'
Government Code K 26227 authorizes the Board of Supervisors to appropriate and
expend general fund monies to establish County programs or to fund other programs
deemed necessary to meet the social needs Of the population o the County.
Welfare and Institutions Code § 900 authorizes the Board Of Supervisors to
establish maximum monthly rates, pursuant to 0 11460" which the Juvenile Court
may order the County to pay for dependents, wards or minors concerning whom
Juvenile Court petitions have been filed.
Welfare and Institutions Code § 11400 designates the State Department of Social
Services as the single organizational unit responsible for administering a sta-
tewide system for establishing rates for children in foster care who receive
AFDC-FC.
The rates set forth in this resolution are for 24-hour care and supervision of
children placed by either the Social Service or Probation Departments in foster
care facilities. These facilities may be either liceM68d/approvSd family homes
or licensed group homes. The term "family home" includes foster family homes,
Small family homes and the homes of both relative-caretakers and noD;8lated legal
guardians.
IT IS BY THE BOARD RESOLVED that
l. General Provisions
a. AFDC-FC rates set by the State Department Of Social Service pursuant to
Welfare and Institutions Code § 11460 effective July l, 1984 are hereby
established as maximum monthly rates which the Juvenile Court may Order
the County to pay for dependents- wards Or minors concerning whom
Juvenile Court petitions have been filed.
b. AFDC-FC rates previously established in Resolution No. 84/232 adopted on
April 17, 1984 and Resolution No 84/655 adopted on October 30, 1984 have
been carried forward and augmented as required by regulations Of the
State Department Of Social Services.'
c. Those portions of Resolution No'. 84/232 adopted on April 17, 1984 and
Resolution No. 84/665 adopted on October 30, 1984, which Set County rates
for foster home care are hereby superseded,
d. The rates specified in this resolution are the maximum amounts to be paid
and lower rates shall be paid whenever permissible and feasible.
e~ The rates specified in this resolution apply to children in foster care
who are receiving County Board and Care for Children funding as well as
to those who receive AFDC-FC.
2. Family Home Payment Rates
a. Basic Rates
The maximum monthly AFDC-FC basic rates for family home care in CnUtp8
Costa County shall be established pursuant to the standardized schedule
set forth in Welfare and Institutions Code § 11461' adjusted annually for
cost of living increases or decreases in accordance with Welfare and
Institutions Code § I1453. Necessary adjustments may be made at the
written direction of the State Department of Social Services.
For children eligible to receive AFDC-FC, the basic rate shall be paid
from AFDC-FC funds. For children not eligible to receive AFDC-FC, the
basic rate shall be paid from County funds.-

b. Specialized Care Rate Systems
1) Difficulty of Care Allowances
Specialized care increments may be authorized in addition to the
basic rate (as specified in 2,a above) in specific cases by the
written direction of the County Welfare Director or his designee.
Approval of these specialized care increments (Difficulty of Care
Allowances) shall be based on criteria which include, but are not
limited to, the level of physical and emotional problems presented by
the child, the level of auxiliary services needed by the child, and
the ability and willingness of the foster parents or specified
relative-caretakers to provide for the child' s specialized care
needs.
Payment of Difficulty of Care allowances shall follow the formula
adopted by the Board of Supervisors on September 14, 1976 (Resolution
No. 76/801) subject to regulations developed by the State Department
of Social Services and/or County Welfare Director.
The maximum monthly Difficulty of Care allowances shall be estab-
lished pursuant to written direction from the State Department of
Social Services as authorized by Welfare and Institutions Code
§11461(d) .
For children eligible to receive AFDC-FC, the Difficulty of Care
Allowances shall be paid from AFDC-FC funds. For children who are
not eligible to receive AFDC-FC, the Difficulty of Care Allowances
shall paid from County funds.
2) Specialized Foster Care Homes
a) The maximum initial monthly specialized care rates for Probation
and Social Service Department placements in specialized foster
care in Contra Costa County shall consist of a basic component
(as specified in 2, a above) established in accordance with the
statewide standardized schedule and a "Difficulty of Care"
allowance [as specified in 2,b.1 above] based on each child' s
specialized care needs established in accordance with the provi-
sions of Welfare & Institutions Code §11461(d) .
For children eligible to receive AFDC-FC, the specialized care
rate shall be paid from AFDC-FC funds. For children not eligible
to receive AFDC-FC, the specialized care rate shall be paid from
County funds.
b) Additional $20 (maximum) increments may be provided effective
November 1, 1984 by contract at intervals of not less than six
months from Coun:iy-Only funds, upon satisfactory completion of
required training up to a maximum of $80 over the initial monthly
AFDC-FC rate as set forth in a) above.
c) Subject to payment limits pursuant to Government Code §25502.5,
and in accordance with the above provisions, the Purchasing Agent
is authorized to contract with licensed, specialized foster care
providers effective November 1, 1984 to pay (from County-Only
funds) for training noted above and vacation/respite care as
follows:
(1) These contracts shall be limited to Probation and/or Social
Service Department placements of children ages 7-19 in homes
with up to four long-term beds. No more than 36 beds shall
be contracted for at any one time.
(2) In the case of specialized foster care contractors providing
long-term care, the contract may make provision for alter-
nate care to be provided to the child(ren) placed in each
home to allow each contract home the following:

(f ) Two days of respite for each full month of care may be
' ^
provided up to 8 maximum of 22 days per fiscal year.
Respite days must be used in the month accrued and no
respite days' will be accrued during any month in which
vacation is taken.
(ii) Homes which have provided care for at least six months
may receive d maximum of 14 days of vacation during
each fiscal year; i.e. , 14 days of vacation (per year)
after six months of care. YDCatiOM time, may be
carried forward from one fiscal year to the next pro-
vided this accrual does not extend beyond the contract
period.
(3) In the case of specialized foster care contractors providing
respite care only, the provisions Set forth in (2) above shall
not apply.
(4) Payment for the alternate care of children, during their regular
specia-lized foster care providers respite and vacation shall
be from County-Only funds. Such payments shall be authorized as
follows:
(f \ the maximum allowed for specialized foster homes providing
respite care shall be one-tenth of their monthly rate per bed,
(ii) specialized foster homes providing vacation care shall
receive their monthly rate pro-rated on a daily basis,
(5) All specialized foster care contractors shall be required to
complete a minimum of 20 hours Of tra1OfDO each six months until
they have successfully completed a total of 80 hours of training
They shall receive a $20 per month per child rate increase, from
County-only funds, for each 20 hours of training up to the maxi-
mum Of 88 hours within two years.
3\ Emergency Foster Homes - Social Service Department
a) The maximum per diem AFDC-FC rates for Social Service Department
placements in emergency foster homes in Contra Costa County shall
consist of8 basic component established in accordance with the sta-
tewide standardized schedule (a5 specified in 2 D. above) and a spe-
cialized care increment established in accordance with the provisions
Of Welfare 8 Institutions Code § 1I451(d) .
The maximum per them payment rates for Social Service Department
placements in emergency foster homes shall be established pursuant to
written direction from the State Department of Social Services as
authorized by Welfare and Institutions Code §11461/d\.
For Children eligible to receive AFDC-FC, the emergency foster home
per diem Pate Shall be paid from AFDC-FC funds. For children who are
not eligible to receive AFDC-FC, the per them rate shall be paid from
County funds.
b\ An additional retainer fee shall be provided by contract, on a
monthly basis, to assure that beds are reserved for use for place-
ments of children on an emergency basis.
Retainer fees shall he claimed against Block Grant Administrative
funds to the extent that such funds are available. Claiming instruc-
tions restrict usage of Block Grant Administrative funds for retainer
fees to beds that are available at least one day during the month.
If the beds are not available at least one day during the month or if
Block Grant Administrative funds have been fully expended, the
retainer fees shall be paid from County-Only funds'.
c\ Subject to payment limits pursuant to Government Code §25502.5° and
10 accordance with the above provisions, the Purchasing Agent is
authorized to contract with licensed emergency foster home providers
for the retainer fees noted above, as follows:
/l\ For Social Service placements of children ages 0-17, not more
than 65 beds at any one time, and riot more than five beds per
home.

(2) In the case of contracts providing for beds limited to children
ages 0-12 or to children ages 13-17, the County will pay the
licensed emergency foster parents a retainer fee of $125 per
month per bed without regard to use plus daily rates as set
forth in a) above for actual care provided.
(3) In the case of contracts providing for beds for children in the
full age range of ages 0 through 17, the County will pay the
licensed emergency foster parents a retainer fee of $150 per
month per bed without regard to use plus daily rates as set
forth in a) above for actual care provided.
(4) Contracts requiring payment limits which exceed those authorized
herein shall be made by the Board of Supervisors.
4) Temporary Foster Homes - Probation Department
The maximum AFDC-FC per them rate for Probation Department placements
in temporary foster homes in Contra Costa County shall consist of a
basic component established in accordance with the statewide standar-
dized schedule (as specified in 2, a above) and a specialized care
increment established in accordance with Welfare and Institutions
Code §11461 (d) .
Temporary foster homes are designated for use by the Probation
Department for placements of minors alleged to come under Welfare and
Instititions Code §601 or adjudged wards of the Juvenile Court.
The maximum per them payment rates for Probation Department place-
ments in temporary foster homes shall be established pursuant to
written direction from the State Department of Social Services as
authorized by Welfare and Institutions Code §11461(d) .
For children eligible to receive AFDC-FC, the temporary foster home
per them rate shall be paid from AFDC-FC funds. For children who are
not eligible to receive AFDC-FC the per them rate shall be paid from
County funds.
5) Small Family Homes
The maximum AFDC-FC rates for small family homes consist of a basic
component established in accordance with the statewide standardized
schedule (as specified in 2,a above) and a specialized care increment
determined in accordance with Welfare and Institutions Code §11461(d) .
The maximum monthly rates for placements in small family homes shall
be the Regional Center prescriptive rate for intensive level of care,
as established by the State Department of Development Services,
including an allowance for personal and incidental expenses (PIE).
Exceptions to pay higher rates may be approved by the County Welfare
Director on a case-by-case basis.
AFDC-FC Payment levels for those children who meet Regional Center
criteria may be supplemented effective July 1, 1984, from County-Only
funds, up to the Regional Center prescriptive rate level .
For children eligible to receive AFDC-FC, the small family home rate
shall be paid from AFDC-FC funds. For children who are not eligible
to receive AFDC-FC, the small family home rate shall be paid from
County funds.
.c. Out of County Placements
The family home rates paid for children placed by Contra Costa County
Probation or Social Service Departments in other Counties of the State
shall be the basic rates of such other Counties. For children who
require specialized care rates, the rates to be authorized shall be those
established by such other Counties; or, if no such rate system exists,
the levels established for Contra Costa County.

3. Group'Home Payment Rates
The maximum monthly AFDC-FC payment rates for Probation and Social Service
Department placements in group homes shall be thegroup home program rate
established by the State Department of Social Services pursuant to Welfare
and Institutions Code § 11462. These rates shall be subject to adjustments,
for cost of living or allowable cost changes, made in accordance with written
directions from the State Department of Social Services as authorized by
Welfare and Institution Code § 11462.
For children eligible to receive AFDC-FC, the group home rate shall be paid
from AFDC-FC funds. For children who are not eligible to receive AFDC-FC,
the group home rate shall be paid from County funds.
4. Clothing Allowances
Clothing Allowances may be authorized by the written direction of the County
Welfare Director, County Probation Officer, or their respective designees in
order to provide each child in foster care with needed clothing. Such
allowances may be paid to family home care providers (except those small
family homes whose rates are established at the Regional Center maximum,
including the personal and incidental allowance) and group home providers, as
well as specified relative-caretakers and non-related legal guardians who
receive AFDC-FC. Clothing Allowances may be adjusted, in accordance with the
provisions of Welfare and Institutions Code § 11453, pursuant to written
direction from the State Department of Social Services. For children eli-
gible to receive AFDC-FC, the clothing allowances shall be paid from
AFDC-FC funds. For children not eligible to receive AFDC-FC (other than
children with relative caretakers or non-related legal guardians), the
clothing allowances shall be paid from County funds.
5. Temporary Home Care
In order to continue the County's capability for providing temporary/emergency
care of children out of their own homes during the parents' temporary
absence, and because the Board considers the temporary care of a child within
the home of a relative, neighbor or friend to be in the best interests of the
child and at a lesser cost to the County than emergency foster family home-
care, the Board AUTHORIZES the Social Service Department to place children in
temporary home care within the home of a relative, neighbor or friend at the
following maximum daily payment rates, with a maximum stay of ten (10) days:
One child $10
Two or more children $15 (regardless of the number of children)
