HomeMy WebLinkAboutMINUTES - 08061985 - 1.15 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 6., 1985 , by the following vote: AYES: NOES: (See Below) ABSENT: ABSTAIN: SUBJECT: Proposed Clyde Park Tennis Court County Service Area M-16 The Public Works Director submitted to the Board proposed Plans and Specifications for construction of - a tennis Court in a ' park located at Norman Avenue and Trafalgar Place , Clyde area, which is within County Service Area M-16 . The Engineer's cost estimate for the initial construction contract is $20,000 base bid . The Public Works Director recommended approval of the Plans and Specifications and authorization to advertise for bids which are to be received on September 5 , 1985 . Supervisor McPeak advised there is some dispute relative to who has ititle. to the site of the proposed tennis court--the County or private land owner(s) . Don Freitas , former County Service Area Coordinator , advised that the site of the proposed tennis court has been iden- tified as park property. A grant of $20 ,000 was awarded by the State in 1980 to fund this project at the proposed location. Mr . Freitas inferred that the State would not have granted the funds if the title of the property was not vested in the County. He cautioned that delays in construction of the tennis court might jeopardize the funds since they must be used by July 1 , 1986 . Dee Kilroy, President , Citizens Advisory Committee for County Service Area M-16 , commented on the importance of the tennis court to .the community of Clyde . . Maurice Huguett , attorney for the landowners , spoke on the question ofownership of the proposed site and the need to resolve this question before construction of the tennis court begins. He referred town application for a General Plan Amendment for that area scheduled to be heard by the County Planning Commission on August 14 , 1985 . If the General Plan Amendment is approved , a deve- loper will submit plans for a project that will include a recreation area which, in his opinion, would be a better alternative than what is currently before the Board . Supervisor McPeak expressed concern that even if a General Plan Amendment is approved , it will be several months before a deve- lopment plan is presented for approval . Delays in resolving this problem might impact on the construction schedule since at the earliest the project will be started in October when weather con- ditions are, not always favorable . Supervisor McPeak requested a one-week delay to allow her further opportunity to meet with all parties to seek resolution to the problem. Supervisor Powers commented on the need to review the issues noted in terms of ownership and potential litigation related thereto , and possible loss of funds if construction is delayed. He suggested that staff review these issues with all interested parties and advised that he believes a two-week delay would be more appropriate. Supervisor McPeak moved that the Board defer decision on this matter for one week, the motion seconded by Supervisor Torlakson, the vote was as follows: AYES: Supervisors McPeak, Torlakson NOES: Supervisors Powers , Schroder , Fanden ABSTAIN: None The motion failed to carry. Thereupon, Supervisor Powers moved that this matter be continued to August 20, 1985 , and that the Community Development Director and Public Works Director report to the Board on the issues of land ownership including litigation potential , construction timetable of the project , and the possibility of funds being withdrawn if construction is delayed . The motion was seconded by Supervisor Schroder , the vote on the motion was as follows: AYES: Supervisors Powers , Schroder , Fanden NOES: Supervisors McPeak, Torlakson ABSTAIN: None The motion carried .
