Posted on Mon, Aug. 07, 2006 Suspect in CHP officer's death held without bail after turning self in By Chris Metinko ' CONTRA COSTA TIMES . OAKLAND -A man believed to have been responsible for the hit-and-run death of a California Highway Patrol officer over the weekend, turned himself in to police Monday and led investigators to the vehicle suspected of having struck the officer. Russell Rodrigues; 47, of Oakland surrendered to officers at the North County Jail In Oakland shortly after noon, said CHP Sgt. Les Bishop. After being questioned by detectives, Rodrigues was taken Into custody at 3:15 p.m. and booked without bail at Santa Rita Jail on charges of felony hit and run and vehicular manslaughter. "It's fair to assume that the attention we got was Instrumental in the quick resolution to this," Bishop said, "Now it's time to take care of the Clearman family and the CHP family and move on. Personally speaking, I know that I feel like there's a little bit of closure with taking him into custody." Rodrigues worked as a jail technician for Alameda County Sheriffs department before he resigned under pressure 21/2 years ago for undisclosed reasons, Sheriff's.spokesman Jim Knudsen said. Meanwhile, Officer Brent Clearman's family spent the day huddled in silence preparing his funeral arrangements. Services will be held at I I a.m.Thursday at the Sleep Train Pavilion in Concord. CHP Lt. Mike Maskarich said Rodrigues led police to a 1990s model Buick LeSabre that police had been searching for in connection with Clearman's death after he was struck Saturday night on an on-ramp to northbound Interstate 880. The car, which was found in Alameda, had damage consistent with a collision with a person or large object, Maskarich said. Clearman was struck at approximately 10:55 p.m. on the 66th Avenue entrance to I-880, where he had left his patrol car to investigate an earlier minor crash on the side of the ramp. The farmer Marine was standing on.the left shoulder when a car struck him and then Pied north on I-880. The two-year CHP veteran died Sunday morning of multiple trauma at Highland Hospital. A carjacking suspect arrested Sunday evening in the 3200 block of Mandela Parkway in West Oakland was not linked to the death,Oakland police said Monday. Clearman,a Washington native, spent 12 years in the U.S. Marines and served in Iraq before leaving the Corps in 2002. He is survived by his wife, Cathy Jo. The couple had no children. Flags at the state Capitol and CHP offices were lowered to half-staff Monday. Clearman was the seventh CHP officer to die in the line Of duty in the past year. Before joining the CHP two years ago,Clearman,a Concord resident who died Sunday from injuries he suffered when he was struck Saturday by a hit-and-run driver on Interstate 880 in Oakland, was a U.S. Marine Corps sharpshooter in Iraq. Other officers, wearing black armbands as they gathered at a news conference, appealed to the driver to come forward. "You've done the wrong thing," said Sgt. Les Bishop Now it's time to do the right thing." Colleagues said Clearman, 33, who worked the all-night shift, thrived on getting suspects off the street. Just last month, he and his partner arrested 33 people on drunken driving charges. "He was the poster child of what we look for In.Highway Patrol men and women," said California Highway Patrol Commissioner Mike Brown an Sunday. "He was good with the public, he was proud of what he did, he was good at what he did." Police all over the Bay Area searched Sunday for the I otorlst who was driving a car that hit Clearman about 10:30 p.m. Saturday as he investigated an accident on northbound I-880 near the Oakland Coliseum. Officials are searching for two cars they believe may bl involved in Clearman's death. Oakland police officers late Sunday found a 2000 Pontiac Grand Am that was carjacked just before the accident, said CHP Sgt. Mike Wright. Police don't know if the Grand Am was linked to Clearman's death, but CHP investigators were questioning the driver of that car. The other car is a severely damaged late'90s champagne color Buick Lasabre. Debris from the scene led investigators to believe that the Buick's hood emblem is missing and the driver's side grill is damaged. Clearman, Wright said, was a great officer and a good match for the CHP. Before coming to the CHP In October 2004, Clearman served in the Marines for 12 years and was a decorated veteran of th'e war in Iraq. Clearman was an experienced sharpshooter and quickly became a weapons training officer, teaching others what he learned In the military. "It's tragic that (the) CHP family is losing a fine officer,"I Wright said. "It's also sad for the community of Oakland, where he served so well." After he was hit, Clearman was taken to the trauma center at Highland Hospital in Oakland, where doctors worked all night to save him. He died Sunday morning, officials said. "The medical staff at Highland did everything humanly and medically possible to save him," said his supervisor, Capt. James Leonard. "And I'm told that Brent fought." Gov. Arnold Schwarzenegger Issued a statement Sunday, saying that "officer Clearman exemplified that commitment and courageously made the ultimate sacrifice-" Flag's at the State Capitol will be flown at half-staff today in honor of Clearman. Clearman leaves behind a wife, Cathy Jo. The couple had no children, Wright said. He's the third CHP officer to die at work this year. In 2005, four officers died ih the line of duty, including Lt. Michael Walker who was struck while investigating a Highway 17 crash on New Year's Eve. While these type of accidents are uncommon, there is no(state law requiring motorists to move to another lane when they see a CHP patrol car with lights flashing on the shoulder. Nearly three dozen other states have such provisions, but Schwarzenegger vetoed a similar measure after it passed the state Legislature in AANA MARK DESAULKIIER (9251646; 67 CHP officer killed in hit-and-run Page 2 of 2 zoos. Some safety advocates argue that the laws preventaccidents such as the one Saturday.'Detractors argue.it would do little to protect officers or other emergency workers and would only serve to Increase traffic on the state's already busy highways. With or without the law, Wright said drivers Should slow down whenever they see a emergency, crew, law enforcement, offlcer or even just a car on the side of the road. 1 "We have a dangerous yob. We work on the side of the road where cars go 50, 60, even 80 miles an hour," Wright said. "We hope as a department, and as an agency that works on the freeway, that any time you see an emergency vehicle on the side of road, you slow down. If you feel safe doing so, get over." Officers gathered at the news conference Sunday talked about their seven colleagues who have died in the tine of duty since September 2005. "When these things happen to us, it hurts. When thls stuff happens to your highway patrol, it should hurt all of us. Once again,we will be planning another funeral," Brown said.
