SUBJECT: Authorize execution of contract with the Contra Costa County
Sheriff's Department for supplemental police services for the
Housing Authority in the North Richmond and Rodeo areas
Having received and reviewed a report from the Executive Director of
the Housing Authority of the County of Contra Costa outlining the necessity of a
contractural arrangement with the Contra Costa County Sheriff's Department for
supplemental police services for Housing Authority owned developments in the
North Richmond and Rodeo areas and the Advisory Housing Commission recommen-
dation supporting approval of execution of said contractural arrangement.
IT IS BY THE BOARD ORDERED that the Executive Director of the Housing
Authority of the County of Contra Costa be AUTHORIZED to EXECUTE a contract with
the Contra Costa County Sheriff's Department furnishing supplemental police ser-
vices for the Housing Authority in the North Richmond and Rodeo areas, as recom-
mended by the Advisory Housing Commission .

CONTRACT FOR LAW ENFORCEMENT SERVICES
1. Parties. This Contract is entered into by and between the Housing Authority of
the County of Contra Costa (hereinafter called AUTHORITY) , and the County of Contra
Costa (hereinafter called COUNTY) .
2. Term. This Contract shall become effective at 12:01 a.m. on September 17, 1984
and continue in force month to month until terminated by either party giving written
notice thereof to the other party at least 30 days before the termination date.
3. Existing Agreements Superseded. All existing agreements between COUNTY and
AUTHORITY for law enforcement services are hereby superseded by this agreement.
4. Authority Obligations. AUTHORITY shall make to the COUNTY those payments
described in the Payment Provisions attached hereto which are incorporated herein by
reference, subject to all the terms and conditions contained or incorporated herein .
5. County Obligations. COUNTY shall provide those services and carry out that work
described in the Service Plan attached hereto which is incorporated herein by
reference, subject to all the terms and conditions contained or incorporated herein.
6. Special Conditions. This contract is subject to the Special Conditions attached
hereto, which are incorporated herein by reference.
7. Signatures. These signatures attest the parties ' agreement hereto:

SERVICE PLAN
1. Level of Services. The level of service provided by COUNTY to AUTHORITY
shall be as provided herein and subject to the annual public safety budget of
AUTHORITY.
a . Enforcement of federal , state , and local statutes and ordinances .
b. COUNTY shall provide law enforcement services to AUTHORITY in the
amount of 2,912 hours per year at 56 hours per week as follows :
i . One full-time peace officer, designated as the primary
AUTHORITY peace officer.
ii . One relief peace officer.
C. Replacement of absent personnel shall be provided by COUNTY in
accordance with the operating policies and procedures of COUNTY.
d. COUNTY shall provide all personnel , materials , supplies , equipment,
and support services necessary for the law enforcement services agreed to herein .
2. Local Office. Personnel assigned to AUTHORITY pursuant to this contract
shall report for duty and conclude their shifts at the COUNTY Richmond Substation .
3. Assignment. The primary officer will remain in that assignment ,
barring promotion, retirement, termination, or transfer acceptable to AUTHORITY,
a minimum of 12 months .
4. Unsatisfactory Perfo nmance. COUNTY shall transfer personnel assigned
to AUTHORITY to duties outside the AUTHORITY, no later than 30 days upon receipt
of written request from AUTHORITY , unless such transfer would violate the law,
County policies and practices , or the Memorandum of Understanding between the
Deputy Sheriff's Association and COUNTY.
5. _Reports and Statistics . Upon request, COU14TY shall provide to AUTHORITY
reports and standard statistics relating to law enforcement services within the
AUTHORITY in such form as is mutually agreed by AUTHORITY and COUNTY.
6. Vehicles.
a. COUNTY shall provide all vehicles , insurance, fuel , maintenance,
and safety equipment required for the services rendered under this Contract.
b. COUNTY shall provide replacement vehicles of similar quality for
all vehicles out of service for maintenance purposes .
7. Support Services. COUNTY shall provide, at no additional cost, all
support services provided to the incorporated cities .
8. Training . COUNTY shall provide personnel trained in the basic service
areas of management and supervision, patrol , traffic safety and crime prevention/
investigation.

SPECIAL CONDITIONS
1. Labor Relations.
a. COUNTY shall negotiate and administer all labor relation agreements
and personnel rules and procedures between COUNTY and its employees rendering
services under this Contract. AUTHORITY may at any time report to COUNTY their
concerns about COUNTY personnel performing services under this Contract. COUNTY
will investigate and take whatever action it deems appropriate.
b. In the event obligations under this Contract by COUNTY to furnish
law enforcement services to AUTHORITY are interrupted by strikes , boycotts , and
other forces beyond control of COUNTY , COUNTY shall make a pro rata adjustment
or refund of amounts payable to COUNTY hereunder. Further, in the event of any
such strike or boycott, COUNTY will exert any and all reasonable means available
to provide law enforcement services to AUTHORITY and agrees that AUTHORITY may
at its option secure law enforcement services from another agency during the
term of any such strike or boycott.
2. Indemnification. COUNTY shall defend , save harmless , and indemnify
AUTHORITY and its officers , agents , and employees from all liabilities and
claims for damages for death, sickness or injury to persons or property, including ,
without limitation, all consequential damages from any cause whatsoever arising
from or connected with the operations or the services to AUTHORITY hereunder,
resulting from the conduct, negligent or otherwise, of COUNTY, its officers ,
agents, or employees .
3. Authority Cooperation. AUTHORITY shall give COUNTY the full cooper-
ation and assistance of its officers, agents and employees and hereby designates
its Director as its representative to coordinate with the Sheriff all activities
provided pursuant to this Contract.
4. Employees ' Status. Persons employed in the performance of services
under this Contract are COUNTY employees , and do not have and do not acquire any
pension, civil service, or any other status or right which AUTHORITY confers
upon its employees. For t1►e purpose of conferring official status to ti►e personnel
performing services under this Contract, every such person shall be deemed to be
an officer or employee of AUTHORITY while so engaged .
5. No Authority Responsibility to Personnel . AUT14ORITY is not responsible
for the direct payment of salaries, wages or other compensation to any COUNTY
personnel performing services under this Contract, nor for compensation or
indemnity to any COUNTY employee for injury or sickness arising out of his
employment.
6. Annual Notifications of Level and Cost of Service. On or before
January 1st of each year, AUTHORITY shall notify COUNTY of the desired level of
law enforcement services for the fiscal year beginning the next July 1st.
Thereafter, but no later than March lst, COUNTY shall notify AUTHORITY of the
annual cost of services requested by AUTHORITY for the ensuing fiscal year.
These estimated costs shall be in accordance with the Payment Provisions set
forth herein .
