TO: CITY OF SAN PABLO c/o City Clerk One Alvarado Square San Pablo, CA, 94806 (a) Claimant : Saint Timothy Lutheran Church's post office address is 3390 San Pablo Dam Road, San Pablo, California 94803. (b) Notices concerning this claim should be sent to Robert P. Brorby, Attorney at Law, 1211 Newell Ave. , Walnut Creek, California 94596 . (c) The circumstances which gave rise to the claim asserted became known to claimant on or about January 25, 1983. (d) On or about January 25, 1983, a crack was noted in claimant's upper parking lot which later resulted in a buckling across the parking lot in a general east/west direction apparently as pressure occurred in a general southerly to northerly direction from the land immediately south of claimant's property. As of the date of the preparation of this claim and since approximately late February, 1983, the church's southerly parking area has been unuarable with the exception of the most northerly portion of thalt lot. The slide mass is currently applying pressure in a generally southerly to northerly direction effecting the improvements upon claimant' s property including the primary structure .thereon. Claimant' s injuries are and will be a total and/or partial loss of the use of their property and a permanent total and/or partial diminution in the value and equity of EXHIBIT A r, r , said property, all in an amount unknown to claimant ,at this time. Claimant is informed and believes and thereupon alleges that said damage has been and will be caused by the local public entity's failure to maintain property - as to which it has title and/or possession and/or total or partial control over - "in a reasonably safe manner, and failure to adhere to certain discretionary and mandatory duties, and the creation of a public nuisance. (e) The name or names of public employees causing the injury, damage or loss is unknown to claimant at this time. (f) To date claimant has expended the sum of $17, 023.25 for purposes of repair of- their property and mitigation of their damage and said costs will continue in an amount presently unknown to claimant. Claimant ' s damage or loss also includes diminution in value of its real. propertyin an amount presently unknown to claimant and claimant's damage will ultimately exceed $750, 009 unless the local public entity as to which this claim is made and other adjacent property owners take adequate steps to prevent .further damage to claimant's property. Executed on December 27, 1983 at Richmond, California.
