MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: September 11, 1984 SUBJECT: Ponderosa Cablesystem's Request for Construction Timetable Extension Specific Request(s) or Recommendation(s) & Background & Justification RECOMMENDATION Approve Ponderosa Cablesystem' s request for a construction timetable extension through February 5, 1985 for all franchise areas except Blackhawk and a five year extension for the Blackhawk area. BACKGROUND The franchise with Ponderosa Cablesystems calls for operation of the cablesystem by August 6, 1984. Ponderosa Cable has requested extension of that deadline date to February 5, 1985. The County Cable Television Ordinance No. 82-28, Section 58-8.004, Construction Timetable, states that the Board of Supervisors must approve any delay in the terms o the timetable. Ponderosa cites two reasons for their delay: 1. A landslide along Marsh Creek Road. Apparently the landslide, which occurred 12 years ago, destroyed the telephone company poles and Ponderosa has been waiting a determination from the telephone company on whether the poles would be replaced or if the wires would be underground. Currently, plans are for undergrounding in September, 1984. 2. The headend facilities necessary for reception have not been completed due to delay in site approval by the City of Danville. (The permits were originally granted on April 2, 1984. However with the City granting Ponderosa a franchise within their limits, a new larger dish necessitated a resubmittal of the landuse permit and development plans. ) Although large in area (see Exhibit A for map), the Ponderosa cablesystem will serve only about 235 homes when completed (exclusive of Blackhawk) . There are 33 miles of cable of which 10 miles have been completed, another 10 miles stranded but not cabled, and 13 miles still need both stranding and cabling. In addition, there is approximately 2500 feet of underground cable to be installed along the slide area on Marsh Creek Road. Apparently, Ponderosa has not been granted access to the private roads of Blackhawk, although it would be ready to provide cable service as soon as access was granted. Since the access issue has not yet been resolved, staff believes that it would be best to grant Ponderosa Cable an extension of their construction timetables for Blackhawk, thus putting Ponderosa Cable in compliance with their franchise agreement with the County.
