Authorize Chairman, Board of Supervisors, to execute Service Agreement with Cubic Industrial Corporation for the provision of maintenance and other services for county-owned Votronics Mote Counting equipment for fiscal year 1974-1975 at a total cost of $55,650.00. 26. Authorize Chairman, Board of Supervisors, to effectuate ent on behalf of tae Board in the agreement between the County of Contra Costa and International Business Machines Corporation approved by the board on August 20. 1974. The supplementary grant would provide a third site in central county and would increase the scope of the project by approximately $75,000 for a total annual project cost of approximately $350,000, 29. Authorize Chairman, Board of Supervisors, to execute agreement between the County of Contra Costa and the State of California, Department of health, to conduct a screening program to detect potentially debilitating health conditions in elederly persons (age 60 years and over) in four locations in the county during the period from September 1, 1974 through August 31, 1975, as recommended by the Acting County Health Officer and the Director, Human Resources Agency. DEADLT14E FOR AGENDA ITEKS: THURSDAY, 5:04 P.M. 0001V N i CONTRA COSTA-COUNTY PUBLIC WORKS DEPARTI4ENT MARTINEZ, CALIFORNIA r RC1 !. September 30, 1974 AGENDA REPORTS Report A. CAMINO PABLO - Road No. 3224 - Moraga Area - The Board of Supervisors, through its order of July 2, 1974, referred to the Public Works Director, a letter from Mrs. Kathy Fretz, President, Camino Pablo Branch, Moraga Parents Club and Mr. Charles E. Toll, Principal, Camino Pablo School, requesting that the County provide an adult crossing guard to supervise students crossing Camino Pablo on their way to and from the Camino Pablo School in Moraga. Some time ago the Board of Supervisors adopted a policy for providing adult crossing guard services. The policy is based upon a method developed by the Institute of Traffic Engineers, a national professional organization.. Basically, this method determines whether adequate gaps exist in a stream of traffic. If there are gaps long enough so that the pedestrian does not have to wait more than 60 seconds for such a gap, then no control is required. On the otherhand, if the gaps are not Sufficiently long or occur too infrequently, thf.n control of some sort is indicated. On July 16, 1974, the Public Works Department r,.-ported to the Board that since this request was receiv,:d in July, students were not attending school during regular School hours- and the Department could not condut.-t the appropriate studies until the normal school year began. Using the Board's policy and the method describ<:d above, the Public Works Department conducted studies d-tring the week of September 16 through September 20 o-3 Camino Pablo at the intersections of Hodges Drive and oxford Drive. The Department found that adequate "gap ;" in traffic exist on Camino Pablo, therefore, in ke !ping with the Board's policy, the Public Works Department recommends that the request for an adult crossing guard be denied. At the present time the intersections of Camino Pablo at Hodges Drive and Camino Pablo at Oxford Drive are both being serviced by the School's student Saft:ty Patrol. The student Safety Patrol has been in operation at these locations for quite some time and it appears that the Safety Patrol is working quite well. It is the opinion of the Public corks Department that the student Satety Patrol is providing adequate protection for those students vho must cross Camino Pablo and the Department feels that the school should be encouraged to continue this program. (continued on next page) A G E !I D A Public Works Department Page 1 cif 10 September 30, 1974 00011 TWMR Report A continued: 1hile making the field review on this matter, the Public Works Department found that, due to road frontage improvements being constructed in conjunction with subdivision developments, Camino Pablo in the vicinity of the School, is being transformed from the original tv o lane road to a four lane road. The Department plans to revise the road striping, repaint and adjust existing crosswalks to accommodate the Hider roadway when all of the pavement widening is completed. (Clerk to send copy of this Report to Mrs. Fretz and Mr. Toll) Board Action required. (TO) SUPERVISORIAL DISTRICT I Item 1. LENOK ROAD - Road No. 1655 - Work Order 6065 - Kensington Area It is recommended that the Board of Supervisors approve Work Order 6065 in the amount of $9100 and authorize the Public Works Director to arrange for the construction of a type II mar.-hole 20 feet deep at #85 Lenox Road : and reconstruct the existing type "c" inlet to County standards at #95 Ardmore Road in the Kensington area. The construction work will be done by Richmond Crane Services who eras the lowest of four bids received. This work is a Class 1 Categorical Exemption from Environmental Impact R:port requirements. (M) SUPERVISORIA DISTRICT II Item 2. COUNTY SERVICE AREA L-12 - Vine Hill Area At the request of local citizens and in conformance with the policy on street lighting, Resolution No. 72/341, it is recommenled that the Board of Supervisors authorize the Pacific Gas and Electric Company to energize nine (9) 7,500 lumen, mercury vapor street lights in Subdivision 4422 along Morello Avenue and Midhill Road. The lights shall be energized in conformance with the drawing entitled "County Service Area L-42, Subdivision 4422, " dated September 24, 1974 , which is on file in the Traffic Ergineerirg Division of the Public Works Department. PACIFIC COAST INTERCOLLEGIATE FLYING ASSOCIATION CONFERENCE - Buchanan Field The Pacific Coast Intercollegiate Flying Association has tentatively selected Buchanan-Field for its annual SArECON conference to be held on November 8, 9, and 10, 1974. The conference will consist of safety meetings and aviation events such as: cross-country navigation, precision landings, and message drops. None of these activities require a waiver of Federal Aviation Admin- istration or Airport regulations. Arrangements have been made with the Sheraton Inn-Airport Motel for accommodations and conference rooms. The event is planned for participants only and is not intended to attract or accommodate spectators. The activities have been discussed with representatives of the FAA Air Traffic Control Tower, and the event has received the endorsement of the Aviation Liaison Committee at its September 17th meeting. The Public Works Director recommends that the Board of Supervisors authorize the use of Buchanan Field for the conference on the condition that the Association provide the County with (1) a certificate of insurance naming the County as an additional insured in the minimum amount of $500,000/1,000,000 bodily injury and $100,000 property damage, and (2) a hold harmless and indemnification provision in favor of the County. COUNTY 'TRANSIT SLRVICE AREA T-2 On September 25, 1974, the Board of Directors of AC Transit approved a resolution to the effect that upon successful adaption of Proposition L it would be their intention to contract with the County to operate a local transit service within the T-2 Service Area boundary. The resolution outlined that an appropriate written document would be prepared in detail to include, but not limit to, the following provisions: 1. That AC Transit shall act as an independent contractor to operate and maintain the buses necessary for the local transit service. 2. County shall establish the routes, levels of service, and fare structures with appropriate advice and counsel of AC Transit. 3. AC Transit shall prepare and file necessary documents to obtain Federal financial assistance, including applications to the Urban I1iass Transportation Administration and any other appropriate Federal Agency. 4. AC Transit shall likewise file all necessary documents with the Metropolitan Transportation Agency for the purpose of obtaining funds available under the Transportation Development Act of 1971. 5. All revenues derived from the operation of the local transit service shall be credited to the County. 6. The County (T-2 Ser-rice Area) shall pay AC Transit all of its costs in:urred in operating the service. The Local Mass Transportation Advisory Commission has been considering various details of the proposed agree- ment with AC Transit, iicluding all those mentioned above. At the time the Board of Supervisors requested the Planning Commission to initiate a review of the General Plan for the Vine Hill area, and requested a report to the Board on this review. The subject appeal is on the agenda of the Board of Supervisors for the September 30, 1974 meeting. The follvwing is a report on the status of the General Plan Review for the Vine Hill-Pacheco Corridor Area. 1. Status of the Review The request of the Board of Supervisors was brought before the Planning Commission at its study session of March 19, 1974, at which time the north-central planning review was considered pur- suant to the continuing program for review of general plan and zoning consistency. The area contains 2.615 acres and a popula- tion of 5,200. Since that time, the planning Department has undertaken field surveys to ascertain the existing land uses, has reviewed a variety of source materials including topographic maps, aerial photographs, Assessor's records, utility maps, and other data available regarding existing conditions and development trends in the study area. The staff has analyzed the above materials and policy documents pertaining to the future development in the affected area, including the General Plan of the County now zoniag ordi ante, a.ad both the Geaera? In consequence, the Planning Department assisted in drawing up a survey instrument, and the survey was made on August 31st - September 2nd, 1974. The results of the survey were tabulated by the residents who generally agreed with the major preliminary staff recommendations. A first draft of the staff report is currently in preparation and will be completed by the end of the month. 2. General Plan Amendment Procedure As you know, the actual content of a General Plan Amendment for the Vire Hill area will not be known until all of the procedures for a General P.an Amendment have been completed. The steps which must yet follow include the following: a. Internal review of the preliminary staff recommendations and preparation of the final staff report. b. Preparation of an environmental impact report on the proposed amendment. c. Public hearings before the Planning Commission, revisions of the General Plan Amendment in light of the public hearings, and approval of the Amendment by the Planning Commission. d. Preparation of the findings and submission of the lime to the Board of Supervisors. e. Public hearings before the Board of Supervisors, revisions of the amendment if deemed desirable, and ultimately, adoption of a general plan amendment. From the above procedural steps, the preliminary staff recommendations would be subject to considerable review and consideration prior to any final adoption. 3. Preliminary Staff Recommendations The staff studies have indicated that findings of the environmental impact report on Application 1824-RZ (prepared in August 1973) are til= ._-=id. S--zilariv, b th the findings and conclusions of the staff report on the subject application (dated September 11, 1973) are applicable. The staff reco:=erda'ions include, among others, that the General Plan be amended in this particular area by providing high intensity residential land use (multiple family use) on the northerly side of Pacheco Boulevard (generally within the area now zoned for M-1, Multiple Family) , and that lands further north be retained in the existing high density single family residential land use category (existing Single Family Residential (R-6) zoning) . 00061 i Board of Supervisors -3- September 23, 1974 It is felt that a General Plan "Commercial" designation or a "Commercial" zoning district at this location would be an un- warranted intrusion into an area where a residential character is well established, and would result in a mixture of land uses detrimental to existing residential development both east of the site and west of the site (beyond an existing vacant parcel) . 4. Response to Recent Communications from the Applicant In his application for an appeal (dated December 5, 1973) , the applicant questioned certain findings in the environmental impact report. He questions the residential character of the surround- ing area, the increase in, traffic due to commercial use of the site, and the statement that commercial uses will have a detrimen- tal effect upon adjoining residential properties. The applicant states that high density single family use of the site would strain ".....non-existent school and recreation facilities" and existing police, fire, and sanitation facilities_ Finally, the applicant states that conversion of open pasture land to commer- cial use is not an irreversible commitment, since it would be easier to convert commercial use to residential land use rather than vice-versa. The staff feels that the above comments are un- founded. The predominant existing land use, both adjoining and near the subject site, is residential with some vacant and agri- cultural lands. While recreation and park facilities are indeed lacking, play facilities as well as educational facilities are available one and a half blocks east as Las Juntas School. with respect to increased traffic, the applicant indicates that there would be minimal traffic generated by the storage in the proposed buildings. Experience has indicated that additional outside storage is usually associated with this kind of develop- ment and, thus, more traffic would be generated than indicated by the building. Further, the rezoning is not for a specific use but for a General Commercial District (C) which would permit a broader range of traffic-generated uses either by the applicant or subsequent owners of this property. Traffic generation by general commercial uses could indeed be very substantial. The same principle applies to the visual impact upon surrounding properties; while the building proposed may or may not be attrac- tive, outside storage will have an adverse visual effect, and alternative co=ercial asses permitted under the rezoning could Contrary to the a_plicant's representation, single family develop- ment of the area would not strain existing school, police, fire, and sanitation facilities. Adequate capacity is available in all of these to handle the potential small increment of single family 00062 Board of Supervisors -4- September 23, 1974 Finally, commercial development of the site must indeed be considered an irreversible environmental impact since the liklihood of eliminating structures, paving, landscaping, etc., and restoring open pasture is indeed remote. In his letter of December 7, 1973, the applicant states that, ".....the application covers the rezoning of a tract which ac- cording to the anticipated General Plan of the City of Martinez, will be zoned as industrial processing. This statement is in error. The City of Martinez General Plan (adopted in June 1973) has retained the same boundary between single family residential lands as the Martinez General Plan of 1980 (which was adopted in October 1964) in the vicinity of the site in question_ Thus, the site is designated for single family residential use in both plans_ 5. Summary The preliminary staff recommendations for the Vine Hill-Pacheco Corridor General Plan Review indicate that the vicinity of the site in question should be retained in residential uses, a policy which is also reflective of the City of Martinez General Plan. Whether these recommendations may be changed in the course of the remaining plan amendment procedures will not be known until final adoption of the General Plan Amendment by the Board of Supervisors. In view of the foregoing, our prior recommendation that this application be denied remains the same. This is sustained by the Planning Commission's unanimous recommendation that the requested zoning change be denied. The time frame specified in the present . regulations is totally unrealistic. CSAC supports t e concept o - Parking Management Plans (PMP) over "facility by facility" review, and these PMP's should promote acceptable flexibility compatible with the principles of local self-determination. - A thorough statement on "Cost/Benefit" analysis con- siderations should be published before final PMR's . are promulgated. - Air Pollution considerations should not be the only determinant in land use decisions by county govern- ment. Numerous elements (i.e. , social, economic, water, solid waste management, etc.) must be evaluated in responding to local conditions and requirements during land use decision-making processes. - Vigorous efforts must be continued to clean up the ma or source of air pollution— the automobile itself. Li ewise, stationary source control programs must not be allowed to be de-emphasized. Finally, unrealistic time schedules and impossible im- plementation techniques must be reviewed by Congress. Sensible amendments to the Clean Air Act need to be devel- oped. Crash programs that create confusion, fiscal ir- responsibility, and massive adverse public reaction does not promote the laudable intent of this Federal legisla- tion. CSAC will be offering written and oral testimony consistent with the policy statements outlined at the public hearings in October. Please transmit to our Sacramento office any official positions taken by your county so that a compre- hensive analysis of these regulations can be formulated and circulated for the benefit of all concerned. I expect this new money to be only the first installment on substantial additional public service employment funds recently authorized by President Ford. The following are our recommendations for the use of this additional money: 1. Allocate an additional $23,100 to the Antioch Unified School District. 2. allocate an eauitable share of funds to the Knightsen School District. 3. Retain the balance of the supplement CETA money for county use. The additional money for the Antioch Unified School District is recommended because in the initial allocation of CETA Title II funds an oversight resulted in the district receiving $23,100 less than would have otherwise been the case. The allocation for the Knightsen School District is recom- mended because a vacancy in the Office of the District Superintendent resulted in the school district not applying to the county for inclusion in the original allocation of funds. 0000 H 1' . .. . 2. Finally, it is recommended that the remaining money be retained by the county because in the original allocation of funds, the county retained only $157,000 out of $1,235,000 available.
