FII IAL IIMPALT: The financial impact to the County will be a reduction in costs through less disruption of our routine maintenance activities, a reduced liability exposure, and elimination of outstanding accounts receivable. RgkcXW POR 1IR71 At this time County forces are providing road and drainage maintenance services to the Cities of Danville and San Ramon. The amount of work performed is small in caaparison to our total maintenance effort. During the past year the scheduling of service has changers such that it is now very disruptive to County operations in the unincorporated areas. We are experiencing more instances where County work operations must be terminated in the middle of the work day to respond to City needs. A second factor is the question of liability. Under the present contract the County has a liability exposure whenever we perform work within a city. This exposure is inherent ice. any maintenance activity, and it cannot be avoided. In the, unincorporated area we accept this exposure because we have the responsibility of maintaining the County road and drainage systems. The County has no responsibility for these systems within cities. The cities are unable arra unwilling to insure or hold harmless the County for work within their jurisdictions. Currently, two claims are pending against the County for work performed within cities. Staff from the County Administrator's office, County Counsel, and Public Works Department havE met with city representatives for the cities self insurance fund to discuss this insurance - hold harmless problem. At this time there appears to be no solution acceptable to both parties. Hy ljaajx , spy MFK.bo.6.t8 -2- Finally, we have experienced a problem in receiving payment for work performed. Some payments from the cities have been significantly overdue. In one instance there has been a refusal to pay for work that has been performed. The County is providing the services to the cities at cost; no markup has been included for oorrection of work that is unsatisfactory. Instances of unsatisfactory work must be covered at City cost.
