SUBJECT: Memoranda of Understanding
Agency Shop Provisions
The Board received a July 12, 1984 letter from Katherine
Smith , County Elections Department employee , transmitting a petition
signed by 24 employees of Contra Costa County expressing concern
with the provisions of Memoranda of Understanding under consideration
•.regarding establishment of Agency Shop as a condition of employment ,
and protesting its application retroactively to employees hired
prior to approval of said Memoranda .
Katherine Smith appeared before the Board this day and
submitted an additional 105 signatures to the aforesaid petition
protesting the Agency Shop provision . She again voiced her objection
that the initial terms of employment with the County have been
changed .
Mark A . Williams , Planning and Programming Division , County
Auditor-Controller Department , submitted a petition with 31 signatures
of employees from his department and the Walnut Creek-Danville
Municipal Court opposing the Agency Shop provision . Mr . Williams
expressed concern with respect to the lack of communication regarding
the provisions for Agency Shop and the fact that no input was .solic-
ited from employees who were not members of a union .
Beverly •Portillo , Richmond District Attorneys Office ,
speaking also on behalf of three other employees in said office ,
protested the fact that non-union employees were not given the
opportunity to be present at negotiations with the union with respect
to the Agency Shop agreement , and urged the Board to recognize and
respect the freedom of choice of all County employees regarding the
status of their employment .
Longna Maczolla , Lydia Miraglio ,- Rene 'Kenny, Phillis
Williams and June Garlington submitted statements for the record
opposing the Agency .Shop provision .
Another petition containing an additional 67 signatures
protesting the Agency Shop provision was submitted for the record .
Supervisor Robert I . Schroder stated that he is opposed to
the position that the Board had taken with respect to the Agency Shop
provision that would require non-union employees to pay a fee to
retain their employment .
Supervisor Tom Torlakson commented on the benefits all
employees within represented classifications receive as a result of
the meet and confer process with County and union representatives .
With the exception of Supervisor Schroder , Board members indicated
support for the Agency Shop Provision .
No action was taken on this issue .

Dear Supervisors :
There are a number of county employees in represented
classifications who are unhappy with provisions in Memoranda
of Understanding under consideration by you relative to the
establishment of Agency Shop as a condition of employment in
Contra Costa County. At the time I , as well as many others ,
accepted employment with the County, I was given the option
of joining a union. Like many others , I declined.
Now, I am being placed in a position of joining a union,
paying a monthly fee to the union regardless of whether I want
to or not, or losing my job. I am angry that the terms of
my employment have been changed.
I understand Ordinances adopted by the Board of Supervisors
cannot be retroactive. I came into the County workforce under
one set of rules. I do not feel that those rules pertaining
to my employment or status of employment should be. changed
without a public hearing on this issue. I and other employees
would have no objection to the application of an Agency
Shop to new employees joining the county' s workforce.
The initial conditions of my initial employment with
Contra Costa County should be respected and maintained.

Dear Members of the Board: B
We are non-union clerical employees of the District Attorney' s office .
We represent 46 years of employment with Contra Costa County.
Since Proposition 13 was passed, we have put up with threatened lay-offs ,
reduced budgets , limitations of supplies and equipment, hiring freezes ,
increased work loads without an increase in personnel; all of which
resulted in serious morale problems . Then comes the Medical Services
fiasco which again we employees were expected to bear the brunt by taking
a pay cut. Through all of this we have not complained, we have not
threatened, we have not demanded. We have come to work every day and tried
to do the best job we could under sometimes trying conditions . During the
strike of 1971 , those of us who were working here then, had to put up with
the abuses and name calling of striking Union members to get to work to do
the job we were being paid to do . And now the County has sold us out to
the Union with the Agency Shop agreement .
We have chosen not to join the Union for our own personal reasons . While
we have not always agreed with the negotiations between the Union and
the County in the past , we have accepted the contracts as reasonably fair.
This time, however, we feel the Agency Shop agreement in the Proposed
Memorandum of Understanding is grossly unfair to non-union employees and
we protest the fact that we were not given the opportunity to be present
at the negotiations . To force an employee to choose between the Union
and her job is blackmail . To force an employee to join an organization
in which she does not choose to belong to, is denying her the right that
Union members have, the freedom of choice. We feel that the Union, while
professing "to provide fair and non-discriminatory representation to all
employees . . . regardless of whether they are members of the union, " in
fact, only act in the interest of the Union and its members .
If we refuse to concede to Union blackmail, we will be fired. We will
lose . retirement benefits , health plan benefits and accumulated sick leave .
With 8 to 14 years of employment with the County, we will find it difficult
to "start over again" in seeking new employment. Those of us over 50 years
of age will find it even more so. Those of us who are single parents will
be hard pressed to support our children on a starting level salary. It will
mean financial and economic disaster for all of us.
We feel that the Board of Supervisors should recognize the rights of ALL
County employees . To do this , you must reject the Agency Shop agreement
and continue to let employees choose whether or not they wish to belong to
the Union.

The June Employees Newsletter contained information on the Agency Shop
agreement and stated that if our specific questions had not been answered
to call our departmental office or the personnel office. We called our
Administrative Assistant , Mr. John Christolos and requested that someone
come down to our office to answer the many questions we had. Mr. Christolos
called back later and stated that he had passed on our request to Mr. _
William Hamilton, Employees Relations Manager. Mr. Hamilton said he was
"too busy" to come down to talk to us . There was a suggestion that we
submit a written list of questions and send then to Mr. Hamilton. Since
this was unacceptable to us , we then attempted to set up a meeting with
.Supervisor Powers , through his secretary. The next day Mr. Cisterman
called and set up a meeting with us to answer our questions . We suspect
that Mr. Powers had something to do with the Personnel Director ' s generous
offer. After one postponement, Mr Cisterman did come down and answer our
questions . He told us that we did have the right to represent ourselves
in negotiating with the County and we exercised that right in a letter to
Mr. Cisterman dated July 3 , 1984 requesting a meeting date to discuss salary
and working conditions . To date, we have not recieved a reply to this
request . We have also been told by Mr. Christolos that Mr. Hamilton
informed him that as non-union members and non-management personnel , there
is no grievance procedure available to us . If this is true , it is gross
discrimination against non-union employees .
We hope this proposal will receive your most serious consideration so that
many, long time , dependable employees can keep their jobs and the County
can continue to provide competent services to the people of Contra Costa
County.

Dear Mr. Hamilton:
I was shocked and dismayed to receive this foam and letter from you regarding the
"Agency Shop", or better known as "Closed Shop". I always thought that a vote had
to be taken by the entire membership of a business, if a union was felt to be need-
ed, and if more than 50% voted for it, a union was formed. When was this done?
Also, it would seem to me that the same vote should be taken to create this "Agency
Shop" agreement. This also was neglected. It is just being rammed down our throats.
It reminds me of the kind of "protection" small business' in certain cities have
to pay to hoods to be allowed to remain in business. If they try to buck that
"system" their windows are broken, or bombs thrown into their shops. I have always
detested "bullies", and unions have much of the time acted as such. I will never
forget the C.C. strike years ago when my husband worked at the Boy's Ranch in Byron,
and he was almost forced off the Marsh Creek Rd. several times by hoods or goons.
He felt he had a duty to his job in caring for those unfortunate boys at the Ranch
who had become wards of the court. I will also never forget the treatment Dorlys
Locke and I received at the hands of the zealots during the clerk's strike in 172
at the Public Defender's offices which were then in 4 homes. I came to you then and
spoke to you of what we were enduring.
I was an ICS at that time, and because I did not choose to strike _(I'd been employed
with the County 2 months and so was on probation )- because, as they put it, "I did
not follow orders", I did not pass probation, and was forced to be down-graded to an
ITC, which I have remained ever since. I've lost thousands of dollars in wages
because of that. I have been on the ICS list twice, but was never able to regain my
former status. I an presently on the Secy I list, because I was told the County
needed people with shorthand. However, I have been on many interviews but was not
chosen because "they wanted someone with more recent experience of that kind". Also,
I am 63 and I'm sure that fact discourages then from hiring me, and I can t blame
then for that.
Th get back to the "Agency Shop" - if this goes the way the Union wants it they will
have huge sums of money in their coffers. Who will audit their books to see how the
money is spent? Why do they need all that money?, and what will they do with it?
Will they "lend" it to a few privileged few - who will build casinos, and who knows
what else? Possibly send a bunch of their elite to Hawaii for a convention.
A few years after the clerk's strike of '72 I did join the Union, only last year I
took the opportunity of dropping out with quite a few others who did also. At that
time I signed up for a like amount to the Bay Area Crusade. I felt they were in
more need of my money than the union; and that is how I feel now - with all the
budget cuts, and services cutbacks we shouldn't be demanding raises when so many
very important programs are being cut to the bane. Prior to the formation of unions
in the County - my husband received his pay raises with the County without any
trouble.
I have a mentally ill son who has been in I Ward and J Ward a few times over the last
two years, and it is. a crime to cut back so severely on the staff that practically
nothing is done for these poor unfortunates who have to go there. All they get is a
roof over their heads for a few days, a few meals, medication and then back on the
streets again - just as desperate and ill as before. If more funding is not appro-

priated to help all these needy programs our streets will became battlegrounds
as was seen recently in San Ysi.dro, CA.
I would far rather my vaney go to support any one of those very needy programs.

Dear Employee:
You are employed in a position in a job classification which is represented by
United Clerical Employees, AFSCME, Local 2700 for purposes of employer-employee
representation. As you may already know, an "Agency Shop" provision is included
in the new Memorandum of Understanding between Contra Costa County and United
Clerical Employees, AFSCME, Local 2700. As previously explained in the June
1984 issue of the County Employee Newsletter, an Agency Shop Provision means
that:
1. You, as a permanent County employee, can join the employee organi-
zation which represents your job classification and pay the stan-
dard initiation fee, monthly dues and general assessments.
2. Should you wish not to be a member of the employee organization,
you must pay a monthly service fee equal to the standard ini-
tiation fee, monthly dues and general assessments to the organiza-
tion as a condition of continued employment.
However, if you are a member of a bona fide religion, body or sect which has
historically held a conscientious objection to joining or financially supporting
public employee organizations and do not wish to join the employee organization
or pay a service fee, you must as a condition of continued employment contribute
a sum equivalent to union dues, standard initiation fees and general assessments
to a designated charitable organization.
Enclosed with this letter is a three part NCR form entitled, "Employee
Authorization for Payroll Deduction of United Clerical Employees, AFSCME, Local
2700 Membership Dues or Service Fee," and a return, preaddressed, envelope.
Please complete the form, retain the PINK copy and return the others in the
enclosed envelope.

Dear Mr . Torlakson :
To say that I am angered and resentful is an understatement .
I was hired by Contra Costa County in a clerical position in
November 1974 . At the time there was no requirement for
clerical employees to belong to a union . I believe that
your Board has changed my working conditions, and I was
neither consulted nor informed of your intentions .
I have informed Sheriff Rainey that I intend to retire from
county service on December 1 , 1984. That date is firm . In
view of this I would ask your Board for a waiver from the
conditions of the Memorandum of Understanding, with the
condition that I do in fact retire on or before December 1 .

Dear Ms. Williams:
I am in receipt of your letter addressed to me regarding ' XN@ - If I
may, I will respond to your specific questions in the order in which you stated
them in your letter. However, before doing so I hope you understand that the
County of Contra Costa in no way bears any personal malice towards you.
You ask, first of all, why an election was not held to bring in a "union" in the
first place (currently designated as United Clerical Employees, Local 2700,
AFSCME) . Ms. Williams, an election was held, by secret ballot, in 1971 and a
majority of some 1200 eligible clerical employees voted to recognize United
Clerical Employees as the "majority representative" for purposes of negotiating
with the County of Contra Costa.
With respect to clerical employees voting for Agency Shop, United Clerical
Employees, Local 2700, AFSCME as of July 1, 1984, already represented approxima-
tely fifty-four percent (54 %) dues paying members in the General Clerical
Bargaining Unit. Consequently, an election to vote "for" or "against" Agency
Shop was not required.
With respect to what the union will do with "all the money" taken in from Agency
Shop, I don't have an answer. The law is the law and Agency Shop is permissible
as a bargainable matter between an employee organization and a County or City.
In closing, I want to tell you that I believe I understand your deep felt con-
cerns regarding your reaction to the 1972 strike, your reaction to not being
promoted, and your reactions to the letter I issued regarding "Agency Shop".

Dear Employee:
You are employed in a position in a job classification which is represented by
United Clerical Employees, AFSCME, Local 2700 for purposes of employer-employee
representation. As you may already know, an "Agency Shop" provision is included
in the new Memorandum of Understanding between Contra Costa County and United
Clerical Employees, AFSCME, Local 2700. As previously explained in the June
1984 issue of the County Employee Newsletter, an Agency Shop Provision means
that:
1. You, as a permanent County .,employee, can join the employee organi-
zation which represents your job classification and pay the stan-
%I and initiation fee, monthly dues and general assessments.
2. Should you wish not to be a member of the employee organization,
f you must pay a monthly service fee equal to the standard ini-
tiation fee, monthly dues and general assessments to the organiza-
tion as a condition of continued employment.

However, if you are a member of a bona fide religion, body or sect. which has
historically held a conscientious objection to joining or financially supporting,
public employee organizations and do not wish to join the employee, organization .,
or pay a service fee, you must as a condition of continued employment contribute
a sum equivalent to union dues, standard initiation fees and general assessments
to a designated charitable organization.
Enclosed with this letter is a three part NCR form entitled, "Employee
Authorization for Payroll Deduction of United. Clerical Employees, AFSCME, Local
270'0' Membership Dues or Service Fee," and a return, preaddressed, envelope.
Please complete the form, retain the PINK copy and return the others in the
enclosed envelope.

For your information, the current AFSCME, Local 2700 dues structure is one per-
cent (1%) of gross monthly pay up to a maximum of $18.00 per month.
Example: Your gross pay cheque is $1500.00
One percent (1%) equals $15.00
Your gross pay cheque is $1900.00
One percent (1%) equals $19.00, but you pay $18.00
In addition, there is a one-time only twenty-five dollar ($25.00) initiation
