The decision was appealed by a neighbor. On February 11, the Planning Commission denied the Desmonds' application. This appeal from the Planning Co ission decision is filed on behalf of William and Tanya Desmo d. Their appeal is based upon: ( 1) the overall consistency of the project with the County General Plan and Zoning Ordinances, (2) the project's consistency with specific Zoning Ordinance standards for approval of residential second units,' (3) the proj ct's consistency with Zoning Ordinance standards for establishing a conditional land use,' and (4) satisfaction of the Zoning Ordinance appeal standards 3 These points are covered in the discussion below.' ' Section 82-24 . 1002, Title 8, Contra osta County Code. ' Section 26-2.2008, Title 8, Contra C sta County Code. a Section 26-2 .2404 , Title 8, Contra Costa County Code. These standards appear to be designed for appeals from project approvals. This case involves, instead, appeal from denial of an application, so that the applicability of the standards is doubtful. Nevertheless, the appeal fully satisfies these standards. Detailed responses to issues conside ed by the Planning Commission cannot be provided at this time because the Commission has not yet adopted findings to support its decision. General Plan and Zoning Ordinances. The proposed residential second unit would comply with all applicable requirements of the County General Plan and Zoning Ordinances. The General Plan use designation, Single-Family Residential, Low-Density, and the R-15 zoning both allow residential second units, subject to required County approvals. See Chapter 82-24, Title 8, County Code. Further, establishment of second units in existing residential areas furthers provisions of the General Plan and Zoning Ordinances which seek to preserve the County's open space, concentrate urban development, and increase the supply of housing. 2 . Section 82-24.10, Standards for Approval of Residential Second Units. The proposed project would comply with all of these standards. a. The unit is to be rented, leased, or occupied by one or more persons, and the Applicants are prepared to accept such a restriction. b. The lot exceeds the 6,000-square-foot minimum size requirement. C. The unit satisfies all zoning ordinance specifications. The sideyard setback of 10 feet, of which the adjoining neighbor has complained, is consistent with zoning, as are the height, location, and coverage of the structure. Coverage of the second unit will be 640 square feet,' less than two-thirds of the allowed 1,000 square feet. No variance is required for authorization of this project. d. A separate entrance to the second unit is located, as required, to the rear of the structure and is not visible from the street-front area. e. The project is architecturally compatible with overall neighborhood character and the primary residence. The new structure, designed by the respected Santa Rosa firm, JR Designs, echoes the stucco and shingle roof design of the primary residence which, in turn, is harmonious with the neighborhood character. Neighbor complaints that rental of the unit would be incompatible with the neighborhood really concern the proposed use, and not the architecture. f. Addition of the second unit would not overburden public services, utilities, or facilities, or create excessive noise, traffic, or parking problems. Traffic in the immediate neighborhood (a series of cul-de-sacs) is very light, and capacity would not be overburdened by addition of one dwelling. Two on-site parking spaces would be provided for the second unit through a garage addition. Nothing about this project in any way indicates that it or its future occupants will create excessive noise. g. The project presents no threat to public health, safety, or welfare. On the contrary, by increasing the supply of housing at the relatively affordable level of small rental units, the project will enhance the public health, safety, and welfare. 3. Section 26-2.2008, Standards for Establishment of Conditional Land Uses. These standards are also satisfied by the project. a. The project will not adversely affect realization of General Plan policies and goals. Instead, it will contribute to their implementation by providing new housing in existing urban areas, thus avoiding loss of open space and agricultural lands and the public costs of extending public services to these areas. In achieving these planning goals, the project will make a positive contribution to, rather than interfering with, orderly development within the County. b. The project will not adversely affect preservation of property values or protection of the tax base within the County. On the contrary, the project can be expected to enhance property values and thus to augment the County tax base. C. The project cannot be expected to create a nuisance or enforcement problem within the neighborhood. The residential use proposed is an allowed use, and nothing about the project warrants concern that the residential users of this unit will create nuisance or enforcement problems. d. The project will not encourage marginal development within the neighborhood. The proposed use is an allowed use which requires no variance of applicable zoning controls and which can be expected to enhance the value of property in the neighborhood. e. The health, safety, and welfare of the County will be enhanced, as explained above, rather than diminished by this project. Sunne Wright McPeak, Chair Members, Board of Supervisors February 21, 1992 Page 4 4. Section 26-2.2404(c) , Grounds for Appeal. Three of these standards may be relevant to this -project. a. Effect on property value and consistency with General Plan: Addition of the second unit to the Desmonds' property would increase its value and would comply with the General Plan. Because the property and proposed project fully satisfy County standards for approval of a second unit land use permit, and because State and County laws strongly favor approval of such housing units, Mr. and Mrs. Desmond could reasonably expect approval of such a project on their property. Accordingly, denial of the application to build such a project would deprive them of that reasonable expectation and adversely affect the value of their property. This adverse effect could not be justified by a finding that the project is inconsistent with the General Plan because it is not. b. Required standards and evidence relied upon by Planning Commission: The standards which control approval of a residential second unit and a conditional land use are indicated above. No relevant and credible evidence was presented to the Planning Commission to establish inconsistency with any of these standards. C. Specified findings and their supporting evidence. The Applicants are informed that the Planning Commission has not adopted findings in support of its decision. No such findings were articulated at the hearing. The Applicants therefore cannot comment at this time on the Commission's findings. For the reasons indicated above, William and Tanya Desmond request that their appeal be set for hearing by the Board of Supervisors. Sincerely, A L.
