JERSEY ISLAND FERRY The Jersey Island Ferry, "Victory II," reopened for regular service as of October 4, 1974. VETERANS MEMORIAL BUILDING REMODEL - Building Maintenance 1341 It is recommended that the Board of Supervisors approve Addendum No. 2 to the contract documents for the Veterans Memorial Building, Richmond. This Addendum provides a revised bid proposal form. There is no change in the Architect's estimated cost of construction. This Addendum has been distributed to all listed planholders. PAUL PETERSEI%1 REQUEST FOR REIMBURSEMENT AGREEMENT - Work Order 8505 - Sans Crainte Drainage Area The Board of Supervisors, through its Order of July 29, 1974, referred to the .Public Works Director and County Counsel a letter from Mr. Paul C. Petersen in which he requested that an agreement be prepared to provide reimbursement for his costs in constructing offsite drainage improvements in the vicinity of Rudgear Road and San Miguel Drive. A similar letter was directed to the Walnut Creek City Council. County and City staff members have met and reviewed the request. It was generally agreed that some reimbursement to Whitecliff Homes would be reasonable. It is recommended that the Board direct the Public Works Director and County Counsel to prepare an appropriate agreement with the City of Walnut Creek and Whitecliff Homes. The agreement shall provide that reimbursement will be limited to drainage fees collected within the Sans Crainte subwatershed basin encompassing the Whitecliff Homes Development. (FC) Report B. SHERATON INN MOTEL COMPLEX LEASE - Buchanan Field By Order dated July 9, 1974, approving the delinquent rental payment plan, the Board of Supervisors also directed the Public Works Director to make monthly reports to the Board as to Lessee's performance on future payments of rents due to the County. As of October 1, 1974, the Lessee has made all pay- ments due to bring the minimum ground rents and rental percentages current. He has also paid the third installment payment of $9,738.65 as set by the County Auditor-Controller. (A) Report C. N.kVAJO AVIATION LEASE - Buchanan Field By Order dated August 20, 1974, approving the delinquent rental payment plan, the Board of Supervisors also directed the Public Works Director to make monthly reports to the Board as to Lessee's performance on future payments of rents due to the County. MARKET AVENUE - Road No. 0562 - North Richmond Area At the request of the A. C. Transit District and after an engineering study, it is recommended that Traffic Resolution No. 2010 be approved as follows: Pursuant to section 22507 of the California Vehicle Code, parking is hereby declared to be prohibited at all times, except for the purpose of loading or unloading bus passengers, on the south side of MARKET AVENUE (Rd. 10562) , North Richmond, beginning at a point 16 feet east of the centerline of Fifth Street and extending easterly a distance of 48 feet. (TO) Item 2. NORTH RICHMOND STORM DRAIN PROJECT - Project H.U.D. No. W.S.-CALIF_-436 - Work Order 8780 - North Richmond Area The contract for the pump station and discharge system for the North Richmond Storm Drain Project was completed by the Centractor, Elmer J. Freethy of El Cerrito, on September 6, 1974, in conformance with the contract and the approved plans, at a contract cost of approximately $878,000. It is recommended that the Board of Supervisors accept the contract as complete as of September 6, 1974. It is further recommended that a 21-day extension of contract time be granted due to weather caused delays which were not taken into consideration when the weekly statements of working days were issued, and difficulties with materials suppliers which resulted in delays. ELECTION TALLY CENTER 610 Marina Vista, Martinez - Building Maintenance 11369 - Martinez Area Pursuant to the oral directive given by the Board of Super- visors to the County Administrator on June 5, 1974 to investi- gate the causes of"failures or delays in the vote count tally for the June election, the following information and recommen- dations have been obtained. The Tally Center facility, which houses the vote counting equipment, has been evaluated by" the Cubic Industrial Corpor- ation, manufacturer of the counting equipment, as a res-alt of the tallying failures and delays last June. Fluctuations of temperature and h•.tidi.ty were reported which varied widely from the recommended temperatures of 70* F. to 80° F. Although a combination of factors contributed to the June breakdown, Cubic Industrial Corporation suggests that air conditioning and humidification equipment be installed to maintain their recommended environmental conditions in order to protect the substantial investment the County already has in the Tally Center equipment. The cost of the installation will be about $302000 with the major portion of the cost recoverable as removed equipment at some future date if the sub-lease for the premises with Earl and Joann Dunivan should be terminated. The current sub-lease expires May 15, 1978. By memorand= dated September 3, 1974, James R. Olsson, County Clerk, recommends the installation of cooling and humidification equipment before November 5, 1974 in order to have the premises ready for the November 5, 1974 election. In order to accomplish the installation as- described above in time for the November election, it is rec-- ended that the Board of Supervisors declare that an emergency exists and direct that the Public :,forks Department proceed in the most expeditious manner, pursuant to Government Code Section 25458, to accomplish the installation. Sauer, Public forks Director SUBJECT: Appeal of City of Malnut Creek on Bancroft Green (LUP 3005-74) (11:30 a.m. Item on October 8, 1974 Agenda) As directed by the Board of Supervisors, Mr. Michael Walford of our Land Develop- ment Division met with Mr. Eddie Peabody, Chief of Planning of the City of Walnut Creek, to analyze the conditions which the City desires to have added to those which the Planning Commission has already approved. These conditions involve improvements along the Bancroft Road and Ygnacio Valley Road frontages and improvements to the intersections of Bancroft Road at Ygnacio Valley Road, Bancroft Road at Banbury Road, and Bancroft Road at Stratton Road, the latter two being the two entrances to the 800+ unit "Bancroft Green." The City has set up what they feel are appropriate requirements forimprovements along Bancroft Road and Ygnacio Valley Road and is recommending that they be programmed with each of the three "Phases" under which it is anticiplted Bancroft Green will be developed. It should be noted that Phase I is the only one under consideration it this time. It is the most northerly and consists of slightly over 200 units. Phase II will be the slightly larger center section, while Phase III is adjacent to Ygnacio Valley Road and is double the size of either previous phase, consisting of about 400 units. Following are the proposed conditions of Walnut Creek on each of the three phases of the development of Bancroft Green. Phase I 1. Provide a new signal controller for the intersection of Bancroft Road and Ygnacio Valley Road together with new detector loops and appropriate lane striping. This improvement is estimated to cost approximately $15,000 and will result in much greater capacity through the intersectioI for Bancroft Road traffic. 2. Widen the southbound approach lanes to the Bancroft-Ygnacio intersection to acco=odate free richt turns and additional through and left turn capacity. 3. Phase II 1. Construct a dual left turn lane on Ygnacio Valley Road eastbound. This will require some widening, new signal heads and possibly some right of way` acquisition. The present left turn lane is carrying about 250.vehicles per hour at peak times. A single left turn lane is only good,for about 300 vehicles per hour, so the 50 vehicles per hour contributed by Phase I of Bancroft Green will use up the available capacity. The second left turn land must be constructed-with the second phase to avoid the possibility, or probability, that failure to do so would cause left turning cars to block a through lane on Ygnacio Valley Road. This condition would most likely cost the developer about $100,000. 2. Install traffic signals at Stratton Road. 3. Complete all remaining frontage improvements along Bancroft Road adjacent to Phases II and III. Phase III 1. Construct frontage improvements on Ygnacio Valley Road. 2. Reconstruct the two small free right turn islands on the north s .de of Ygnacio Valley Road at Bancroft to permit three through lanes on Ygnacio Valley Road. 3. Interconnect the traffic signal at Ygnacio Valley Road and Bancr--ift with signal at Ygnacio Valley Road and San Carlos. Following are the recommendations of Public Works Department after r;viewing and considering Walnut Creek's request. Phase I The new controller and detector loops for the Ygnacio-Bancroft intervection are an appropriate and reasonable condition of the first phase. The new controller would be adequate to handle all further modifications to the interse:tion without replacement. Bancroft Road is presently a single lane wide approaching Ygnacio Valley Road, so through and left turning traffic can block the right turning movement and cause unnecessary congestion. lye therefore feel that the widening of Bancroft [:oad as it approaches Ygnacio Valley Road, say for 300 feet, would be a recommended and reasonable condition. Since this widening is adjacent to Phase III it would be required at a latter date anyway. 6OC65 � y v -r • i l Board of Supervisors -3- October 7, 1974 A City developer is already lengthening the eastbound Ygnacio left turn lane. We feel that further lengthening is not advisable, but that dual left turn lanes should be created with a later Phase of development Total cost of these Phase I improvements are estimated to be about $30,000. Phase II Construction of the dual left turn lane is a necessity but, for cash-flow and coordination reasons, we would prefer to see it done with the larger•Phase III. This will slightly overtax the left turn lane for a short period of time-, especially if Sandy Cove Shopping Center goes into operation before Phase III. There is also the risk of the.County or City having to make these improvements if Phase III does not go ahead and Sandy Cove does. Construction of the entire Phase II and III frontage improvements along Bancroft Road would be a good idea, because it would complete what would otherwise be -a short gap and Mould also relieve some of the frontage costs from the otherwise heavy burdens of Phase III. The Department will make appropriate recommendations regarding the Stratton Road signals with our other Phase II recommendations, as we did with Banbury Road in Phase I. Phase III With Phase III, we would recommend that the developer improve his Ygnecio Valley Road frontage, construct the dual left turn lanes on eastbound Ygnaci) and de all other intersection improvements as recommended by WalnutCreek. :his would result in a less extensive time for improvements on Ygnacio to be und!r con- struction, and the planning and design could be much better coordinat•:d. he do not believe the interconnection of the Bancroft Road and San Caclos Drive signals is a proper requirement of this developer. Some of these improvements are partially required due to anticipated increased traffic on Bancroft Road as a result of Sandy Cove Shopping Center. ?n the other hand, a sizable portion of the Bancroft Green traffic will be utilizing the Treat-Bancroft intersection, where Sandy Cove will be making some $250,000 in intersection improvements; so in the final analysis, we feel that Ifallut Creek's recommendations are valid and reasonable, and encourage the Board to add the following conditions to Bancroft Green, Phase I. 1. Developer shall furnish and install a new signal controller and detector loops at the intersection of Bancroft Road and Ygnacio Valley Road, and shall remove and relocate traffic striping, as necessary. Fluctuations of temperature and humidity were reported which varied widely from the recommended temperatures of 70o F. to 80o F. Although a combination of factors contributed to the June breakdown, Cubic Industrial Corporation suggests that air conditioning and humidification equipment be installed to maintain their recommended environmental conditions in order to protect the substantial investment the County already has in the Tally Center equipment. The cost of the installation will be about $30,000 with the major portion of the cost recover- able as removed equipment at some future date if the sub-lease for the premises with Earl and Joann Dunivan should be terminated. The current sub-lease expires May 15, 1978. "By memorandum dated September 3 , 1974, James R. Fire Protection District Zones SB 1916 (Neledly) was enacted into law as Chapter 438, and amends Section 13391 of the :Health and Safety Code to permit the establishment of zones within a Fire Protection District for paying certain ongoing hater charges that are of sole benefit to the zones. 3. Anpointment of Counsel for Minor Permissive not Mandatory SB 11027 (Nejedly) , to amend Welfare and Institution Code §634 .5 to make the appointment of counsel for a minor-in-unfit-home hearing (W. &I. C. 5600(d) ) permissive rather than mandatory failed to pass the Senate Judiciary Committee. 4. Use of Insurance Proceeds for County Appropriations Air 3-499 (Knox) was enacted into law as Chapter 526, and amends Section 29130 of the Government Code to allow a county to use its insurance proceeds for specific appropriation. 5. County Contracts for Special Services AB 3565 (Boatwright ) was enacted into law as Chapter 558, and amends Section 31000 of the Government Code to expressly permit a county to contract for architectural services, training for county employees , and secur.ty services for county buildings. Permit County Purchasing Agent to Lease Personal Property SP 1917 (Nejedly) was enacted into law as Chapter 543, and amends Sections 25504 and 25505 of the Government Code to allow county purchasing agents to lease-out personal property of the county or of a special district not required for public use, in the same manner as he may now sell such property. 7. Acceptance of Small Gifts to County AB 3566 (Boatwright) was enacted into law as Chapter 559, and amends Section 25355 of the Government Code to permit a Board of Supervisors to delegate its power to accept gifts to the county if the value does not exceed $100.00. 8. County Municipal Court Personnel AB 3483 (Knox) was enacted into law as Chapter 1309, and changes the salary and position of various officers and attaches of the Municipal Courts in the county, adds an additional judgeship for the Walnut Creek-Danville JudiciAl District, increases the salaries of regular official Superior and Municipal Court reporters, and increases specified additional filing fees in the Superior and Municipal Courts of the county from $13 to $14. 9. Consolidation of Marshals ' Offices SB 2436 (Nejedly)to consolidate Marshals ' Offices of the Delta and Mt. Diablo Municipal Court Districts, failed to pass the Assembly Judiciary Committee because that Committee's hearing was cancelled at the request of the author of the Bill. 10. County Service Areas AB 4326 (Knox) was enacted into law as Chapter 877, and amends Section 25210.90 of the Government Code to provide that territory withdrawing from a County Service Area, for which the county for the benefit of the Service Area has incurred specified indebtedness or other contractual obligations, shall nevertheless be liable for assessment and payment of a tax for its pro rata share of such indebtedness or contractual obligation. An initial application/budget for fiscal year 1974-1975 was submitted in March 1974 based upon the preliminary county allocation. At that time, as you may recall, the Director, Human Resources Agency alerted your Board to potential problems in the Local Programs category of the budget because of inadequate funding. Subsequent meetings between State Department of Health and Office of Alcohol Program Management personnel and county staff produced positive results for the county. The final fiscal year 1974-1975 Short-Doyle allocation for Contra Costa County was increased substantially over the preliminary allocation. The revised allocation for Local Programs, inclusive of local mental health programs, alcoholism programs and drug abuse programs, was increased in combination by $457,541 in Gross Program and $326,321 in Net Program; increases of 6.3% and 7.4%, respectively. Local programs funded with federal Social Rehabilitation Service (SRS) funds remained unchanged from the initial allocation.
