LETTER from Contra Costa County Recreation and Natural Resources Commission (in response to Board referral) recommending that an allocation of $3,600 be made from the County Fish and Game Propagation Fund to the County Probation Department for s� installation of an aeration system at the Byron Boys ' Ranch fishing pond. RESOLUTION adopted by the Town Council of the Town of Moraga on November 13, 1974, pursuant to Government Code Section 34333, authorizing the county to continue to provide services (furnished prior to incorporation) to said Town for the remainder of the 1974-1975 fiscal year or until said Council requests discontinuance, whichever first occurs; and RESOLUTION designating certain county officials (Sheriff, Public Works Director and Building Inspector) as ex-officio city officials of said city. ACMOWLEDGE RECEIPT 9. MEMORANDUM report from Acting County Health Officer (in response to letter from Mr. K. B. Renkert pertaining to a failure of septic tank drain_ fields in the Muir Oaks area of Martinez) recommending that abatement action be instituted against properties in said area having malfunctioning individual sewage disposal systems that have public sewers available adjacent to their property. SOTO STREET - PARTIAL AB4NTDO101ENT - Richmond Area Cecelia Crawford, Ned Robinson, and the•Rheem Manufacturing Company have requested the abandonment of a portion of the Soto Street right of tray which lies south of Market Avenue at the easterly line of Lot 1 of the Loomis Subdivision. The right of way exists only on paper; no road improvements have ever been constructed. ' Cecelia Crawford states that she owns the aforementioned Lot 1. Rheem Manufacturing Company states that they own the adjacent property. The abandonment is requested so that all of said Lot 1 may be fully utilized. It is recoxmended that the Board of Supervisors set a date for a public hearing on the proposed abandonment. (10:30 a.m. , January 14, 1975 is recommended) . (LD) SUPERVISORIAL DISTRICTS I. II Item 2. VALLEY VIE? ROAD AND LOS ALTOS DRIVE - SLIDE INVESTIGATION El Sobrante and Kensington Areas It is recommended that the Board of Supervisors approve and authorize the Public Works Director to execute a Consulting Services Agreement with Harding-Lawson�Associates for an investigation of slides on Valley View Road near Christopher Court; in the EI Sobrante area, and on Los Altos Drive, in the Kensington area. The Agreement provides for a maximum payment of $4,000 which cannot be exceeded without prior written approval of the Public Works Director. INZ£T GRATE MODIFICATION - APPROVE PLANS AND CALL FOR BIDS Countywide Area It is recommended that the Board of Supervisors approve plans and specifications for the Inlet Grate Modification project and advertise for bids to be received in four weeks, and opened at 11:00 a.m. on January 7, 1975. The Engineer's estimated construction cost is $11,003. The project consists of the welding of bars on inlet grates to eliminate the possibility of bicycle wheels falling through the grate openings. This is the third grate modification project and will complete the bicycle-proofing of all County inlet grates. This project is considered exempt from Environmental Impact Report requirements as a Class Ic Categorical Exemption. (RE: Work Order 4944) (RD) SUPERVISCRIAL DISTRICT II Item 4. RELIEZ VALLEY ROAD - SLIDE PROTECTIOi: - Martinez Area It is recommended that the Board of Supervisors approve Work Order 6457 in the amount of $3,300 and authorize the Public Works Director to arrange for the installation of 350 feet of flume on Reliez Valley Road, in the Martinez area. The flume will replace a collapsed pipe and collect the water prom the outlet pipe on Pebble Beach Loop and direct it into the drainage inlet on Reliez Valley Road. The water is currently draining into a slide area. The work will be done by County forces. This maintenance work is a Class 1 Categorical Exemption from Environmental Impact Report requirements. POMONA STREET - SOILS IhWESTIGATION - Crockett Area By Order dated September 30, 1974, the Board of Supervisors approved a Consulting Services Agreement with Lowney-Kaldveer Associates, Oakland, for soils investigation in connection with the repair of a retaining wall on Pomona Street in the Crockett area, with a maximum payment limit of $5,100.00. It is recommended that the Board authorize the Public Works Director to approve an increase in the maximum payment limit to $6,126.00 to coy=er additional costs of drilling and flagging which were not in the scope of the original agreement. • (RE: Project No. 2191-4192-74) (RD) A G E N D A Public Works Department ^Page of 9 December 10, 1974 00013 0 ! LA COLTNA RQ1,D - TRAF FTC REGULATION - E1 Sobrante Area At the request of local citizens -and after an engineering study, it is recormended that Traffic Resolution No. 2049 be approved as follows: Pursuant to Section 22507 of the California Vehicle Code, parking is hereby declared to be prohibited at all times on the west side of LA COLII:A R0,111J) (Road No. 1265L) , E1 Sobrante, beginning at a point 60 feet south of the centerline of San Pablo Dam Road and extending southerly a distance of 250 feet. (TE) Item 7. PACHECO BOULEVARD - CLAIM WAIVER ACCEPTANCE - Pacheco Area It is recommended that the Board of Supervisors accept Claim Waiver dated November 30, 1974 from Marshall Pierpont McCoy and Gertrude E. McCoy and authorize Mr. Vernon L. Cline, Chief Deputy Public V orks Director, to sign said Claim on behalf of the County. It is further recoumended that the County Auditor-Controller be authorized to draw a warrant in favor of the claimants for $50.00 and deliver same to the County Real Property ! Agent for processing. Payment is for repair work on claimant's side-yard fence and retaining wall damaged during the current Pacheco Boulevard widening project. (RE: Project No. 3951-4512-72) (RP) Item 8. CARQUIIF-Z SCENIC DRIVE - McaTN ROAD - SLIDE AREA WINTERIZATION - Port Costa Area It is recommended that the Board of Supervisors approve Work Order 6461 in the amount of $112200.00 and authorize the Public W or?:s Director to arrange for the winterization of several slides on Carquinez Scenic Drive, in the Port Costa area. Winterization will include filling the existing large cracks in the road pavement with asphalt concrete to seal the surface and prevent eater from getting into the slide area. This is a temporary measure to hold the road through the winter. The work will be done by County forces. This maintenance work is a Class 1 Categorical Exemptioa from Environmental Impact Report requirements. (RE: Work Order 6461 - Roads Nos. 2191 and 2784) (M) Item 9. MORELLO AVENUE AND MIDHILL ROAD - CONTRACT ACCEPTANCE - Martinez Area The contract for the Morello Avenue-Midhill Road Reconstruction project was completed by the Contractor, Syar Industries of Vallejo, on November 21, 1974, in conformance with the approved Plans•, Special Provisions, and Standard Specifications, at a contract cost of approximately $79,000. PACHECO BOULEVARD - C011-MACT ACCEPTANCE - Martinez Area The contract for the widening of Pacheco Boulevard, along the frontage of the new Ace Hardware store east of Howe Road in Martinez, was completed by the Contractor, Diablo Valley Paring of Concord, on november 20, 1974, in conformance with the approved Plans, Special Provisions, and Standard Specifications, at a contract cost of approximately *9,900. It is recommended that the Board of Supervisors accept the contract as complete as of November 20, 1974. The contract was completed within the allotted contract time limit. (RE: Project No. 3951-4217-74) (C) Item 11. FOSTER LANE AND AETE-NIDA MARTINEZ - COACT ACCEPTANCE - El Sobrante Area The contract for stabilizing slides on Foster Lane and Avenida Martinez, in E1 Sobrante, was completed by the Contractor, Eugene. G. Alves Construction Company, Inc. of Pittsburg, on December 2, 1974, in conformance with the approved Plans, Special Provisions, and Standard Specifications, at a contract cost of approximately $352000. It is recommended that the Board of Supervisors accept the contract as complete as of December 2, 1974. The contract was completed within the allotted contract time limit.. SAN R41-10N VALLEY BOUJLEYARD - LAME MAREUNGS - Danville Area With the completion of the frontage improvements on San Ramon Valley Boulevard in front of the new Longs Drug Store near Sycamore Valley Road and the recent modification of the Southern Pacific Railroad t crossing near Railroad Avenue, the Public l;orks Department is pro- posing a revision to the pavement lane ,markings from Railroad Avenue to Sycamore Valley Road to improve the traffic flow and safety in this area. The proposed plan «gill provide four 12-foot viae traffic lanes, two 5-foot vide bike lanes, parking on the vest side of the road, and a 12-foot wide continuous left turn lane. Parking Will need to be elimi- nated on the east side of the road to irplement the plan. The Department held a public meeting in June regarding the need for bike lanes in this area. Also, comments have been solicited from various citizen groups regarding the proposed plan. The San Ramon Valley Chamber of Coumeerce has objected to the loss of parking under the proposed plan. Rovever, the Valley Action Forum, Valley Progrnms Committee, Diablo Wheelren, Valley Spokesmen, Diablo Valley League of Women Voters, American Association of University Women, and the Ban Ramon Planning Co=ittee have advised the Department that they are in favor of the proposed plan. Also, approximately 80 percent of the merchants along the affected portion of v San Ramon Valley Boulevard have signed a petition stating that they are in favor of bike lanes. On 1.%y 23, 1972 the Board of Supervisors adopted the County Interim Bicycle Paths Plan which indicates San Rama Valley to be a primary bicycle route. Since the roadway width is adequate to accommodate the p bike lanes by eliminating parking on one side of the road, and since there is substantial public need end support for installing the bike lanes, it is ' the opinion of the -Public Works Department that this plan should now be implemented. Fernandez The public hearing on CATV rates proposed by various County licensees was closed on November 25,_ 1974 with the decision to be made by your Board on December 10, 1974. Although this matter was not referred to this office, a number of queries have been made by Board members prompting these comments. The rates authorized to be charged by those firms applying for an increase have been in effect for many years as they were established by the initial application for a license to serve unincorporated areas. There is no question that profit margins have been constricted due to higher costs resulting from inflation and additional requirements mandated by the F.C.C. The consultant has reviewed the systems and determined that rates requested are fair and reasonable. There seems to be general agreement that some relief is in order. The rate of return should be adequate to provide a financial climate capable of sustaining the system at a level of performance acceptable to the public. It must be recognized that complete fairness and equity cannot be achieved as the rates are determined by the operations of the total system, rather than costs for serving specific areas which vary considerably due to many factors; i.e. , density, topography, location, overhead or underground, etc. 14hile understanding that fixing rates is a complex problem, other facets of cable service which have surfaced at the public hearing and thereafter and which obviously need some attention are discussed below: 1. Service Standards. There have been comments and complaints submitted as to the quality of service providad. The consultant reported that the visual quality of signal on all �_t Lhe tirre o= lnsaection in all excellent. However, a great number of 0007 Microfilmed with board order Board Members 2. December 9, 197-1r- complaints 974complaints have been received from the Orinda Downs area which seems to indicate that the standards of service for this area is not acceptable.. Recommendation. Your Board should consider erecting the technical staff of the County Communications Division to make a preliminary investigation of this matter and report its findings to the Board. Such a technical investigation will, of course, involve some County expense. Mr. J. F. Angliss, Communications Engineer, indicates that a general review of the quality of the signal can be accomplished but that any extensive review of a system or continuous monitoring program of any magnitude will require additional staff and equipment. 2. Customer Complaints. There has been an inquiry as to the number or complaints from subscribers received by this office. The number of complaints received has been quite small which is influenced to an unknoum degree by the low visibility of the County in this matter. December 9, 1974 Although there have been 16 reception complaints against Cable-Vision during the 1973-1974 period it should be noted that only five of the 16 complaints were reported in the second half of the period, i.e. , May, 1974 through October, 1974. The number of complaints lodged against the other cable companies• are not significant. Recommendation. The cable companies should e directedto provide the County with quarterly reports indicating the nature and disposition of requests made of service complaints by each month. These reports should be monitored by County staff to deter- mine the nature of the complaints and if prompt remedial action has been taken. 3. Local ProgrThe lack of programs origzna�ting in the community as a local public service has been the subject of criticism by some. Recommendation. The cable firms should each e alrectea to provide a report to your Board indicating the current availability of facilities and personnel for program origination, a listing of such local programs which have been shown on its system for the last six months and its plans for future program origination. 4. F.M. Reception. Sous concern has been .. ex-Dressed as to the level and standard of F.R. service provided by cable firms. Recommendation. The technical staff of the. Commuunications Division should also be directed to investigate the quality of F.M. reception and to provide a report on this service to the Board. 00018 000" 8 Id Ra Board Members 4. December 9, 1974 5. Underground Service Rates. It has been suggested by some that there be a differential in the service rates between underground and overhead services to recognize the higher costs of underground installations. As indicated by the consultant there is no financial data available for analysis to determine separate rates. The rate structure is determined by total system revenue and expenditure analysis and does not involve any attempt to breakout the separate components which if known might result in some installations being prohibitively expensive. The differential may be somehwat mitigated by recognizing the additional cost of undergrounding in the installation rate. Recommendation. A rate differential could, of course, be established but would of necessity be arbitrary and should be approached with caution so that some reason- able balance be maintained. 6. Underground Installation. As indicated in the _ report or Lne consuirtant, the cost of an underground installation may be considerable more than overhead. The problems related to such installations have brought on the situation expressed by the Associated Building Industry whereby cable firms have requested that the developer pay for the installation costs. Recommendation. The financial data analyzed to review proposed rates reflect the result of previous operations and revenues. The question of the party responsible for installation costs in new developments is complicated and should be the subject of a separate study and not delay further the requested rate increases. 00079 i v 7'71 15F, i Board Members 5. December 9, 1974 7. Citv of Lafayette Request for Deferral. The hovemoer L, letter Strom Mr. E. C. Marriner, City Manager, City of Lafayette, requests the Board not to take action to increase rates at this time as this system is under study by another consultant employed by the cities (Martinez, Pleasant Hill and Lafayette) served by this company. Purportedly, this study will be completed in February, 1975. The County has no jurisdiction with respect to cable service within cities. In the case of Lafayette, the city is served by two firms licensed by the County (A.T.C. Cable-Vision, and Televents) prior to incorporation. As a result the City upon incorporation simply adopted by reference the County ordinance and rate structure. Although this action was taken by the City, it may be- that any rate changes approved by the County would not be applicable to customers within the City. If the rate change is .applicable to_ City subscribers, then it would seem that the City" Council may take action to hold the present rate within the City, The City has authority to take such action as it deter- mines legal and necessary. It is interesting to note that no deferral is requested with respect to the increase requested by Cable- Vision which is higher than Televents. Recommendation. The following alternatives are avai ab a to the Board: (a) Defer any increase for Televents pending completion of other study and City hearings thereon. (b) Grant an interim increase subject to possible subsequent modification upon completion of the other study; and (c) Proceed with the request and authorize a permanent rate increase. 00080 1A r .„,,. .. December 9, 1974 It is recommended that alternative (b) be followed in that authorizing a permanent rate which turns out to be higher than that subsequently authorized by the cities would not be well accepted by subscribers in the unincorporated area. However, this is not to say that there may be valid reasons for a differential inside and outside of cities due primarily to the difference in density of subscribers. Also, there have been such differentials in rates although this situation is obviously not desirable. The attached schedule shows the current status of rates currently authorized by cities for cable service. Summary As indicated above, there are a number of concerns with respect to CATV service in the unincorporated area-deserving of attention and which need to be resolved. It is recommended that the Board recognize the financial pressures being faced by cable companies by authorizing an interim rate adjustment effective January 1, 1975; it is suggested that said rate adjustment to be 25 cents less than the proposed rates indicated by Wilsey and -Ham in its final recommendation as fair and reasonable (see attached schedule). All other increases requested by cable companies to be denied. The interim rates are to remain in effect until the actions described above are completed and reports presented to the Board to evidence that the concerns expressed have been satisfactorily resolved and that an adequate and reasonable level of public service is being provided by cable companies. The involvement in the complaint investigation and monitoring service to be performed by the County should be determined by the number and nature of the complaints. If the County is to actively and continuously pursue enforcement of standards of service it may be necessary to add staff in which case consideration should be liven to increasing the license fee (presently fixed by ordinance at 2 per cent of the gross receipts) to cover the addition_! cost.
