SHERATON INN MOTEL CO:IPLEX LEASE - Buchanan Field By Order dated July 9, 1974, approving the delinquent rental payment plan, the Board of Supervisors also directed the Public Works Director to make monthly reports to the Board as to Lessee's performance on future payments of rents due to the County. As of September 1, 1974, the Lessee has made all payments due to bring the minimum ground rents and rental percentages current. He has also paid the second installment payment of $9,525.27 as set by the County Auditor-Controller. (A) Report .-B. . WATER QUALITY MANAGE1.1EN7 PLAN FOR THE ALMEDA CREEK WATERSHED, ABOVE NILES On August 20, 1974, the Board of Supervisors referred to the Public Works Director and t1he County Health Officer a letter from Mr. Daniel F. Murphy, Chief of Planning, Bay Area Sewage Services Agency, transmitting a cosy of Resolution No. 74-37, adopted by the Agenc�, requesting local agencies to develop and implement a 'water Quality manaste;menC plan for the Alameda Creek Watershed above Niles. In response to that referral, this report was prepared jointly by the Public Works Director and the County Health Officer. 1. The upper. portion (about 6,200 acres) of Amador Valley, a sub-basin of the Alameda Creek .Watershed, lies in southern Contra Costa County. 2. The County Planning Department is presently in the process of preparing a General Plan for San Ramon Valley. The study area for the Plan includes most of the upper portion of Amador Valley. 3. The County's Local Agency Formation Commission is under State Mandate to establish "spheres of influence" in this area. 4. The County Public Works and Health Departments are charged with the responsibility of. administering the procedures under which the Board of Supervisors issues permits for the installation of sewage collection systems and for the construction of sewage treatment facilities. KAVAJO AVIATION - Buchanan Field On August 20, 1974, the Board of Supervisors approved a payment plan for Navajo aviation to pay $7,953.91 in rents for the six-month period ending June 30, 1974 which were delinquent on July 30, 1974. The schedule requires the total to be paid in four equal monthly installments; the first payment to begin September 1, 1974. The Board directed the Public Works Department to make monthly reports to the Board of Supervisors as to Navajo's performance under this plan. The first installment, due September 1 under the plan, has not been received. The Public Works Director, therefore, recommends that the Board direct the Public Works Department, with the advice of the County Counsel, to prepare and issue a Notice of Default to terminate the lease. (A) SUPERVISORIAL DISTRICT I Item 1. COLUSA AVENUE - Road No. 1452 - Work Order 6062 - Kensington Area It is recommended that the Board of Supervisors approve Work Order 6062 in the amount of $7,500 and authorize the Public Works Director to issue a purchase order to the City of E1 Cerrito for the asphalt concrete overlay of Colusa Avenue from Valley Road to Santa Fe'Avenue. By Joint Exercise of Powers Agreement, this portion is maintained by the County. This work will be performed under contract by the City, with the County participating in the material and placement costs at contract prices; the contract administration costs will be borne by the City. This project is considered exempt from Environmental Impact Report requirements as a Class lc Categorical Exemption. BISHOP ROAD - Road No. 2295AQ - Crockett Area At cteiasogo e �uhe eissecoedhaeWsafclelahon bea irovas Pursuant to Section 21657 of the California Vehicle Code, that portion of BISHOP ROAD (Road No. 2295AQ) , Crockett, is hereby declared to be a one-way street and all vehicles shall travel in a westerly direction only, beginning at the intersection of Hartwell Street and extending westerly, to the intersection of Atherton Avenue. (Traffic Resolution No. 1994 pertaining to the present one-way restriction on Bishop Road is hereby rescinded.) (TO) Item 3_ RODEO CREEK ENCROACH14ENT - Flood Control Zone 8 - Rodeo Area It is recommended that the Board of Supervisors, as ex officio the Board of Supervisors of the Contra Costa County Flood Control and Water Conservation District, approve the issuance of encroachment permit "Rodeo-101" to the Rodeo Sanitary District for the installation and maintenance of a sanitary sewer line crossing the improved channel of Rodeo Creek at 7th Street, and authorize J. E. Taylor, Deputy Chief Engineer, to execute the permit. This installation is an appurtenance to Subdivisions 4325 and 4327- now under construction and, as such, has met Environmental Impact Report requirements. M Item 4. THIRD STREET - Road No. 1795 - Work Order 6061 - Rodeo Area It is recommended that the Board of Supervisors approve Work Order 6061 in the amount of $3,000,00 and authorize the Public Works Director to arrange for the installation of 60 lineal feet of 29 inch X 18 inch corrugated metal pipe arch to run from the existing Type "A" inlet on the northeast corner of Third Street and Rodeo Creek to Rodeo Creek. The wort: will be done by a private contractor. Funds are to be provided from the 1974-75 Road Capital Budget. This work is a Class 1 Categorical Exemption from Environmental Impact Report requirements. M Item 5. SAN PABLO DAM ROAD - Road No. 0961C - Work Order 6452 - San Pablo Dam Area It is recommended that the Board of Supervisors approve Work Order 6452 in the amount of $5,500 and authorize the Public Works Director to arrange for the bank and drainage repair on the low side of San Pablo Dam Road at Station 258. The work will be done by a private contractor. (M) Item 6, NO4 COUNTY CORPORATION YARD - Work Order 5394 - Martinez Area It is recontnended that the Board of Supervisors authorize the Public works Director to issue a purchase order in the amount of $2,365.00 to the Mt. View Sanitary District for the reconstruction of a sanitary sewer manhole over an existing sewer line at the new County Corporation Yard site off Blum Road. The raising and reconstruction, to approximate finish elevation, of the manhole is advantageous at this time as Cal Trans is importing fill material to this site at no cost to the County. This fill material is necessary for the development of the future Corporation Yard and would otherwise have to be purchased in the fu RD). SUPERVISORLkL DISTRICT III Item 7. LARKEY LANE-SAN LUIS ROAD-Road llo. 3854 tialnut Creek Area At the request of local citizens and after an engineering study, it is reco=-.,erded that Traffic Resolution No. 2003 be approi=ed as follows: Pursuant to Section 21101(b) of the California Vehicle Code, the easterly intersection of LARKEY L.AiNE (Road No. 3854A) and SAN LUIS ROAD (Road No. 3854C) , Walnut Creek, shall be declared a stop intersection and all traffic traveling southbound on LIRKFI LANT shall stop before entering or crossing said intersection. (TO) It["r,, 8. 111 ER ROAD - Project Ho. 2444-5817-74 - Orinda Area It is recorm ended that the Board of Supervisors accept slope and drainage easement dated August 29, 1974, from W. B. Sheppard, et ux. Said easement contains 1,263 square feet of lard required in conjunction with slide correction work- on tuner Road. (RP) . Item 9. CANYON ROAD - Proiect No. 2631-4165-74 - Moraga Area It is recaummended that the Board of Supervisors approve and authorize its Chairman to execute an agreement between the County and the Roman Catholic Bishop of Oakland, providing for a sharing of the cost of various improvements being constructed by the Church and by the County s contractor along Canyon Road. The agreement serves to alleviate conflict between the two contractors and to reimburse the Church for changes in completed work which were required when the County decided to-narrow the roadway by 18 feet. SHERMAN DRIVE STORMDRAIN - Storm Drainage District (Zone 77) - Work Order 8502 - Pleasant Hill Area It is recommended that the Board of Super_►isors, as ex officio the Board of Supervisors of the Contra Costa County Storm Drainage District, approve Supplement Zi to Work Order 8502, authorize the increase in the Contract Contingency Funds by $6,400, to a total of $14,734, and authorize the Deputy Public Works Director, Operations and Flood Control, to execute Contract Change Order No. 1 in the amount of $13,500. This action is necessary to provide for the unanticipated costs of sewer lateral and water line relocations. A reduction in construction engineering expenditures due to good progress of the contractor, and a transfer of presently unencumbered Zone 77 funds are sufficient to cover the additional costs. Hizh.Tay Users Tax Annortionment The Controller of the State of California advises that the August, 1974 apportionment of highway users taxes to Counties has been completed and that a warrant in the amount of $354,970.99 has been Bailed to Contra Costa-County as its share of these tares. This is $13,619.81 less than the August, 1973 apportionment of $365,590.80 and $38,191.85 less in total apportionment since the beginning of the fiscal year. (B & S) Item 19. COUNTY TRANSIT SERVICE AREA T-2 In order to expedite the planning of local mass transportation within County Service Area T-2, it is necessary to make detailed schedule determinations, accounting studies, prepare official documents such as State and Federal financial assistance requests, contractual agreements, equipment specifications, and do other detail work. The Local Mass Transportation Advisory Commission recognizes that funding for this work should be sought from the Transportation Development Act fund. This fund is administered by the Metropolitan Transportation Comni.ssion and may be allocated only to Bay Area Rapid Transit District or AC Transit insofar as Contra Costa County is concerned. FIRE COLLEGE SITE IMPROVE1•1ENTS (CO2NTRACT I) - Contra Costa Countv Consolidated Fire Protection District - Work Order 5547 It is recommended that the Board of Supervisors accept as substantially complete as of September 10, 1974, the construction contract with Larry Adams, General Contractor, Berkeley, for the Site Improvements at the Fire College (Contract I) , and authorize its Clerk to file the appropriate Notice of Completion. The. Fire College is located at 2945 Treat Boulevard, Concord. A letter has been received from the General Contractor authorizing the County to withhold $4,200 for si.: light standards until they are installed. The manufacturer cannot provide the specified light standards for approximately twenty-two creeks. (BP) Item 21. COUNTY HOSPIV%L ELEVATOR, MARTINEZ - Building Maintenance Job No. 1232 The passenger elevator at the County Hospital was out of service for a period of three days, June 25 through June 28, 1974, due to a failure of the hydraulic system. Repairs were made but, duce to the nature of the failure, the level of service has been seriously reduced and probability of future failure greatly increased. The questionable reliability of the unit presents a serious threat to life- safety operations at the County Hespital. The Public Works Department evaluation is that the elevator is beyond further repair and should be replaced. It is, therefore, recommended that the Board of Supervisors find that an emergency- exists and direct the Public Works Department to proceed in the most expeditious manner, pursuant to Section 25458 of the Government Code, to replace the elevator. Oak Court is a private court which serves only adjacent properties. It has been proposed that the improvements be constructed pursuant to the provisions of Chapter 27 of the Improvement Act of 1911 and that the assessments be paid in installments over a 15 year period. Under this proposal the county would finance the improve- ments (estimated to cost about $20,000) on a private court. It is county policy that county financing under assessment district proceedings is authorized only where there is substantial public interest and benefit to be derived from the improvements. The proposed project does not qualify under county policy for the requested financing. Furthermore, the petition is defective in that the cost of work is to be spread on a pro-rata share of the assessed valuation of properties included in the proposed district whereas under Chapter 27 costs must be spread on a front foot basis. Recommendation It is recommended that the request from the owners of property on Oak Court for a Chapter 27 assessment district using county financing be denied.
