors approve Work Order 614,5 (Supplement I) in the amount of $5,100, and authorize the Public Works Director to issue a purchase order to Contra Costa Landscape, the only quotation received for work to be done on San Pablo Dam Road at Station 250 in the X! Sobrante area. The work consists of hydromulch seeding to stop erosion of the fill slope constructed to stabilize the slide and protect the road. This work is a Class I Categorical Exemption from environmental impact report requirements. (M) - Item 3. 'We have lived in this area for three years and found the service to be less than expected.... He have lived in two areas serviced by two different i cable companies and found the services to be exceptional and the rates less than we pay here. I have had a visit by a Cable Vision workman who ex- plained the comparq's problems with vandalism and the distance from our house to the main hook-up line. Although I sympathize Stith their prob- lem I*pay for a service and expect to get what I pay for. Several days a week, at least, our television and uta hookups are partially useable and yet I have to pay the full rate. Cable-Visioa telephone lines are busy for several hours at a time (phone off the hoof:) and I have called dur=g regular working hours on a week day only to be told they are closed. Because of our geograpbjcal area we are dependant on a television cable and would appreciate a company who tries to do their job well. As I mentioned on the telephone, due to skyrocketing costs, the have found that the economic feasibility of constructing cable service in many projects is extremely poor. The project in question is Tract 4406, known as Diablo West #1, in Danville. As you may know, P. G. & E. has increased their trench costs, adding to the problem. When P. G. & E. makes up a joint trench intent, it is divided into four parts- Gas, Electric, Telephone, and CATV. The four parts are generally divided into equal parts where each is required to pay 25'76 of the trench. If CATV chooses not to participate in the trench, the costs to the developer increase significantly. In this particular application, unless the trench costs are absorbed by the developer, the will be unable to provide cable service to the project until it is nearly complete and almost fully occupied. If the costs arep aid, the will provide cable service when we start getting requests. Further, we will provide, at no cost to you, the cable necessary for prewiring and instruct your contractor as to the proper method of prewiring. The CATV share of this trench is $8, 361. Such an ordinance prob- ably can be justified on either the basis of traffic regulation or consumer protection. I suggest that there would be little gain in the County adopting such an ordinance unless a substantial number of the cities in the County likewise adopt such an ordinance. You may wish to submit this matter to the Mayors' Conference for their consideration. The matter might appropriately be referred to some Board committee to determine whether or not we should also include in such an ordit- nance on a permanent basis the color signaling system that was re- cently utilized during the gasoline shortage period. Answer: In the opinion of this office the positions are incompati- ble. Discussion: The threshold question in incompatibility cases is whither the positions in question are public offices. A city coun- cilman is a public officer. [Government Code 536501(a)]. In the opinion of this office, Assessment Hearing Officers and Assessment . Appeals Board Alternate Members are public officers [People ex rel. Chapman v. Rapsey (1940) 16 Cal.2d 636, 107 P.2d 388; People ex rel. fagshz:: v. Authorities on the subject of cocmon law incompatibility of office usually are based upon the conclusion that there are no constitu - tional or statutory provisions which otherwise, prohibit the dual office holding in question [see, e.g., 36 Ops.Cal.Atty.Gen. 252, 254 (1960), 11o. 59-1031. In this case, Revenue and Taxation Code §1624.2 expressly prohibits participation by an Assessment Appeals Board member in any assessment appeal proceeding as to which the mesaber has an interest that could reasonably be expected to influ- ence the impartiality of his judgment.
