Vacation No. 1911- ) Resolution of Intention to
Vacate Highway
S. &H.Code Sec. 8320 and 8321
The Board of Supervisors of Contra Costa County RESOLVES THAT:
Pursuant to Chapter 3 , "General Vacation Procedure, " of Part 3
of Division 9 of the Streets and Highways Code, this Board declares its
intention to vacate the hereinafter described County highway. For a
description of the portion to be vacated, see Exhibit "A" attached
hereto and incorporated herein by this reference. This proposed
vacation is generally located in the area of Orinda. A map of the portion
to be vacated is on file in the Public Works Department.
It fixes Tuesday, August 14 , 1984 at 10 : 30 a.m. (or as continued)
in its Chambers, Administration Building, 651 Pine Street, Martinez ,
California, as the time and place for hearing further evidence offered
by any interested party as to whether this is unnecessary for present or
prospective public use, particularly in connection with traffic
circulation in downtown Orinda.
The Clerk shall have notice of this matter published in the
Contra Costa Times , a newspaper of general circulation published
and circulated in this County, which is selected as the newspaper most
likely to give notice to persons interested in the proposed vacation,
for at least two successive weeks before the hearing in accordance with
Streets and Highways Code, Section 8322 . The Clerk shall also have said
notice posted conspicuously along the line of this proposed vacation
at least two weeks before the hearing, in accordance with Streets and
Highways Code, Section 8323 .

SUBJECT: Decision on proposed Vacation No . . 1911 , Bryant Way, in
the Orinda area .
The Board on July 10, 1984 closed the public hearing on
the proposed vacation of Bryant Way in the Orinda area , and deferred
decision to this date; and
J . Michael Walford , Public Works Director , advised that he
had prepared a report dated July 24, 1984, in response to the
Board' s direction of July 10, 1984, to substantiate the Public Works
Department' s recommendation for vacating a portion of Bryant Way in
Orinda and advised that , in his opinion , Bryant Way was not needed
for the circulation in the downtown Orinda area; and
Supervisor Fanden commented that Contra Costa County
should not vacate Bryant Way and advised that this conclusion had
been supported by the citizens of Orinda, and also stated that , in
her opinion Bryant Way is an easily maintained public street which
is well used by the citizens of Orinda and urged the Board members
not to vacate the County' s interest in Bryant Way, and advised that
she would not support its vacation; and
Supervisor Schroder commented that an application was made
to ,the County sometime ago to vacate Bryant Way, and advised that no
decision has yet been made on the application because the Board had
felt that no action should be taken on that application until it had
completed its hearings on the Crossroads Application No . 3055-82;
and
Supervisor Schroder also advised that the Board has received
a recommendation from the Orinda Area Planning Commission recom-
mending that the Board vacate Bryant Way because it was not
necessary for circulation in the Orinda area , and also advised that
the Orinda Chamber of Commerce and the Orinda Association did feel
it was necessary to maintain Bryant Way for adequate traffic cir-
culation, and advised that he had not heard any testimony which led
him to believe that the retention of Bryant Way was necessary; and
Supervisor Torlakson advised that he would support the pro-
posed vacation of Bryant Way; and
Supervisor Fanden advised that the citizens of Orinda were
opposed to the vacation of Bryant Way, and stated that she felt the
County should not give up a public Street , and recommended that the
Board defer decision on this matter for one week in order to review all
the alternatives; and
Supervisor McPeak inquired whether the Public Works
Department could investigate whether there would be a use for Bryant
Way in the future and also inquired what the public would derive
from relinquishing Bryant Way; and
J . Michael Walford advised that there would be no public
benefit other than a reduction in the amount of road system maintained
by the County; and

Supervisor Fanden requested that the Board delay this
matter for one week so that members of the Board may have a chance
to meet with the Orinda Area Planning Commission, Orinda Citizens
Committee , Orinda Chamber of Commerce and the Orinda Association;
and
Supervisor Torlakson advised that he felt Bryant Way is
not needed and proposed a motion for the vacation of Bryant Way; and
Supervisor Schroder seconded the motion; and
There being no indication of support for the proposal , the
motion and the second were withdrawn; and
Supervisor Powers recommended reopening the public hearing
in three weeks and refering the issue of processing of further evi-
dence to the County Administrator and appropriate Department Heads;
and
Board members considered the matter , IT IS BY THE BOARD
ORDERED that the recommendation of Supervisor Powers is APPROVED and
Resolution No . 84/432 fixing August 14, 1984 , at 10: 30 a .m . for said
hearing is APPROVED .
