With respect to performance under this subgrant, Subgrantee is totally self-insured for public general liability and automobile exposures, and for workers' compensation. Subgrantee shall continue to provide adequate resources to cover its legal obligations through- out the period of this subgrant. 6. In the event of any termination, all property, finished or unfinished documents, photographs, data studies and reports, supplies prepared or purchased by the Subgrantee under this subgrant shall be disposed of in accordance with the direction of EDD. 7. At the expiration of the term of this subgrant or upon termination to the expiration of the subgrant, funds not expended for the purposes of this subgrant shall revert to EDD. 8. Termination (a) Either party may terminate this subgrant upon ten (10) days written notice to the other party. Legal Relationships 1. The Subgrantee will comply with the requirements of the Comprehensive Employment and Training Act of 1973, as amended (CETA) P.L. 93-203 Stat. 839 and P.L. 93-567. 88 Stat. 1843) . hereinafter referred to as the Act, and with the regulations I and policies promulgated thereunder; and 2. Subgrantee assures and certifies that if the regulations promulgated pursuant to the Act are amended or revised, he will comply with them or willnotifyEmployment Development Department (EDD) within 30 days after promulgation of the 1 amendments or revision that he cannot so conform so that EDD may take appropriate action including termination, if necessary. f 3. The Subgrantee certifies that he possesses legal authority to apply for the grant or contract; a resolution, motion or similar action has been duly adopted or passed as an official act of the Subgrantee's governing body, authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the person identified ' as the official representative of the Subgrantee to act in connection with the application and to provide such additional information as may be required; and a copy of this document i is attached to this subgrant. 4. This subgrant 1s not intended to and shall not be construed to create the relationship of agent, servant, employee, partnership, joint venture or association between the parties. 5. Services and activities provided under this Act will be administered by or under the supervision of the Subgrantee (sections 105 (a) (1)(B) and 205(0)(1). i 6. EDD shall act as fiscal agent and will process all invoices from and to the subgrantee. 7. Subgrantee agrees that its premises are available for on-site inspection by EDD, its agent or Department of Labor during reasonable business hours. 8. Subgrantee agrees that third party contractural agreements to provide any or all of the services in this subgrant shall be subject to prior written approval of EDD. B. Limiting Provisions 1. Subgrantee assures that he will comply with the provisions of the Hatch Act which limit the political activity of the employees. ! 2. Subgrantee assures that he will comply with the requirement that no program under the Act shall involve political activities (section 710) . - 5 - 3. Subgrantee assures that he will establish safeguards to prohibit employees from using their positions for a purpose that is or gives the appearance of being motivated by desire for private gain for themselves or others, particularly those with whom they have family, business or other ties. 4. Subgrantee assures that participants in the program will not be employed on the con3truction, operation or neintenance of that part of any facility :hich is used for religious instruction or worship (section 703 (3))- 5- Subgrantee assures that the program will not result is the displacement of employed woexers or impair existing contracts for services or result in the substitution of Federal funds for other funds in connection with work that would otherwise be performed (section 703(7))- 6. It will comply with the requirements of the provisions of the Uniform Relocation Assistance and Real Property Acquisition Act � of 1970 (P.L. 91-646 and 11-IC 74-7 issued thereunder) which provides for fair and equitable treatment of persons displaced as a result of Federal and federally assisted programs. I 7. Subgrantee assures that in no event will he assign work experience participants, if any, to other than public agencies and/or non- profit private organizations. Subgrantee understands that work experience in the private, for-profit sector is prohibited. C. Program Provisions 1. Subgrantee will provide manpower services, including job development to those most in need of them including low income persons and persons of limited English-speaking ability, and that the need for continued funding of programs of demonstrated effectiveness is considered in serving such persons (section 105 (a)(1)(D)). 2. Subgrantee wi?1 give special consideration to the needs of eligible disabled veter,3r_s, special veterans, and individuals who served in the 4--ned :crcews and who receive other than a dishonorable discharge within 4 years before the date of their application. Each subgrantee in selecting participants for programs funded under Title I of the Act, shall take into consideration the extent that such veterans are available in the area. Specific effort should be made to develop appropriate full or part-time opportunities for such veterans. The i Subgrantee should utilize the assistance of the State and local veterans employment services representative in formulating its program objectives. i On a continuing and timely basis, information on job vacancies and training opportunities funded under Title I of the Act shall i be provided to the State and local veterans employment services representative for the purpose of disseminating information to eligible veterans (section 104(b) of Emergency Jobs and Unemployment Assistance Act of 1974). 6 - O, I 3. Subgrantee will assure that training and related services will, to the maximum extent practicable, be consistent with every individual's fullest: capabilities and lead to employment opportunities which will enable participants to become economically self-sufficient (section 10 (a)(b)). 4. Subgrantee will assure that rrograms of institutional skill training will be designed for occupations in which skill shortages exist (section 105(a)(b)). ' 5. Subgrantee will assure that institutional skill training and training on the job shall only be for occupations in which the Secretary or the prime sponsor has determined there is reasonable i expectation for employment (section 70300)). 6. Subgrantee will insure that the program will, to the maximum feasible, contribute to the occupational development or upward mobility of individual participants (section 70303)). 7. Subgrantee will insure training will not be for any occupations which require less than two weeks of pre-employment training, unless ir=ediate employment opportunities are available in that occupation (section 703 (8)). I B. Subgrantee will insure that conditions of employment or training will be appropriate and reasonable with regard to the type of work, the gebgrarhical region and the proficiency of the applicant (section 703(4)). 9. Subgrantee will insure that appropriate stan_'.ards for health and safety in work and training situations will be maintained (section 703(5))- 10. Subgrantee will insure that he will comply with the labor standards requirements set out in section 706 of the Act. D. Fiscal Provisions j I 1. Subgrantee will comply with 0:0 Circular number A-95 and Federal Management Circular MC) 74-4 and 74-7, as those circulars relate to the utilization of funds, the operation of programs, and maintenance of records, books, accounts, and other documents under the Act. 2. The Subgrantee certifies that he has adequate administrative and accounting controls, personnel standards, evaluation procedures and other policies as may be necessary to promote the effective use of funds (section 70304)). I i - 7 I I 3. Subgrantee will submit reports as required by EDD and the Secretary and will maintain records and provide accecs to them as necessary for IWD and the Secretary's review to assure that funds are being expanded in accoidanca with the purposes and provisions of the lict, includir g the n_aintennnce of records i to assist IDD and the Secreteuy in determinir4- the extent to which the program meet: the special needs of dicedvantaged, chronically unemployed, and low incowe persons for meaningful employment opportunities (section 703(12) and 311(c)). 4. CLTA funds will, to the extent practicable, be used to supplement, rather than supplant, the level of funds that would otherwise be available for the planning and administration of programs under i the eligible Subgrantee's grant or contract (section 70301)). ' I 5. Subgrantee shall submit written invoices monthly in the manner and form prescribed by EDD. No final payment shall be made by EDD until receipt of the final report from Subgrantee. i 6. Subgrantee shall submit fiscal and statistical data required by j IDD on a monthly basis. 7• Subgrantee expenditures for each cost category will not exceed the total amounts listed under that category. 8. Subgrantee expenditures for salary and fringe benefits line items shall not exceed the amount budgeted. Other expenditures may i exceed budgeted line item amounts within a Cost Category subject i to the following limitation: Line item fle®ibility is restricted to 15% of the total amount remaining in a Cost Category after ' deducting the amount established for salaries and fringe benefits. 9. IDD and/or the U.S. Department of Labor shall have the right to observe and monitor all conditions and activities of this CETA Project, and the Subgrantee shall maintain such program and fiscal records and make such program and fiscal reports as are required by EDD and/or the U.S. Department of Labor with regard to this i CFTA Project.' 10. Subgrantee assures that he will provide ap-- riate workers' j compensation to all participants in on-the-job training, work experience or public service employment activities and appropriate insurance for all participants in classroom training, services to clients, or other activities (section 703(6)). i 11. Subgrantee shall make appropriate provision for the manpower i needs of clients in the area served (section 70305)) and will assure that: - 8 - i A, Individuals receiving training on the job shall be compensated by the employer at such rates, including periodic increases, as may be deemed reasonable under regulations prescribed by the Secretary, but in no event at a rate less than that specified in Section 6(a) (1) of the Fair Labor Stancsrds Act of 1938 or, if higher, under the applicable State or local minimum wage law (section 111(b)). B. Persons employed in Fublic service jobs un•'er this Act shall be paid gages which shall not by lower than whichever is the highest of (a) the minimum wage which would be i%.pplicable to the employee under the Fair Labor Standard: Act of 1938, if i Section 6(a) (1) of such title applies to the participant and if he were not exempt under section 13 thereof, (b) the State of local minimu.-, wage for the moat nearly comparable covered employment, or (c) the prevailing rates of pay for persons employed in similar public occupations by the same employer (section 208(a)(2)). I 12. Subgrantee agrees that EDD and/or Q.S. Department of Labor shall have access to and right to examine and audit all records, books, papers or documents related to the conduct of programs funded by this subgrant. The Subgrantee further agrees to retain all such records, books, papers or documents pertaining to this subgrant for three years from the termination of this subgrant. 13. No later than sixty (60) days following the termination of this subgrant Subgrantee shall submit to EDD a cost report in the form required by EDD showing the actual allowable program costs. If the cost report shows that the actual allowable program costs for the term exceed the payments, EDD will remit the difference , to Subgrantee subject to the maxinmun specified in the payment - limit. If the cost report shows that the payments exceeded the actual allowable program costs for the term, Subgrantee shall refund the difference to LDD. E. Affirmative Action/Grievance Procedures Providion 1. Subgrantee assures that he will comply with Title VI of the Civil Rights Act of 1964, (P.L. 86-354), and in accordance with Title VI i of the Act no person in the United States shall on the ground of race, color, sex, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to i discrimination under any program or activity for which the Subgrantee received Federal financial assistance, and the Subgrantee will immediately take any measures necessary to effectuate this assurance. 2. Subgrantee assures that tie will comply with Title VII of the Civil Rights Act of 1964, (42 USC 2000d) prohibiting employment discrimination where (1) the primary purpose of a grant or contract is to provide employment or (2) discriminatory employment practices will result in unequaltreatment of persons who are or should be benefiting from the grant-aided activity. - 9 - 3. Subgrantee assures that no person with responsibilities in the operation of any program under the Act will discriminate with respect to any program participant or any applicant for participation in such program because of race, creed, color, nationrl origin, sex, age, political affiliation or beliefs (sections 703(1) and 712). 4. Subgrantee nonares that it will comply with Executive Order No. 11246, entitled "Equal Employment Opportunity" as supplemented in Departmant of Labor re6ulations (41 CM Part 60). Subgrantee hereby assures that it has an Affirmative ' Action Plan which in applicable to and covers staff and participants reimbursed through this subgrant, which declares i that it does not discriminate on the basis of race, color, religion, creed, national origin, physical handicap, sex, political. affiliations or beliefs and age and which i specifies goals and target dates to assure the implementation of that plan. Subgrantee will file the approved documentation of the above Affirmative Action Plan with EDD (State CGTA i Office) 10 days before the start of actual program operations. 5. Subgrantee will implement the State CETA Office complaints and grievance procedure for resolving any issue between subgrantee and participants. i I I 10- ------ ------------ ------- - - EXHIBIT a STANDARD OF CONDUCT Subgrantee hereby assures that in administering this EDD subgrant, it will comply with the standards of conduct hereinafter set out, for maintaining the integrity of the project and avoiding any conflict of interest in its administration. General Assurance Every reasonable course of action will be taken by the subgrantee in order to maintain the integrity of this expenditure of public funds and to avoid any favoritism, questionable or improper conduct. This subgrant will be administered in an impartial manner, free from personal, financial or political gain. The subgrantee, its executive staff and employees, in administering the subgrant, will avoid situations which give rise to a suggestion that any decision was influenced by prejudice, bias or personal gain. Conducting Business Involving Relatives j No relative by blood, adoption or marriage of any executive or employee of the subgrantee, will receive favorable treatment in either services provided by, or employment with, the subgrantee. The subgrantee will obtain from each employee and potential participant a complete and signed questionnaire, a copy of which is attached hereto. A copy of the questionnaire shall be retained in the subgrantee's permanent files and made available to EDD personnel for audit purposes. If an employee or potential participant is related to an executive or employee of the subgrantee, the questionnaire shall be submitted to the Chief Counsel of EDD for a ruling on the propriety of participation. Conducting Business Involving Close Personal Friends and Associates Executives and employees of the subgrantee will be particularly aware of the varying degrees of influence that can be exerted by personal friends and associates and, in administering the subgrant, will exercis; due diligence to avoid situations which may give rise to an assertion that favorable treatment is being granted to friends or associates. When it is in the public interest for the 'subgrantee to conduct business with a friend or associate of an executive or employee of the subgrantee, a permanent record of the transaction will be retained. Avoidance of Conflict of Economic Interest An executive or employee of the subgrantee will not solicit or accept money or any other consideration from a third person, for the performance of an act reimbursed in whole or part by the subgrantee or EDD. This project will operate between April 1, 1981 and September I 30, 1981. This project is an extention/expansion of the 204(c)(2) project originally ! funded beginning in February, 1980. Briefly, this project was the first smitten under Section 204(c)(2) by the Manpower Education Section. It was designed to serve the rapidly growing bilingual community in Contra Costa County which had, to a large extent, been denied regular CETA training opportunities because of language barriers which prevented them from achieving a qualifying reading level based upon an English-language �. evaluation. This project has utilized and coordinated the training resources of the Pittsburg Unified School District, Adult Education Center, and the facilities of Polly Priest Business College. It also utilized: i 1. The Contra Costa Office of EDD for outreach, recruitment and job market information; 2. The Prime Sponsor's CETA Units for orientation, eligibility determination, referral, and allowance payment services; 3. The Private Industry Council for policy, curriculum, and industry needs advice; 4. The Prime•Sponsor's Staff for HIS and technical service; S. The Manpower Education Staff for project monitoring and guidance; and 6. The local media for outreach and project publicity. Funding resources for the project link the following: I 1. State Department of Education, Manpower Education Section, Section 204(c)(2), for Private School training cost, coordination/job development cost, and clerical assistance at the Public School site; 2. State of California, Educational Apportionment Fund (ADA), for the Public School training cost; and 3. Contra Costa County, Department of Manpower Programs, CETA Title IIB funds, for allowances and support services. i I If 25 The project began in February, 1980, with considerable outreach and I recruitment activity, but with initially very modest response. The original 40 training slots were not filled until May of 1980 and, at our request, the training time was extended by the Prime Sponsor and Manpower Education Section so that the project ending date is currently April 30, 1981. Having overcome the initial outreach and recruitment problems, the project has moved along at a very satisfactory rate, with students, training agencies, and Prime Sponsor representatives enthusiastically viewing these special training efforts. Outcomes for the first group are expected to equal the target job entry level of 48. The need in the community for this service is a growing one, and there have been many requests for enrollment from the bilingual community coming from members of family, friends, and +neighbors of current participants. In meetings of the training agencies and Prime Sponsor representatives, extension of the current training efforts were deemed highly desirable. Because of declining CETA fundi, it was irmpossible, however, for the Corin g! to continue to support tie extension with allowance monies. In addition, to training 40 additional bilingual residents of Contra Costa County, the project extension will provide EDD with a complete Project Manual detailing the procedures +_ecessary to link the training, supportive, and funding agencies, as well as a description of the training process, job development, and placement activities. This i Manual should enable project replication by EDD anywhere the need appears in California. The project extension will also demonstrate that:- 1. The funding resources of a variety of agencies can be linked and coordinated in a productive training effort as the law intended; 2. The training resources of public and private agencies can work together in a cooperative effort to achieve a single outcome; 3. The bilingual residents of Contra Costa County, a community swollen by refugees from around the world, can be served by a Manpower program that previously screened them out because of language barriers; and 4. The labor market can beiefit from the wide variety of skill which the bilingual community brings to our society. A separate subgrant between Polly Priest Business College, the Pittsburg Unified School District, and the State Department of Education will i provide funding for the training delivery itself. Organization Chart The County Department of Manpower Programs (DMP) is a line department within the Contra Costa County government. The Manpower Director is directly responsible to the Board of Supervisors and the County Administrator. Legal Relationships 1. The Subgrantee will comply with the requirements of the Comprehensive Employment and Training Act of 1973, as amended (CF.TA) P.L. 93-203 Stat. 839 and P.L. 93-567, 88 Stat. 1843) , hereinafter referred to as the Act, and with the regulations and policies promulgated thereunder; and 2. Subgrantee assures and certifies that if the regulations promulgated pursuant to the Act are amended or revised, he will comply with them or will notify Employment Development Department (EDD) within 30 days after promulgation of the amendments or revision that he cannot so conform so that EDD may take appropriate action including termination, if necessary. 3. The Subgrantee certifies that he possesses legal authority to I apply for the grant or contract; a resolution, motion or similar action has been duly adopted or passed as an official act of the Subgrantee's governing body, authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the person identified as the official representative of the Subgrantee to act in connection with the application and to provide such additional information as may be required; and a copy of this document is attached to this subgrant. I 4. This subgrant is not intended to and shall not be construed to y create the relationship of agent, servant, employee, partnership, I joint venture or association between the parties. 5. Services and activities provided under this Act will be administered by or under the supervision of the Subgrantee (sections 105 (a) (1)(B) and 205(0)(1). 6. EDD shall act as fiscal agent and will process all invoices from i and to the subgrantee. 7. Subgrantee agrees that its premises are available for on-site inspection by EDD, its agent or Department of Labor during reasonable business hours. 8. Subgrantee agrees that third party contractural agreements to provide any or all of the services in this subgrant shall he subject to prior written approval of EDD. B. Limiting Provisions 1. Subgrantee assures that he will comply with the provisions of the Hatch Act which limit the political activity of the employees. i 2. Subgrantee assures that he will comply with the requirement that no program under the Act shall involve political activities (section 710) . - 5 - i 3. Subgrantee assures that he will establish safeguards to prohibit employees from usinc their positions for a purpose that is or gives the appearance of being motivated by desire for private gain for themselves or others, particularly those with whom they have family, business or other ties. 4. Subgrantee assures that participants in the program will not be employed on the construction, oreration or mrintenarce of that part of any facility Bich is used for religious instruction or worship (section 703 (3))- 5. Subgrantee assures that the program wall not resalt in the displacement of employed workers or impair existing contracts for services or result in the substitution of Federal funds for other funds in connection with work that would otherwise be performed (section 703(7))• 6. It will comply with the requirements of the provisions of the Uniform Relocation Assistance and Real Property Aceuisition Act of 1970 (P.L. 91-646 and YvC 74-7 issued thereunder) which provides for fair and equitable treatment of persons displaced as a result of Federal and federally assisted programs. 7. Subgrantee assures that in no event will he assign work experience participants, if any, to other than public agencies and/or non- i profit private organizations. Subgrantee understands that work experience in the private, for-profit sector is prohibited. C. Program Provisions 1. Subgrantee will provide manpower services, including fob development to those most in need of then including low income persons and persons of limited English-speaking ability, and that the need for continued funding of programs of demonstrated effectiveness is considered in serving such persons (section 105 (a)(1)(D)). 2. Subgrantee will give special consideration to the needs of eligible disabled veterars, ep-ecial veterans, and individuals who served in the A-ned Fcrces and who receive other than a dishonorable discharge within 4 years before the date of their application. Each subgrantee in selecting participants for programs funded under Title I of the Act, shall take into i consideration the extent that such veterans are available in the area. Specific effort should be Cade to develop appropriate full or part-time opportunities for such veterans. The ! Subgrantee should utilize the assistance of the State and local i veterans employment services representative in formulating its program objectives. I On a continuing and timely basis, information on job vacancies and training opportunities funded under Title I of the Act shall be provided to the State and local veterans employment services representative for the purpose of disseminating information to eligible veterans (rection 104(b) of Emergency Jobs and Unemployment Assistance Act of 1974). - - 6 - i 3. Subgrantee will assure that training and related services will, to the maximum extent practicable, be consistent with every individual's fullest: capabilities and lead to crployment opportunities which will enable participants to become economically self-sufficient (section 105(a)(b)). 4. Subgrantee will essure that rrograms of institutional skill training will be designed for occupations in which skill I shortages exist (section 105(a)(b)). I 5. Subgrantee will assure that institutional skill training and training on the job shall only be for occupations in which the Secretary or the prime sponsor has determined there is reasonable expectation for employment (section 70300)). 6. Subgrantee will insure that the program will, to the maximum feasible, contribute to the occupational development or upward mobility of individual participants (section 703(13)). i 7- Subgrantee will insure training will not be for any occupations which require less than two weeks of pre-employment training, unless immediate employment opportunities are available in that occupation (section 703 (8)). 8. Subgrantee will insure that conditions of employment or training will be appropriate and reasonable with regard to the type of work, i the gebgrarhical region and the proficiency of the applicant (section 703(4)). 9. Subgrantee will insure that appropriate stanaards for health and safety in- work and training situations will be maintained (section 703(5))• 10. Subgrantee will insure that he will comply with the labor standards requirements set out in section 706 of the Act. D. Fiscal Provisions 1. Subgrantee will cc.^.ply with 0:S Circular number A-95 and Federal Management Circular (FYC) 74-4 and 74-7, as those circulars relate to the utilization of funds, the operation of programs, and maintenance of records, books, accounts, and other documents under the Act. 2. The Subgrantee certifies that he has adequate administrative and accounting controls,- personp.el standards, evaluation procedures and other policies as may be necessary to promote the effective use of funds (section 703(14)). Subgrantee will submit reports as required by EDD and the Secretary and will maintain records and provide access to them as necessary for M- D and the Secretary's review to assure that funds are being expanded in accordance with the purposes and provisions of the fact, includ:rg the maintenance of records to assist EDD and the Secretary in deter-minir:g the extent to which the program meetcs t'_-e special needs o: dieedvantaged, chronically unemrloy2d, and low incowe persons for meaniagful employment opportunities (section 703(12) and 311(c)). 4. CETA funds will, to the extent practicable, be used to supplement, rather than su^plant, the level of funds that would otherwise be ' available for the planning and ad-ministration of programs under the eligible Subgrantee's grant or contract (section 70301)). 5. Subgrantee shall submit written invoices monthly in the manner and form prescribed by EDD. No final payment shall be made by EDD until receipt of the final report from Subgrantee. 6. Subgrantee shall submit fiscal and statistical data required by IDD on a monthly basis. 7. Subgrantee expenditures for each cost category will not exceed the ` total amounts listed under that category. 8. Subgrantee expenditures for salary and fringe benefits line items shall not exceed the amount budgeted. Other expenditures may exceed budgeted line item amounts within a Cost Category subject to the following limitation: Line item flexibility is restricted to 15 of the total amount remainin i in a Cost Category after deducting the amount established for salaries and fringe benefits. 9. EDD and/or the U.S. Department of Labor shall have the right to observe and monitor all conditions and activities of this CETA Project, and the Subgrantee shall maintain such program and fiscal records and make such program and fiscal reports as are required by EDD and/or the U.S. Department of Labor with regard to this ChTA Project.' 10. Subgrantee assures that he will provide sprc:---priate workers' compensation to all participants in on-the-job training, work experience or public service employment activities and appropriate i insurance for all participants in classroom training, services to clients, or other activities (section 703(6)). 11. Subgrantee shall make appropriate provision for the manpower needs of clients in the area served (section 70305)) and will assure that: i I - 8 - I 1 • . I i I A. Individuals receiving training on the job shall be compensated by the employer at such rates, including periodic increases, as may be deemed reascnable under regulstians prescribed by the Secretary, but in no event at a rate less than that specified I in Section 6(a) (1) of the Fair Labor Stenearis Act of 1938 or, if higher, under the applicable State or local minimum wage law i (section 111(b)). I B. Persons employed in Fublic service jobs un•:er this Act shall be paid wages which shall not be lo•.+er than whichever is the highest of (a) the minimum wage which would be H.Dplicable to the employee under the Fair Labor Standardn Act of 19389 if Section 6(a) (1) of auch title applies to the participant and i if he were not exempt under section 13 thereof, (b) the State of local minima:, wage for the most nearly comparable covered employment, or (c) the prevailing rates of pay for persons employed in similar public occupations by the same employer (section 208(a)(2)). 12. Subgrantee agrees that EDD and/or D.S. Department of Labor shall have access to and right to examine and audit all records, books, papers or documents related to the conduct of programs funded by this subgrant. The Subgrantee further agrees to retain all such records, books, papers or documents pertaining to this subgrant for three years from the termination of this subgrant. 13. No later than sixty (60) days following the termination of this subgrant Subgrantee shall submit to EDD a cost report in the form required by EDD showing the actual allowable program costs. If the cost report shows that the actual allowable program costs for the term exceed the 1,3ynents, EDD will remit the difference to Subgrantee subject to the maxiimun specified in the payment limit. If the cost report shows that the payments exceeded the actual allowable p_•ogrnm costs for the term, Subgrantee shall refund the difference to LDD. E. Affirmative Action/Grievance Procedures Providion 1. Subgrantee assures that he will comply with Title VI of the Civil Rights Act of 1964, (P.L. 88-3;4)9 and in accordance with Title VI of the Act no person in the United States shall on the ground of race, color, sex, or national origin, be excluded from participation I in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Subgrantee received Federal financial assistance, and the Subgrantee will immediately take any measures necessary to effectuate this assurance. 2. Subgrantee assures that he will comply with Title VII of the Civil Rights Act of 1964, (42 USC 2000d) prohibiting employment discrimination where (1) the primary purpose of a grant or contract is to provide employment or (2) discriminatory employment practices will result in unequal treatment of persona who are or should be benefiting from the grant-aided activity. Subgrantee assures that no person with responsibilities in the operation of any program under the Act will discriminate with respect to any program participant or any applicant for participation in such program because of race, creed, color, national origin, sex, age, political affiliation or beliefs (sections 703(1) and 712). 4. General Assurance Every reasonable course of action will be taken by the subgrantee in order to maintain the integrity of this expenditure of public funds and to avoid any favoritism, questionable or improper conduct. This subgrant will be administered in an impartial manner, free from personal, financial or political gain. The subgrantee, its executive staff and employees, in administering the subgrant, will avoid situations which give rise to a suggestion that any decision was influenced by prejudice, bias or personal -gain. Conducting Business Involviru Relatives i No relative by blood, adoption or marriage of any executive or employee of the subgrantee, will receive favorable treatment in either services provided by, or employment with, the subgrantee. The subgrantee will obtain from each j employee and potential participant a complete and signed questionnaire, a copy of which is attached hereto. A copy of the questionnaire shall be retained in the subgrantee's permanent files and made available to EDD personnel for audit purposes. If an employee or potential participant is related to an executive or employee of the subgrantee, the questionnaire shall be submitted to the Chief -Counsel of EDD for a ruling on the propriety of participation. Conducting Business Involving Close Personal Friends and Associates I Executives and employees of the subgrantee will be particularly aware of the varying degrees of influence that can be exerted by personal friends and associates and, in administering the subgrant, will exercise^ due diligence to avoid situations which may give rise to an assertion that favorable treatment is being granted to friends or associates. When it is in the public interest for the subgrantee to conduct business with a friend or associate of an executive or employee of the subgrantee, a permanent record of the transaction will be retained. Avoidance of Conflict of Economic Interest An executive or employee of the subgrantee will not solicit or accept money Or any other consideration from a third person, for the performance of an act reimbursed to whole or part by the subgrantee or EDD. Supplies, materials, equipment or services purchased with subgrant funds will be used solely for purposes allowed under the subgrant. Compliance Failure to comply with these assurances may be deemed a material breach of the subgrant and the basis for immediate termination of the subgrant. This project will operate between April 1, 1981 and September 30, 1981. This project is an extention/expansion of the 204(c)(2) project originally i funded beginning in February, 1980. Briefly, this project was the first written under Section 204(c)(2) by the Manpower Education Section. It was designed to serve the rapidly growing bilingual community in Contra Costa County which had, to a large extent, been denied regular CETA training opportunities because of language barriers which prevented them from achieving a qualifying reading level based upon an English—language evaluation. This project has utilized and coordinated the training resources of the Pittsburg Unified School District, Adult Education Center, and the facilities of Polly Priest Business College. It also utilized: i 1. The Contra Costa Office of EDD for outreach, recruitment and job market information; 2. The Prime Sponsor's CETA Units for orientation, eligibility determination, referral, and allowance payment services; I _ 3. The Private Industry Council for policy, curriculum, and industry needs advice; 4. The Prime Sponsor's Staff for MIS and technical service; 5. The Manpower Education Staff for project monitoring and guidance; and 6. The local media for outreach and project publicity. Funding resources for the project link the following: 1. State Department of Education, Manpower Education Section, Section 204(c)(2), for Private School training cost, coordination/job development cost, and clerical assistance at the Public School site; 2. State of California, Educational Apportionment Fund (ADA), for the Public School training cost; and 3. Contra Costa County, Department of Manpower Programs, CETA Title II—B funds, for allowances and support services. — 1 — i The project began in February, 1980, with considerable outreach and recruitment activity, but with initially very modest response. The original 40 training slots were not filled until May of 1980 and, at our request, the training time was extended by the Prime Sponsor and Manpower Education Section so that the project ending date is currently April 30, 1981. Having overcome the initial outreach and recruitment problems, the project has moved along at a very satisfactory rate, with students, training agencies, and Prime Sponsor representatives enthusiastically viewing these special training efforts. Outcomes for the first group are expected to equal the target job entry level of 48. - The need in the community for this service is a growing one, and there have been many requests for enrollment from the bilingual community corning from members of family, friends, and neighbors of current participants. In meetings of the training agencies and Prime Sponsor representatives, extension of the current training efforts were deemed highly desirable. Because of declining CETA funds, it was impossible, however, for the County to continue to support the extension with allowance monies. It is requested that the State CETA Office join the funding linkage in this project so that 40 new participants can be trained from April 1, 1981 through September 30, 1981. The funding requested would cover payment of allowances to project participants during the six—month period. The amount is estimated to be $78,823. Funds unexpended from this total would be returned to EDD by the Prime Sponsor. We believe that an additional 40 participants can be enrolled in the i project within the first three weeks of April and that they can be trained to employability by the end of September. A waiting list of prospective participants has been assembled at each of the training sites, and we feel sure that the outreach and recruitment problems experienced a year ago have been largely overcome by the most effective outreach method of all — word of mouth. In addition to training 40 additional bilingual residents of Contra Costa County, the project extension will provide EDD with a complete Project Manual detailing the procedures necessary to link the training, supportive, and funding agencies, as well as a description of the training process, job development, and placement activities. This Manual should enable project replication by EDD anywhere the need appears in California. The project extension will also demonstrate that: I 1. The funding resources of a variety of agencies can be linked and coordinated in a productive training effort as the law intended; 2. The training resources of public and private agencies can work together in a cooperative effort to achieve a single outcome; 3. The bilingual residents of Contra Costa County, a community swollen by refugees from around the world, can be served by a i Manpower program that previously screened them out because of language barriers; and 4. The labor market can benefit from the wide variety of skill which the bilingual community brings to our society.
