Lucas Application No. 3026-84 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION On May 18, 1984, James R. Lucas filed Application No. 3026-84 to amend Development Plan 3035-81 by allowing 3800 sq. ft. of first floor space for office uses with 28 on-site parking spaces. On June 25, 1984, the Orinda Area Planning Commission denied this application. The applicant appealed. The appeal was heard by the Board of Supervisors on August 21, 1984 at which time the Baord indicated its intent to approve the appeal and directed that findings be prepared accordingly. Attached for your consideration as Exhibit A are findings for the approval of the applicant's appeal. EXHIBIT A FINDINGS FOR 3026-84 AS APPROVED BY THE BOARD OF SUPERVISORS ON SEPTEMBER 11, 1984: In the matter of the requested additional parking variance the Board finds that: 1. The additional one stall parking variance would not be a grant of special privilege inconsistent with limitations on other properties in the area since significant parking variances have been granted in the downtown area and currently exist. 2. Because of special circumstances involving the projects location, strict application of the parking standards would deprive the subject property ofAhe rights enjoyed by others in the vicinity. 3.. The additional one stall auto variance is negligible and, therefore, substant-ially meets the intent and purpose of the Community Business District (C-B). In the matter of the request to allow office uses on the first floor of the subject building the Board finds that: 1. .The requested use is not detrimental to the health, safety and general welfare of the County; 2. The proposed use will not adversely affect the orderly development of property in the County since office uses on the first floor of buildings in the C-B zoning district now exist and is allowed in the downtown Orinda area. 3. Approval of the requested office use will not adversely affect the preservation of property values or the tax base in the County; 4. The proposed use is consistent with the goals and intent of the General Plan for the Orinda area. 5. The proposed use will not create a nuisance. 6. The proposed use will not encourage marginal development in the neighborhood; and 7. The location and design of the project established special and unique characteristics which makes approval of the requested office use desirable. C���DoD� a• 061`rq
