HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-438 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Resolution of Sunnary Abandonment of Superseded Portions of POMONA STREET, County Road No. 2191, RESOLVrION No near Port Costa, The Board of Supervisors of the County of Contra Costa does resolve as follows: THAT,a portion of that certain County road,, known as Pomona Street (County Road No. 2191) situated within the County of Contra Costa, has been superseded by relocation; and THAT, said relocation will not out off access to the property of any person, which prior to such relocation adjoined the highways; and THAT, it appears proper that said portions of relocated roads be summarily abandoned as provided in, Section 960.1 of the Streets and Highways Code; and THAT, a deed has been tendered to the County of Contra Costa quitclaiming the interest in lands for the , right of way for the relocated portions of Pomona Street, in consideration of the abandonment by the County of Contra Costa of portion of the County Road described herein, which by this resolution is abandoned; and THAT, it is to the mutual advantage of the County of Contra Costa and said grantor that said abandonment be effected„ and THAT, portion of said County road superseded by re- location and more particularly described as follows: Portion of Canada Del Hambre (Northern Part) described as follows: All that portion of right of way contained in the grant from G. W. MaNear to the Board of Supervisors of Contra Costa County recorded October 12, 1888 in book 54 of Deeds, at page 257, lying within the 29.31 acre ;parcel of land described in the deed from G, W. McNeer, Incorporated, to Tidewater Oil Company, a corporation recorded December 19, 1960, under Recorder's Series No. 61494,, in book 3766 of Official Records, at page 208. RES OLt3T ISN N{34 3 8 be and the same is hereby ABANDONED, and the Clerk of the Beard of Supervisors is directed to cause a certified copy of this resolution to be recorded in the office of the County Recorder of the County of Contra Costa; and THAT, this Board does hereby approve and accept the Quitclaim Deed, dated August 24, 1961 from Tidewater Oil Company, which conveys the property therein described to the County of Contra Costa for County road purposes, and quitclaims to said Tidewater Oil Company the superseded segment of County read herein abandoned and therein described and does authorize the Chairman of the Board to execute said quitclaim Deed for and on behalf of the County of Contra Costa, and directs the Clerk of the Board to cause the game to be recorded in the office of the County Recorder of the County of Contra Costa, State of California, PASSED AND ADOPTED by the Board of Supervisors of the County of Contra Costa on the 14th day of November, 1961, by the following vote: AYES: Supervisors - James P. Kenny, Thomas John Coll, Edmund A. Linscheid, Joseph S. Silva. NOES: Supervisors - None. ABSENT: Supervisors - Mel F. Nielsen. RESOLUTION NO. 4
