" HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA TO: BOARD OF COMMISSIONERS DATE: August 20, 1985 FROM: cc: Perfecto Villarreal , Executive Director SUBJECT: TRANSFER OF PROPERTY - CAL 11-139 WEST PITTSBURG - CONTRA COSTA COUNTY FLOOD CONTROL DISTRICT I. RECOMMENDED ACTION: Approve transfer of a portion of Assessor' s Parcel No. 097-260-018, as described in the attached Grant Deed, to the Contra Costa County Flood Control District for construction of a concrete drainage channel and authorize execution of the Grant Deed by the Chairwoman, as recommended by the Advisory Housing Commission. II•. FINANCIAL IMPACT: Transfer of this property from the Housing Authority of the County of Contra Costa to the Contra Costa County Flood Control District for construction of a concrete drainage channel would create no financial impact on the Housing Authority. III. REASONS FOR RECOMMENDATION/BACKGROUND: The Contra Costa County Flood Control District had requested an easement of a portion of Assessor's Parcel No. 097-260-018, CAL 11-13, West Pittsburg, for use in the construction of a concrete drainage channel . This concrete drainage channel will connect with East Bay Municipal Utility District facilities already in place and will be constructed under the direction of and according to the requirements of the Contra Costa County Flood Control District. Once the drainage channel is constructed, main- tenance of the area would become the responsibility of the Flood Control District. We have determined that the topography of the requested easement area, located at the farthest easterly boundar: of CAL 11-13, West Pittsburg, is of no use to the Housing Authority for development. Additionally, this area is a natural low point suitable only for use as a natural drainage route. However, the concrete drainage channel , which will be 23 feet wide and 5 feet deep, will be an open channel , and, should an easement be granted, the Housing Authority would assume responsibility for liability on this open channel . Staff has determined that the on�y alternative to granting the easement and accepting liability, is transfer of ownership to the Flood Control District. Attached is a copy of the proposed Grant Deed and Exhibit A, describing the property, along with a map locating the exact position of the property in CAL 11-13, West Pittsburg and a map giving the exact metes, bounds and dimensions of the area in question. IV.
