HomeMy WebLinkAboutMINUTES - 08131985 - T.5 i T.5 The Board of Supervisors of Contra Costa County, California Adopted this Order on_August 13, 1985 by the following vote: AYES: (see below for vote) NOES: ABSENT: ABSTAIN: SUBJECT: Workshop on Landfill Siting In compliance with the request of the Board on August 6, 1985, A.A. Dehaesus, Director of the Community Development Department, submitted a report to the Board dated August 13, 1985, (copy attached and incorporated as a part of this Board Order)on several issues pertaining to a proposal for a comparative site evaluation study, participation in a site specific landfill altematives study, a long-term study of solid waste disposal concerns, and preparation of proposed legislation to correct the current fragmented solid waste decision making,process by providing appropriate management authority to Contra Costa County government. June Bulman, Chair, Contra Costa Count Solid Waste Commission, spoke on the assignments given to the Commission by the Board of Supervisors on the disposition of solid waste. She advised that the Commission is now meeting twice a month in order to accelerate its review of solid waste issues, and will be holding a series of educational workshops on this subject. She requested the Board to table any action on further solid waste site studies until the Solid Waste Commission can complete its report to the Board in approximately 60 days(October 15, 1985). Supervisor Powers advised that he concurs with the request of the Solid Waste Commission and therefore withdraws his motion of August 6, 1985, requiring the Community Development Director to provide recommendation on the issues as noted above. Board members concurred with Supervisor Powers and the action taken on August 6, 1985, is hereby RESCINDED pending completion of the report from the Solid Waste Commission in 60 days. The vote on the motion was: Ayes: Supervisors Powers, Schroder, Fanden Noes: Supervisors McPeak, Toriakson Absent: None Supervisor Toriakson reported on the meeting of the West County Mayors' Solid Waste Committee held earlier this morning. He proposed referring to the Solid Waste Commission the assignment of developing criteria for landfill selection. Ms. Bulman disagreed with Supervisor Torlakson's proposal for the reason that there is a great deal of misinformation as to defining what the basic problem is, which is the reason the Commission is holding educational workshops so that all are informed of the basic fundamentals of solid was disposal issues. Mark Jordan, President, East Contra Costa Board of Realtors, expressed concern that property values might drop because of proximity to a landfill site. He requested the Board to urge the Solid Waste Commission to review all potential sites countywide in order to make the best selection. Mike Tucevich, representing WHEW(We Have Enough Waste), urged to Board to not delay in searching for other sites because current landfill facilities are rapidly nearing capacity. He suggested stopping importation of garbage from outside the County, and urged the establishment of criteria for landfill site selection. Even.though he believed the educational workshops of the Commission to be important, he felt that public hearings should have been held prior to these educational workshops. Because of time constraints,the Board determined to discuss this matter further prior to the close of its meeting this afternoon. * x At 4:15,p.m. this day, the Chair reopened the discussion on the landfill workshop issues. Supervisor Toriakson expressed his belief on the need for a public meeting on this issue that would have a structured agenda and would be available to the public prior to the meeting. Supervisor Fanden advised that she was supportive of an informational workshop meeting on August 27, 1985. She suggested the presentation of a staff report with presentations by representatives of East, West, South, and Central County on solid waste issues and management, how the EIR process will work in the selection of a landfill site, and followed by comments from the public which would be limited to two minutes per individual and five minutes for groups. Referring to the need to prepare the agenda the next day for the August 27 workshop, Mr. Dehaesus presented for Board consideration the following five agenda items: 1. Status of private applications; 2. Status of city control or County regulated franchises; 3. Issues of recycling compost, conversion of waste to energy, and transfer stations; 4. Identification of criteria for landfill site selection; and 5. Waste facilities in the County. At the conclusion of the discussion there was consensus among Board Members to hold a workshop on August 27 on'the agenda items proposed by Mr. Dehaesus. Therefore, IT IS BY THE BOARD ORDERED that a workshop is SCHEDULED to be held on August 27, 1985, 7 p.m., in the Board Chambers with an agenda to consist primarily of the five items proposed by Mr. Dehaesus and a format to include a staff presentation of approximately one hour on the agenda items and followed by five-minute presentations by group spokespersons and two-minute presentations by individuals. Dehaesus SUBJECT: Waste Disposal Program Director of Community D vel pment i I On August ,6, 1985 the Board of Supervisors requested that we review the following four items and provide recommendations to the Board on each. The items are: 1 . Determine to not proceed with the Comparative Site Evaluation Study outlined in the July 25, 1985, report of the Director of Community Development; 2. Direct, staff to not participate in any site-specific landfill alternatives study, whether in-depth or general , unless authorized by the Board, until written commitments are made by the cities and sanitary districts in the County to (a) fund the study and (b) direct their waste streams to the site or sites selected by the study; 3. Refer the issue of longterm study of solid waste disposal concerns to th& Solid Waste Commission to update the County's Solid Waste Management Plan; and 4. Direct the County Administrator, County Counsel , and the Director of Community Development to draft legislation to correct the current fragmented so lid waste decision-making process by providing appropriate management authority to Contra Costa County government. On Item 1 , we suggest that the Board not consider pursuing -this Site Evalua- tion Study any further thereby concluding this item. On Item 2, we do not intend to pursue any site-specific. landfill al-ernatives study without Board authorization. Inasmuch as this is a countywide issue, we think that the cities and sanitary districts should participate in the funding of such studies that may be authorized and further that an arrangement should agreed as to the direction of the waste stream. On Item 3 we agree that the Solid Waste Commission should be given the issue of a longterm study as it relates to the Solid Waste Management Plan. ° • I' Board of Supervisors Subject: Waste Disposal Program - 2 - August 13, 1985 i On Item 4, we think that the question of implementation of a solid waste plan is of considerable concern to the County. Therefore, state legislation should be .pursued to add sufficient authority to the County's planning responsibility to allow the County to adequately implement the Plan. The design of a further review and study of waste disposal system should be referred to the Solid Waste Commission and direct that the Commission report back to the Board in two to three months. The design of this review or study should include the updating of the County Solid Waste Management Plan. I Rather than just identifying landfill sites, the waste disposal system would include transfer stations, recycling, composting, criteria for site locations, etc. Through this effort, the Commission would- be providing for public participation as well as itsown hearing process.. Later on, the results of this effort should be reflected in the County General Plan. It is time that the role of the Solid Waste Commission is intensified in this entire process.
