SUBJECT: REQUEST OF THE CITY OF BERKELEY FOR CONTINUED SOLID WASTE DISPOSAL AT THE
WEST CONTRA COSTA SANITARY LANDFILL

Specific Requests or Recommendations & Background & Justification
RECOMMENDED ACTION
1. State that because of the special circumstances involved, continuance of disposal of
solid wastes from the City 'of Berkeley at the West Contra Costa Sanitary Landfill can
only be found consistent with the Contra Costa County Solid Waste Management Plan if
the negative impacts of the disposal are fully offset by measures including paying: a
charge for closure costs of the landfill (effective August 1, 1985) , a capacity use
charge representing costs due to accelerated closure of the landfill , and a local host
community charge as specified in this Board Order.
2. State that without prompt concurring action by the City of Berkeley to the above
measures, disposal by Berkeley at the West Contra Costa Sanitary Landfill shall cease
within 30 days of the effective date of this order.
3. State that if the City of Berkeley agrees to fully offset its impacts of continued
disposal , the payment of capacity use and local host community charges shall be
retroactive to the effective date of this order.
FINANCIAL IMPACT
No significant financial impact to the County. However, the County collects fees for solid
waste management and enforcement based on the tonnage received at landfills. It is estimated
that the enforcement program will lose $6,800 (based on a fee of 10 cents per ton) and that
the solid waste planning program will lose $13,000 (based on 19 cents per ton fee) . These
are projected losses for Fiscal Year 1985/1986. In future fiscal years, no actual losses
will occur because the fees will be adjusted to represent a smaller total tonnage of waste
disposed in the County.
REASONS FOR RECOMMENDATION/BACKGROUND

Sinee August 1983, the City of Berkeley has disposed of approximately 225 tons per day
(seven day average) at the West Contra Costa Sanitary Landfill (WCCSL) . Waste from the

City of Berkeley is hauled from the city transfer station to the WCCSL for disposal .
Approximately 15 trips per day by large transfer vehicles are made. The WCCSL receives about
1,100 tons per day of solid wastes, including waste from Berkeley.
The County Solid Waste Management Plan recognized that waste from the Berkeley transfer
station was to be disposed of at the WCCSL for a two-year period, from mid-1983 to mid-
1985. The Solid Waste Management Plan states that any major imports, as determined by the
Board of Supervisors, will require an Amendment to the Plan. Since the Solid Waste Manage-
ment Plan only shows Berkeley' s waste to be delivered to the WCCSL to "mid-1985" , the
Board should determine that after "mid-1985" Berkeley' s waste should be considered a major
import subject to a determination of consistency with the County Solid Waste Management Plan.
In a letter dated April 4, 1985, Berkeley requested continued use of the WCCSL for disposal
through December 1987. County staff had earlier alerted Berkeley to the need for a consis-
tency determination. On May 21, 1985, the Board authorized the Community Development
Department to negotiate with the City of Berkeley to "insure that mitigation and compensation
is provided by Berkeley for adverse impacts from the import of the waste" . The Community
Development Department has met with the City of Berkeley, Richmond Sanitary Service, and
the West County Mayors Solid Waste Committee on this matter on several occasions. Based on
these deliberations, a letter dated July 1, 1985 was sent to the City of Berkeley outlining
the conditions on which staff stated a recommendation can be made to the Board of Supervisors
that continuance of Berkeley waste is consistent with the County Solid Waste Management
Plan. These conditions are as follows:
1. The City of Berkeley must pay a charge for closure costs for the landfill due to new
closure requirements promulgated by the State Water Resources Control Board. Richmond
Sanitary Service has informed Berkeley that a charge for closure of $6.99 per ton will
be assessed to Berkeley effective August 1, 1985. This is the same increase that is
proposed to be assessed to all users of the landfill .
2. The City of Berkeley must pay a capacity use charge of $5.85 per ton, which is an
assessment for the value of landfill volume used by Berkeley waste. This charge
offsets future additional costs because the imported solid waste causes the landfill
to reach capacity sooner and the users of the landfill will be required to use a more
expensive method of transport and disposal sooner. Money collected by this fee should
be used to benefit the West County users of the landfill .
3. The City of Berkeley must pay a local host mitigation charge. This charge of $1.00
per ton is to compensate the Cities of Richmond and San Pablo which are directly
impacted by the import of Berkeley solid waste. These funds will be used for impacts
suffered along the haul route.
4. The continuance of use of the WCCSL will be dependent on approval of the Alameda
County Solid Waste Management Authority for disposal of Contra Costa County waste in
Alameda County after the closure of Acme Fill , and until a new landfill in Contra
Costa County is operational . If Alameda County should deny a future request of
import for Contra Costa County waste, then waste from Berkeley will cease being
disposed of in Contra Costa County landfills 30 days thereafter.
The above conditions for continuance of Berkeley waste disposal at the WCCSL have been
approved by the West County Mayors Solid Waste Committee.
In a letter dated July 15, 1985, the City of Berkeley stated that any effort by the County
to stop the disposal of Berkeley's waste at the WCCSL would be "viewed as interfering with
our (Berkeley' s) contractual relationship with the WCCSL". They state that any discussion
of any additional charges should not be a part of the County's determination of consistency.
Without the continuance of Berkeley' s waste, the WCCSL is estimated to reach capacity in
1992. If Berkeley's waste continue through December 1987, the landfill will close approxi-
mately one year earlier, in 1991. The closure of the WCCSL will be further accelerated if
waste from the Acme Fill service area are diverted to the WCCSL after Acme closes, as
expected in June 1987. If wastes are not allowed to be exported out of Contra Costa
County, all County landfills will reach capacity in 1989.
If the City of Berkeley decides not to use the WCCSL, the most likely options are the
Altamont or Vasco Road landfill , in eastern Alameda County. Since Berkeley has a transfer
station, it is logistically possible to send waste to these landfills easily and with very
little inconvenience or disruption of service. Staff from Berkeley has informed us that
additional transfer truck capacity would have to be arranged and additional manpower would
be necessary. County staff has been unable to obtain information pertaining to the economics
of use of the Alameda County landfills versus use of the WCCSL from the City of Berkeley.

CONSEQUENCES OF NEGATIVE ACTION
Berkeley will continue to use the WCCSL and not contribute to offsetting its impacts. The
WCCSL will reach capacity approximately one year earlier (or sooner, if Berkeley continues
beyond December 1987) resulting in an increased cost to West County users of the landfill
of approximately $1.2 million.
