HomeMy WebLinkAboutMINUTES - 07301985 - 1.2 (2) TER BMM OF sZ pmasoRs ch ao[ m aosm aax ff, CAlXMUA ` Adopted this Order on July 30, 1985 by the following vote: AYES: Supervisors Powers , McPeak, Torlakson and Fanden NOES: None ABSENT: Supervisor Schroder ABSTAIN: None Resolution No. 85/4 51 SUBJECT: Confirm Engineer's Report, Order Improvements and Levy First Annual Assessment for Landscaping and Lighting Assessment District 1979-3 (LL-2) , Pleasant Hill BART Station Zone 7, Walnut Creek/Pleasant Hill Area The Board of Supervisors of Contra Costa County RESOLVES: This Board has taken a series of actions preliminary to ordering the improvements in Assessment District 1979-3 (LL-2) , Pleasant Hill. BART Station Zone'7 and now makes the following findings and orders: 1. The Board adopted its Resolution Initiating Proceedings for the improvement described therein under the Landscaping and Lighting Act of 1972, and directed the Public Works Director, as the Engineer of Work for the assessment district, to prepare the report required by Section 22565, and following, of the Streets and Highways Code. The improvement is generally described as follows: The maintenance of lighting and landscaping features installed as a part of the Redevelopment Project include, but are not limited to, trees, shrubs, ground cover, street. furniture, decorative signs, paving, paths, fountains, statuary, crossing appurtenances and the necessary provision of electricity, water, sweeping and labor. 2. The Engineer .of Work filed the report as directed, and the Board adopted its Resolution of Intention calling a hearing on the report as required by Section 22587 of the Streets and Highways Code. Notice of the hearing was given by publication and by mailing to affected property owners, all according to the Landscaping and Lighting Act of 1972. Affidavits of publication and mailing were filed with the Clerk of the Board. 3. At the time and place for which notice was given, the Board conducted a public hearing and gave every interested person an opportunity to object to the proposed improvement, the extent of the assessment district, or the proposed assessment. 4. The Board FINDS that written protests against the proposed improvement have not been made by owners representing more than one-half of the area of the land to be assessed. for the improvement. 5. The documents and events described in paragraphs 1 to 3, inclusive, are stated here in tabular form, with their dates and, where appropriate, _their numbers. The Board APPROVES the Engineer's Report and each component part of it, including each exhibit incorporated by reference in the report. 7. The Board FINDS that the Engineer of Work; in the Engineer's Report, has fairly and properly apportioned the cost of the improvement to each parcel of land in the zone in proportion to the estimated benefits to be received by each parcel , respectively, from- the improvement. The Board, hereby confirms and levies each additional assessment as stated in the Engineer's Report. 8. The Board ORDERS the improvement described in paragraph 1 and as detailed in the Engineer's Report.
