HomeMy WebLinkAboutMINUTES - 08201985 - 2.3 THE BOARD OF SUPERVISORS OF CONTRA COSTA 'COUNTY, -CALIFORNIA Adopted this Order on August 20 , 1985 , by the following vote: AYES: Supervisors Powers , Schroder , McPeak, Torlakson , Fanden NOES: None ABSENT: None ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Request of the City. of Berkeley for Continued Solid Waste Disposal at the West Contra Costa Sanitary Landfill A. A. Dehaesus , Community Development Director , presented to. the Board a report , dated August 1 , 1985 (copy attached hereto and incorporated herein) recommending three actions relative to the request of the City of Berkeley to be allowed to continue to dispose of its solid waste at the West Contra Costa Sanitary Landfill (WCCSL) . He noted that without the continuation of Berkeley' s waste , the WCCSL is estimated to reach capacity in 1992. If Berkeley's waste continues to be deposited at that landfill site through December 1987 , that site will close sometime in 1991 . Mr . Dehaesus advised that in order to mitigate the impact of an accelerated closure it is being recommended that tonnage fees be increased to include a capacity use charge as well as a local host community charge . Mr. Dehaesus referred to discussions with representatives of the West County cities and the operators of the landfill site resulting in a letter dated July 1 , 1985 being sent to the City of Berkeley proposing conditions under which WCCSL would be able to continue to accept that city' s waste . In its discussion the Board expressed concern relative to providing for the disposal of Contra Costa County' s solid waste at landfill sites within the County that are rapidly reaching capacity. The Board inquired as to the interest of the City of Berkeley in paying the proposed increased charges . Charles Lachman , Assistant Public Works Director for the City of Berkeley , noted that the City Council is on summer recess to September 10 , 1985 , and requested the Board to defer action on this matter to that date . He claimed that the increased tipping charges translate to a $ 1 .2 million annual charge . He advised that his staff cannot make any commitments until this matter has been con- sidered by the City Council . Board members discussed the matter further and were in agreement to amend the conditions in an attempt to reach an early solution to the problem. Therefore , IT IS BY THE BOARD ORDERED that the following recommendations are approved: 1 . Issue a statement advising that because of the special circumstances involved , continuance of disposal of solid wastes from the City of Berkeley at the West Contra Costa Sanitary Landfill can only be found con- sistent with the Contra Costa County Solid Waste Management Plan if the negative impacts of the disposal are fully offset by measures including paying: a charge for closure costs of the landfill , a capacity use charge representing costs due to accelerated clo- sure of the landfill , and a local host community charge as specified in this Board Order; 2. Agree that the WCCSL will stop receiving solid waste from the City of Berkeley on September 30, 1985 if the City of Berkeley does not respond or act on staff' s conditions; 3. Amend Condition No . 4 as set forth on Page 2 of the report to require the Alameda County Solid Waste Management Authority to submit , within 60 days of this order , written agreement to accepting Contra Costa County waste in Alameda County following the closure of the Acme Landfill; 4. A policy statement is adopted to the effect that if the City of Berkeley agrees to fully offset its impact of continued disposal , the payment of capacity use and local host community charges shall be retroactive to the effective date of this order . IT IS FURTHER ORDERED that the Director of Community Development is instructed to draft a letter to Alameda County rela- tive to the importation of solid waste and the impacts this would have on both counties relative to capacities being reached at land- fill sites , and requesting that representatives from both counties meet to develop a plan to resolve the issue . j I hereby certify that this Is ,'weand correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
