LETTER FROM CONGRESSMAN GEORGE MILLER
I. RECOMMENDED ACTION:
Acknowledge receipt of letter dated July 18, 1985 from Congressman George
Miller expressing his appreciation of the Board of Commissioners concerns regarding
the Department of Housing and Urban Development handbook change which would cut
Section 8 administrative fees by 10%.
III. BACKGROUND:
On June 4, 1985, the Board of Commissioners forwarded letters to Contra Costa
County U. S. Congressional Representatives and Senators expressing concern over the
propriety of the Department of Housing and Urban Development's action to cut Section
8 administrative fees by 10%.
The attached July 18, 1985 letter from Congressman George Miller expresses his
appreciation for those concerns and outlines information regarding a HUD data collec-
tion effort to create a computerized data base showing amounts claimed under the PHA
administrative fee system, expenses and operating reserves for all PHAs currently
administering the Section 8 Existing Housing and Moderate Rehabilitation Programs.

Thank you for your letter expressing concerns about the propriety
of the Department of Housing and Urban Development's action to
cut administrative fees by. 10%.
Both the Department and the Appropriations Committees view
administrative fee reductions as handbook changes, which- are not.
subject to the "notice and comments' procedure. . Administrative
fee changes have never been rule changes; because there. is. no Ve-deral
Register provision that stipulates the fees payable to PHAs.
As you probably'.know, HUD:has_.created a hard-to-house fee for cases
which may cost PHAs higher amounts to process. This new fee is intended
to relieve some of the financial burden of finding housing for
difficult-.to-place families. Additional, HUD has, increased, not frozen,
the allowable Fair Market Rents for housing units with three .or more
bedrooms, which. should reduce administrative costs in .those difficult cases,
HUD informs me that they have initiated a data collection effort that
will create a computerized data base showing amounts. claimed under,
the PHA administrative fee system, expenses, and operating reserves
for all PHAs currently administering the Section 9 Existing Housing
and Moderate Rehabilitation Programs, That system should allow HUD
to make accurate comparisons between real and projected costs, and ,
should allow them to make interim adjustments to the system prior to
completion of the long-term studies of the fee system.
