HomeMy WebLinkAboutRESOLUTIONS - 06242008 - 08-434 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 24, 2008 by the following vote: AYES: Gioia,Uilkema,Piepho,Bonilla&Glover NOES: none ABSENT: none ABSTAIN: none - RESOLUTION NO. 2008/ 4S 4 SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful performance, Drainage Acceptance 00-00002 (cross-reference 95-07976), for project being developed by Windemere BLC Land Company, LLC, San Ramon (Dougherty Valley) area. (District III) On July 25, 2006, this Board resolved that the improvements in Drainage Acceptance 00- 00002 (cross-reference 95-07976) were completed as provided in the Subdivision Agreement with Windemere BLC Land Company, LLC and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance. NOW THEREFORE BE IT RESOLVED that the Public Works Director is AUTHORIZED to: b • REFUND the 24,000.00 cash deposit (Auditor's Deposit Permit No. 372608, dated August 7, 2001) plus interest to Windemere BLC Land Company, LLC in accordance with Government Code Section 53079 (if appropriate), Ordinance Code Section 94-4.406, and the subdivision agreement. BE IT FURTHER RESOLVED that upon approval of the Board, the Developer shall retain the civil improvements for maintenance and ownership in accordance with the G.HAD Plan of Control. BE IT FURTHER RESOLVED that the warranty period has been completed and the Drainage Improvement Agreement and surety bond, Bond No. 11133583275, dated July 18, 2001, issued by The American Insurance Corp., are exonerated.
