On motion of Supervisor W. N. Boggess , seconded by Super-
visor J. P. Kenny, IT IS BY THE BOARD ORDERED that Supervisor
J . E. Moriarty, Chairman, is AUTHORIZED to execute on behalf of
the County an agreement with Columbia Research Institute to pro-
vide professional assistance in connection with the East County-
Delta Expenditure Effectiveness Study, at a cost of $20,000, the
cost being 50 percent reimbursable under a Housing and Urban
Development "701" grant administered by the State.
The foregoing order was passed by the following vote:

EAST COUNTY-DELTA EXPENDITURES EFFECTIVENESS STUDY
CONSULTANT SERVICES AGREEMENT
1. Parties.
Effective NOV 2 5 1974 , the County of Contra Costa, a political
subdivision of the State of California (hereinafter called "County")
and Columbian Research Institute, an Oregon Corporation, (hereinafter
called "Consultant") mutually agree and promise as follows:
2. Employment.
County hereby employs Consultant, and Consultant accepts such employ-
ment under terms and conditions set forth herein and in Appendix "A"
for professional services, to assist the County in completion of the
East County-Delta Expenditures Effectiveness Study and which is more
specifically described in the Work Program attached hereto marked
Appendix "A".
3. Study Coordinator,
The County's Director of Planning, Anthony A. Dehaesus, is designated
as Study Coordinator.
4. Personnel.
Consultant services pursuant to this agreement shall be performed by
personnel of Columbian Research Institute, 1400 S.W. Montgomery, Portland,
Oregon, 97201. Wesley L. Myllenbeck will be the officer in charge for
Columbian Research Institute, Stephen M. Telfer will act as Co-Project
Director.
5. Federal/State Authority.
Said study being partially state and federally funded, Consultant's work,
as well as all study related records and documents, shall be subject to
review at all times, by appropriate state and federal agencies.
6. Compensation.
The County shall compensate Consultant on a flat fee basis in the amount
of $20,000 for work performed pursuant to this agreement.
7. Method of Payment.
County agrees to make partial payments to Consultant as follows:

8. Time of Completion.
Work done pursuant to this agreement shall be completed by June 30, 1975,
unless extended by written agreement of both parties.
9. Termination.
The County may terminate this agreement any time upon giving fifteen
(15) days written notice to Consultant of such termination. In the
event of such termination the Consultant will be paid an amount equal
to the value of work and services performed to the date of termination
plus ten (10) percent of the remaining balance of the total compensation
specified in paragraph 6 of this agreement less payments previously re-
ceived. In the event of default or failure to perform by the Consultant,
the liability of the County shall not exceed the value of work and ser-
vices done to the date of termination.
10. Ownership of Drawings, Reports.
All drawings, reports, electronic data tapes and programs, studies and
surveys, including field notes, prepared by or for the Consultant for
the Study shall become the property of the County and will be delivered
to the County upon completion of the services under, or on termination
of, this agreement.
11. Notifications.
For the purpose of notifying the parties to this agreement, notices
directed to County shall be directed to Anthony A. Dehaesus, Director
of Planning, P. 0. Box 951, Martinez„California 94553. Notices required
for Consultant shall be directed to Columbian Research Institute, 1400
S.W. Montgomery, Portland, Oregon 97201.
12. Status.
The Consultant is an independent contractor and is not to be considered
an employee of the County.
13. Indemnification.
The Consul tant shall assume responsibility and liability for any damage,
loss or injury of any kind or nature whatsoever to persons or property
caused bylor resulting from or in connection with any act, action, neg-
lect, omission or failure to act when under duty to act on the part of
the Consultant or any of its officers, agents, servants, employees, or
subcontractors in its or their performance of the work. The Consultant
shall defend, indemnify and hold harmless the County and any and all of
its officers, agents, servants, or employees from and against any and all
claims, loss, damage, charge, or expense, whether direct or indirect, to
which they or them may be put or subjected by reason of any such damage,
loss or injury.
14. Interest of Members of County and Others.
No officer, member, or employee of the County and no member of its govern-
ing body, :and no public official of the governing body of the locality or

localities in which the Project is situated or being carried out who
exercises any functions or responsibilities in the review or approval
of the undertaking or carrying out of this Project, shall participate
in any decision relating to the work required by this agreement which
affects his personal interest in any corporation, partnership, or asso-
ciation in which he is, directly or indirectly, interested; nor shall
any such officer, member or employee of the County, or any member of
its governing body, or public official of the governing body of the
locality or localities in which the Project is situated or being carried
out, have any interest, direct or indirect, in this agreement of the pro-
ceeds thereof.
15. Assignability.
The Consultant shall not assign any interest in this agreement, and shall
not transfer any interest in the same (whether by assignment or novation) ,
without the prior written consent of the County thereto; provided, how-
ever, that claims for money due or to become due the Consultant from the
County under this agreement may be assigned to a bank, trust company, or
other financial institution without such approval. Notice of any such
assignment or transfer shall be furnished promptly to the County.
16. Interest of Consultant.
The Consultant convenants that it presently has no interest and shall not
acquire any interest, direct or indirect, which would conflict in any
manner or degree with the performance of his services hereunder. The Con-
sultant further covenants that in the performance of this agreement no
person having any such interest shall be employed.
17. Insurance.
The Consultant shall, at no expense to the County, furnish certificates
or other evidence acceptable to the County of (a) public liability insur-
ance of at least $250,000 for all damages arising out of bodily injuries
or death to any one person and at least $500,000 for two or more persons
in one accident or occurrence; and (b) property damage liability insurance
providing for a limit of not less than $50,000. Thirty days' notice of
policy lapse or cancellation is required.
18. Findings Confidential.
Any reports, information, data, etc. , given to or prepared or assembled
by the Consultant under this agreement are confidential and shall not be
made available to any individual or organization by the Consultant with-
out prior written approval of the County. This is not intended to pre-
clude necessary coordination with other County contractors, local cities,
adjacent counties, state or federal agencies.
19. Equal Employment Opportunity.
In connection with the execution of this agreement, the Consultant shall
not discriminate against any employee or applicant for employment because
of race, �religion, color, sex or national origin. The Consultant shall

take affirmative actions to insure that applicants are employed, and
that employees are treated during their employment, without regard to
their race, religion, color, sex or national origin. Such actions
shall include, but not be limited to, the following: employment, up-
grading, demotion or transfer; recruitment or recruitment advertising,
layoff or termination; rates or pay or other forms of compensation; and
selection for training, including apprenticeship. The Consultant shall
require its subcontractors to comply with this provision.
Consultant shall further comply with provisions of the Federal Fair
Employment Practices Appendix identified as Appendix "B", attached here-
to and incorporated herein.
20. Interest of Members of Congress.
No member of or delegate to the Congress of the United States- shall be
admitted to any share or part of this agreement or to any benefit arising
therefrom.
21. Non-Collusion.
The Consultant warrants that he has not employed or retained any company
or person, other than a bona fide employee working solely for the Con-
sultant, to solicit or secure this agreement, and that he has not paid
or agreed to pay any company or person, other than a bona fide employee
working solely for the Consultant, any fee, commission, percentage,
brokerage fee, gifts, or any consideration, contingent upon or resulting
from the award or making of this agreement. For breach or violation of
this warranty, the State shall have the right to annul this agreement
without liability, or, in its discretion to deduct from the agreement
price or consideration, or otherwise recover, the full amount of such
fee, commission, percentage, brokerage fee, gift, or contingent fee.
22. Laws and Regulations.
In the performance of the work hereunder, the Consultant agrees that it
will comply with any and all laws, statutes, ordinances, rules and regu-
lations of any government, whether national, state, or local, and of any
agency of such government which relates to or in any manner affects the
performance of the work. This agreement shall be governed by and shall
be construed in accordance with the laws of the State of California.

EAST COUNTY-DELTA EXPENDITURES EFFECTIVENESS STUDY
WORK PROGRAM
ORGANIZATION
This Work Program mainly proposes an outline of work steps that would carry
out the East County-Delta Expenditures Effectiveness Study. Work to be
done -under each "phase" is divided into "methodology" and "pilot study" com-
ponents; the former is concerned with the steps to be taken to develop a
technique to evaluate the effectivenss of public expenditures in "justify-
ing" general plan alternatives, the latter deals with the application of the
technique to the alternatives selection phase of the East County General
Plan Program.
The Work Program includes a work sequence table and costing information.
In this connection it is noted that the preponderence of the work is to be
done in the first six months in order to have an influence on the East
County General Plan Program which is underway. Because of this timing,
it is proposed that draft reports be submitted to the State in approxi-
mately six to eight months after project commencement and that this sub-
mittal would be the basis for a single end-of-project billing.
PHASES
PHASE 0: PRE-PROJECT ACTIVITY
This phase of the Study is to be carried out prior to the
final approval of this project, and quite largely performed
in connection with the East County General Plan program.
This application is a substantial part of Step 0:1. 1 and
Steps 0:2.1 and 0:2.2 already have been accomplished. It
is anticipated that Step 0:2.4 will be accomplished by the
time this project is commenced (mid-1974) .

PHASE 1: SENSITIVITY ANALYSIS
The purposes of the sensitivity analysis are to identify those
facilities and services that are especially significant to in-
ducing change or are heavily impacted financially by .change.
In part, this phase is to be performed to limit the range of
facilities and services to those that should be considered in
this Study given its time and budget constraints, but this is
not the sole reason. Another reason is to attempt to focus
on those facilities that are sensitive to public expenditures
in terms of inducing or retarding development. This is to
be done in order to identify those subjects where public
expenditures policy could be most effective in managing develop-
ment. To the extent practicable, considerations of governmental
organization (e.g. , many small, single-purpose jurisdictions)
and program conflicts (e.g. , educational preferences or rural
vs. suburban populations) will be introduced.

PHASE 2: UNIT COST DETERMINATION
As was the case in the preceding phase, this is primarily
a "tooling' activity, but necessary and significant because
traditional economic studies have failed to identify and
assign certain key costs. One shortcoming is the failure
to adequately ascribe capital costs to development (e.g. ,
sewage treatment plant costs) ; another is the failure to
account for the "subsidy" to development in the form of
"front end" (or initial) capital investments that are
only ultimately covered by development; still another is
the "subsidy" hidden in the transfer of costs from direct
taxes to service charges. The emphasis on unit costs is
to facilitate the analysis of development alternatives and
sequencing later in the Study.

Debt Service) and, Where Appropriate, the Assignment of
Public Costs on a "Per Unit" Basis.

.1 Develop Costs for Increments of Service and Facilities
Installations in the Planning Area.
..2 Develop Revenue Figures for Increments of Key Land Uses
in the Planning Area.

PHASE 3: CONSTRAINTS ANALYSIS
Although this Study is predominantly an economic study, the
evaluation of public expenditure alternatives cannot be
accomplished in the context of dollar considerations alone.
Many factors, including social aid political, have profound
influences on economic strategies. This phase will attempt
to systematically identify these; however, the emphasis
will be on the "institutional" factors of laws, programs,
and the "service delivery" organization of public juris-
dictions. In particular, the constraints on taxation
imposed by recent legislation such as S.B. 90 and the
decline in programs and their associated resources will be
analyzed.
Step 3:1.0 (Methodology) Develop a Subject Framework for:
.1 Identifying the External Constraints on Facility/Service
Extensions.
.2 Identifying the External Constraints on Public Revenue
Generation and Utilization.
Step 3:2.0 (Pilot Project) Identify Planning Area Constraints Including:
.1 Organization of Public "Service Delivery" Jurisdictions.
.2 Program Availability.
.3 Legal Limitations (e.g. , S.B. 90)

\ PHASE 4: ALTERNATIVES EVALUATION
This is the main component of the Study. Preparatory to it,
the Planning Department will prepare two or more (probably 3)
general plan alternatives as part of the East County General
Plan Program. These are expected to reflect key options, and
at least one will emphasize agricultural preservation in
order to "cost" agricultural preserve and open space programs.
Then, as part of this Study, staff will prepare sequencing
(development staging) arrangements for these and identify
their public cost components.
The cost analysis of the alternative plans will focus on:
1) Aggregate public costs and revenues.
2) Impact on programs, agencies, and the public in general.
3) Impact on agencies.
4) Impact and incidence of costs.
S) An identification of the effects of public land develop-
ment policy on public costs and revenues.
The results of the evaluation will be conveyed to the East
County General Plan Committee for consideration in the
selection of development policies for East County.
Step 4:1.0 (Methodology) Develop Criteria for Evaluating:
.1 The Static and Dynamic (Phasing, "Cash Flow") Facilities and
Service Costs of Alternative Plans.
.2 The Static and Dynamic Generating of Public Revenues of
Alternative Plans.
.3 The Aggregate Qualities (Optimum Arrangements) of Alternative
Plans.
Step 4:2.0 (Pilot Project) Alternative Plan Evaluation:
.1 Convert General Plan Alternatives into Evaluation Alterna-
tives.
2 Relate Alternatives to Public Costs and Revenue Benefits.
.3 Review Costed Alternatives with General Plan Committee
.4 Prepare Findings and Conclusions.
.S Draft Report Chapter.

PHASE 5: REPORTS
The product of this Study will be a 2-part report, or 2
report set, one of which will cover methodology and serve
as a guide to evaluating public expenditures effectiveness
in other jurisdictions. The second will cover the appli-
cation of the methodology to the East County Planning Area
and will serve as an input to that area's General Plan
program. The Study proper will include the preparation of
report drafts for submission to the State, but Contra Costa
County will have to publish the final reports at its own
expense.

STAFF-CONSULTANT RELATIONSHIP
It is proposed that a specialist consultant (in public economics) be
utilized in this project to provide advice and, during the Alternatives
Evaluation Phase, expertise in evaluating the accuracy and feasibility
of the alternatives and articulating the findings and recommendations.
The consultant would also participate in meetings with the East County
General Plan Committee in, first, eliciting comments and, second, explain-
ing the findings and recommendations. However, this Study is intended to
be primarily a staff effort and staff will be responsible for the results.

During the performance of this contract, the contractor, for itself, its
assignees and successors in interest (hereinafter referred to as the "con-
tractor") agrees as follows:
(1) Compliance with Regulations: The contractor shall comply with the
Regulations relative to nondiscrimination in Federally-assisted
programs of the Department of Transportation Title 49, Code of
Federal Regulations, Part 21, as they may be amended from time to
time, (hereinafter referred to as the Regulations), which are herein
incorporated by reference and made a part of this contract.
(2) Nondiscrimination: The contractor, with regard to the work performed
by it during the contract, shall not discriminate on the grounds of
race, color, or national origin in the selection and retention of sub-
contractors, including procurements of materials and leases of equip-
ment. The contractor shall not participate either directly or indirectly
in the discrimination prohibited by Section 21.5 of the Regulations,
including employment practices when the contract covers a program
set forth in Appendix B of the Regulations.
(3) Solicitations for Subcontracts, Including Procurements of Materials
and Equipment: In all solicitations, either by competitive bidding or
negotiation made by the contractor for work to be performed under a
subcontract, including procurements of materials or leases of equip-
ment, each, potential subcontractor or supplier shall be notified by
the contractor of the contractor's obligations under this contract and
the Regulations relative to nondiscrimination on the grounds of race,
color or national origin.
(4) Information and Reports: The contractor shall provide all information
and reports required by the Regulations, or directives issued pursuant
thereto, and shall permit access to its books, records, accounts,
other sources of information, and its facilities as may be determined
by the State Highway Department or the Federal Highway Adminis-
tration to be pertinent to ascertain compliance with such Regulations
or directives. Where any information required of a contractor is in
the exclusive possession of another who fails or refuses to furnish
this information, the contractor shall so certify to the State Highway
Department, or the Federal Highway Administration as appropriate,
and shall set forth what efforts it has made to obtain the information.
(5) Sanctions for Noncompliance: In the event of the contractor's non-
compliance with the nondiscrimination provisions of this contract,
the State Highway Department shall impose such contract sanctions
as it or the Federal Highway Administration may determine to be
appropriate, including, but not limited to:
(a) withholding of payments to the contractor tinder the contract
until the contractor complies, and/or
(b) cancellation, termination or suspension of the contract, in whole
or in part.
(6) Incorporation of Provisions: .The contractor shall include the pro-
visions of paragraph (1) through (6) in every subcontract, including
procurements of„materials and leases of equipment, unless exempt
by the Regulations or directives issued pursuant thereto. The con-
tractor will take such action with respect to any subcontractor or
procurement as the State Highway Department or the Federal High-
way Administration may direct as a means of enforcing such pro-
visions including sanctions for noncompliance: Provided, however,
that, in the event a contractor becomes involved in, or is threatened
with, litigation with a subcontractor or supplier as a result of such
direction, the contractor may request the. State Highway Department
to enter into such litigation to protect the interest of the State, and,
in addition, the contractor may request the United States to enter
into such litigation to protect the interests of the United States.

visor J. E. Moriarty, Chairman, is AUTHORIZED to execute a grant
agreement between the County of Contra Costa and the State of
California, Office of Planning and Research, under the terms of
which the county will receive $20, 000 under the Comprehensive
Planning Assistance (701) grant program during the period July 1 ,
1974 to June 30, 1975 for the study of the East County-Delta area,
the total cost of said project is $40, 000 ($20,000 in grant funds
and $20, 000 in county funds) .

agreement you bind yourself to certain. grant conditions as set forth belol:-
I. That the final application, submitted by the above named Grantee to the
State of California acting by and through the Office of Planning and
Research (OPR) , be made a part of this agreement as though it were
hereto. This includes, but is not limited to, the .Follo:vring:
A. The resolution adopted by the legislative or policy body of
the Grantee.
B. The final application .form.
C The Overall Program Design or Overall Work Program.
D. The Annual Work Program including the Tabular Summary and
Payment Schedule and the Annual Work Program Schedule.
E. Statements of Coordination.
F. Statement of Assurances. .
G. Documentation of legal authorities (if required).
H. Yap of project area.
II. That the Grantee will obtain prior written approval from the Office of
Planning and Research of anv chances in the Annual Work Program or !
Budget before implementing such changes..
III. That the Grantee will administer the grant in accordance with OPR
instructions contained in "Handbook II, Managing a Comprehensive
Planning Assistance Grant" and Section 701 of the Housing Act of
1954, as amended.

WHEREAS the Board of Supervisors desires to conduct a
planning study to provide information needed for solution of
problems relative to community development and growth and to
serve as a basis for decision making and formulation of policies
to encourage a continuous planning process for the full
realization and opportunity to attain defined goals and objectives ;
and
WHEREAS the California Council on Intergovernmental
Relations, under authority of the Government Code of the State
of California, Section 34200, may provide planning assistance for
such a program and receive financial assistance from the U. S.
Department of Housing and Urban Development, as authorized by
Section 701 of the Housing Act of 19549 as amended; and
WHEREAS the Director of Planning has developed an
Overall Program Design and recommended the development of an
organizational structure as outlined in the attached Application
to deal with development problems and issues ;
NOW, THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF THE
COUNTY OF CONTRA COSTA, CALIFORNIA, RESOLVED that the California
Council on Intergovernmental Relations is requested to provide
planning assistance in the amount of $20,000 as more particularly
described in thq project description which is attached hereto . and
incorporated herein by reference; • and
BE IT BY THE BOARD FURTHER RESOLVED that the Director of
Planning is hereby authorized to EXECUTE the application forms
and related documents seeking financial assistance for the afore-
said planning study and, subject to approval by state and federal
authorities of the requested financial assistance in the amount
of $20,000, to utilize staff services on a matching basis ( up to
$20,000 in value) to implement the study.
PASSED and ADOPTED on June 11, 1974 by the following vote
of the Board :
AYES: Supervisors A. M. Dias, W. N.' Boggess,
E. A. Linscheld, J. E. Moriarty.

Director of Plannin East County Study
Last September, pursuant to our mutual interests, we submitted an application for
a federal 11701" planning grant for a project entitled "East County-Delta Expendi-
tures Effectiveness Study" that would investigate the relative costs and benefits
of public expenditures in connection wi uturre East County development alter-
is fives. As we later noted,our application proposal was received favorably and
we were asked to submit an "overall project design" in March. The State Office of
Planning and Research will accept this "overall project design" as our final appli-
cation, provided it is supplemented with an application form and a Board of Super-
visor's resolution supporting the application. Sample copies of these are attached.
Because we did not have to prepare a regular formal application, the State has as-
sumed that our Board of Supervisors has acted on the project, but since this did
not take place and the State is about to approve the surviving applications, it is
desirable that we obtain Board approval of the resolution as soon as possible. We
would appreciate it if your office would put this item on an agenda, and we would
be happy to offer whatever services would be necessary.
This Study is included in our FX 1974-75 budget proposal, but the work needs to
be"phased with the East County General_ Plan Program and should get underway this

WHEREAS, the County of Contra Costa County recognizing the
problems and issues identified in the attached Application for Comprehensive
Planning Assistance desires to provide for a planning study contributing to
improved executive planning, decision-making, and management capability; to
the encouragement of community planning and management as a continuous process;
and to the solution of problems, realization of opportunities and the formulation
and implementation of policies related to community development and growth; and
WHEREAS, the Director of Planning has developed an Overall Program
Design and recommended the development of an organizational structure as out-
lined in the attached Application to deal with these development problems and
issues; and, the California Council on--Zn eeigovernmental -Relations, under
ddf ority of the Government Code of the State of California (Section 34200) ,
may provide planning assistance for such a program and receive financial assis-
tance from the U. S. Department of Housing and Urban Development, as authorized
by Section 701 of the Housing Act of 1954, as amended;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
the County of Contra Costa hereby requests the Council on Intergovernmental
Relations to provide planning assistance under authority of the Government
Code of the State of California, with such financial assistance as may be
provided by the U. S. Department of Housing and Urban Development, under
authority of Section 701 of the Housing Act of 1954, as amended. Such
planning assistance is more particularly described in a project description
that is attached hereto and made a part of this resolution as if fully set
forth herein.
BE IT FURTHER RESOLVED, that the Board of Supervisors of the County
of Contra Costa subject to approval of such planning assistance by the State
and Federal authorities, hereby authorizes the use of personnel of the Dept.
of Planning for services and/or have a net estimated cost to the County of
Contra Costa of $20,000 in staff services contingent upon being matched by
$20,000 in grant monies.
BE IT. FURTHER RESOLVED, TOO, that the Director of Planning of
the County of Contra Costa be, and he is hereby, authorized and empowered
to execute all necessary applications, contracts, and agreements and
amendments hereto to implement and carry out the purposes specified in
this resolution.
The foregoing'Resolution was passed by the Board of Supervisors
of the County of Contra Costa this 28th day of May, 1974. Effective June 1,
1974.
