RESOLUTION ORDERING THE WORK AND
CALLING FOR SEALED BIDS
The Board of Supervisors of Contra Costa County does
resolve as follows:
WHEREAS, the Board of Supervisors of the County of
Contra Costa on the 17th day of October, 1961, adopted its
resolution of intention, No. 381, to order the therein described
work and improvements to be done and made in Contra Costa County
Assessment District 1961--4, which resolution of intention was
duly and legally published in the time, form and manner required
by law, as shown by the affidavit of publication of said resolu-
tion of intention on file in the office of the County Clerk of
said County; and
WHEREAS, after the adoption thereof notices of the
passage of said resolution of intention headed "Notice of
Improvement" were duly and legally posted in the time, form,
manner, location and number required by law, as appears from
the affidavit of posting said notices on file in the office of
the County Clerk of said County; and
WHEREAS, after the adoption thereof, a copy of said
resolution. of intention was duly mailed to all persons owning
real property proposed to be assessed for the improvements
described in said resolution of intention, according to the
names and addresses of such owners as the same appear on the
last equalized assessment roll for taxes, prior to the date of
such mailing or as known to the County Clerk of said County,
which said copies were duly mailed in the time, form and manner
required by law; and
WHEREAS, no written protests to the making of said
improvements were filed with the Clerk of this Board prior to
the time specified in said resolution of intention, and no oral
protests to the making of said improvements were made at the
time and place specified in said resolution of intention; and
WHEREAS, said Board of Supervisors has duly received
and considered evidence oral and documentary concerning the
jurisdictional facts in this proceeding and concerning the nec-
essity for the proposed work and improvements and the benefits
to be derived therefrom, and said Board of Supervisors has
acquired jurisdiction to order proposed improvements,

NOW, THEREFORE, BE 1T RESOLVED that the public inter-
est and convenience require the construction of the improvements
herein referred to, and the Board of Supervisors hereby orders
that the Work and improvements as set forth and described in
said resolution of intention and in the plans and specifications
adopted by this board on the 23d day of January, 1962, be done
and made;
THAT the boundaries of the assessment district and the
grades to which work and improvements are to be constructed
shall be those set forth and described in said resolution of
intention and in the plans and specifications hereinabove re-
ferred to, reference to which is hereby made for all further
particulars;
THAT the County of Contra Costa will contribute to the
cost of said improvements the sum of Four Thousand., Six Hundred
Dollars ($4,600.00) , and that said sum shall be applied first
to the payment of incidental: expenses incurred before the
signing of a contract with the successful bidder for the con-
struction of said improvements;
THAT sealed proposals and bids for the making of said
improvements shall be delivered to the County Clerk of the
County of Contra Costa at or before 11.00 a. m. on February 20,
1962, in the office of said County Clerk in the Hall of Records,
Martinez, California. Said bids, after being publicly opened,
examined and decl.ared,will be calculated by the Engineer of Work
and a report of the results of the bidding and the calculations
of the Engineer of Mork will be reported to this beard at its
next regular meeting. The Board of Supervisors reserves the
right to reject any and all proposals and bids should it deem
this necessary for the public good, and also the bid of any
bidder who has been unfaithful in any former contract with the
County of Contra Costa;
THAT the bidder to whom the contract is awarded will
be obligated at the signing of the contract to advance all
incidental expenses incurred up to the time of entering into
the contract, in excess of the sum of Four Thousand, Six Hun-
dred Dollars ( 4,600.00) ;
THAT the County Clerk of the County of Contra Costa
is hereby ordered to give notice in writing such sealed bids
in the time, form and manner provided by law;
THAT said resolution of intention dated October 17,
1961., is hereby ratified, confirmed and finally adopted.
PASSED AND ADOPTED this 23d day of January, 1962, by
the following vote of the Board:
AYES: Supervisors James P. Kenn , Mel F. Nielsen,
Thomas John Coll, Edmund . Linscheid, Joseph
S. Silva.
