RESOLUTION NO- 560 WHEREAS representatives of the City of Concord will appear before the Public Utilities Commission of the State of California at 10:00 a .m. on Tuesday, January 30, 1962, to present testimony with respect to the crossing at grade of the tracks of the Sacramento Northern Railway Companyts right of way by the extension of Olivera Road in the City of Concord; and WHEREAS this case involves a protest by the City of Concord with respect to a charge by the railroad for the mainte- nance of railroad automatic signals; and WHEREAS it has been the traditional practice in such in- stances for railroads to maintain such automatic signals at their own expense; and WHEREAS the County of Contra Costa is in full agreement with the position taken by the City of Concord; NOW, THEREFORE, BE IT BY THIS BOARD RESOLVED that the Public Utilities Commission of the State of California. be advised that this Board of Supervisors is of the firm opinion that the maintenance cast of such automatic signals should be borne by the railroad in accordance with customary practices . PASSED AND ADOPTED this 9th day of January, 1962, by the following vote of the Board: AYES: Supervisors James P. Kenny, Mel F. Nielsen, Thomas John Coll, Edmund A. Linscheid, Joseph S . Silva .
