HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-573 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Improvements �-y to be Made in Contra Costa RESOLUTION NO. 0 U County Assessment District 1961-4 (Ichabod Lane, Orinda) RESOLUTION F IND ING AND DECLARING THAT THE SPECIAL ASSESSMENT INVESTIGATION, LDMITATION AND MAJORITY PROTEST ACT OF 1931 IS INAPPLICABLE TO THESE PROCEEDINGS The Board of Supervisors of the County of Contra Costa does resolve as follows: WHf,�REAS, there was filed with the Clerk of the Board of Supervisors of Contra Costa County, on the 5th day of July, 1961, a written petition for the improvement of Ichabod Lane, Orinda; and WHEREAS, in accordance with said petition, this Board on the 17th day of October, 1961, adopted a Resolution of Intention to construct said improvements and to make the cost thereof chargeable against the properties benefited thereby, throu-h the formation of Contra Costa County Assessment District 1961-4, under the provisions of the Improvement Act of 1911; and WHEREAS, said petition was signed by all of the owners of more than sixty per cent (60%) in area of the property subject to assessment for said proposed improvements; and WHEREAS, said owners, by said petition, specifically waived investigation proceedings under the provisions of the Special Assessment Investigation, Limitation and Majority Pro- test Act of 1931, NOW, THEREFORE, BE IT RESOLVED: THAT this Board hereby finds and declares that the Special Assessment Investigation, Limitation and. Majority Pro- test Act of 1931 is inapplicable to these proceedings. PASSED AND ADOPTED this 23d _ day of January, 1962, by the following vote of the Board.- AYES: oard:AYES: Supervisors - James P.
