The Board of Supervisors of Contra Costa County , California , 1
9 by vote of two- thirds or more of its members , RESOLVES that: i

10 Pursuant to Government Code Section 25350 .5 , Contra Costa j
11 County intends to construct a storm drain facility , a public f
12 improvement , and , in connection therewith , acquire interests _in
13 certain real property .
14 The property to be acquired consists of two parcels and is
15 generally located in the West Pittsburg area approximately 3OU
16 feet north of Willow Pass Road . The said property is more par-
17 ticularly described in Appendix "A" , attached hereto and incor-
18 porated herein by this reference .
19 On July 16 , 1985 , this Board passed a resolution of intention
20 to adopt a resolution of necessity for the acquisition by eminent
21 domain of the property described in Appendix "A" (Resolution No .
22 85 /405) and fixing August 13 , 1985, in its Chambers in the
23 Administration Building , 651 Pine Street , Martinez, California , as
24 the time and place for the hearing thereon.
25 The hearing was held at that time and place , and all
26 interested parties were given an opportunity to be heard and bases II
27 upon the evidence presented to it , this Board finds , determines
28 and hereby declares the following: II!

1 1 . ' The public interest and necessity require the proposed
project;

2 . The proposed project is planned and located i.n the manner
3 I
which will be most compatible with the greatest public good and
4 i
the least private injury; and
5
3 . The property described herein is necessary for the pro- i
6
posed 'project ; and
7
4 . The offer required by Section 7267. 2 of the Government �
8
Code was made to the owner or owners of record .

10 The County Counsel of this County is hereby AUTHORIZED and
11 EMPOWERED:
12 To acquire in the County' s name , by condemnation, the t it les ,
13 easements and rights of way hereinafter described in and to said
14 real property or interests ) therein , in accordance with the pro-
15 vis ions for eminent domain in the Code of Civi 1 Procedure and the
16 Const -itut ion of California: Parcel 1 is to be acquired as a per-
17 manen t drainage easement; and parcel 2 is to be acquired as a tem-
18 porar'y construction easement; which -shall expire on December 31 ,
19 1986 ;
20 To prepare and prosecute in the County' s name such proceedings
21 in the proper court as are necessary for such acquis it ion; and
22 To deposit the probable amount of compensation, based on an
23 appraisal , and to apply to said court for an order permitting the
24 County to take immediate possession and use said real property for
25 said public uses and purposes .
