HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-492 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Concurrence in Proposed Amendment to Regulation 1 of the Bay Area RESOLUTION NO. 9 2 Air pollution Control District . WHEREAS, the Bay Area Air Pollution Control District held a public hearing on October 18, 1961 to consider amendment of its Regulation 1 to permit burning in flood control channels under emergency conditions; and WHEREAS, the Board by their order dated 17 October 1961 requested modification of the proposed amendment to permit burning under certain conditions; and WHEREAS, the Bay Area Air pollution Control Board at the conclusion of this hearing instructed their legal counsel to re-draft this proposed amendment to Regulation 1 for considera- tion of that Board at their December lath meetingand WHEREAS, the revised draft prepared by the legal coun- sel of the Bay Area Air Pollution Control Board, which will con- stitute item 'h" in a list of exceptions to the fire prohibited under Regulation No. 1, has been brought to the attention of this Board and reacts as follows "Fires set or permitted by a public official in charge of flood control activities for the purpose of disposal of vegetative growth which grew in or at the channel which is lying or growing within the natural channels of natural water courses and flood control channels which fires are in the opinion of such official a necessary incident to the clearing and maintenance of water courses and flood control channels for the speci- fic purpose of preventing or eliminating a flood hazard ." ; and WHEREAS, the Board of Supervisors of Contra Costa County has considered this re-draft of proposed amendment to Regulation 1; NOW, THEREFORE, BE IT RESOLVED that the Board of Super- visors of Centra. Costa County wholly concurs in this re-draft of the proposed amendment and urges the favorable consideration of the Board for the Bay Area. Air Pollution Control District to adopt this re- draft of the proposed amendment substantially in its present form in order that the needed and necessary channel burning to avoid flood hazards may be continued . PASSED AND ADOPTED this 12th day of December, 1961, by the following vote of the Board: AYES: Supervisors James P. Kenny, Mel F . Nielsen, Thomas John Coll, Edmund A. Linscheid, Joseph S.
