In the Matter of the
Abandonment of Hercules RESOLUTION OF
Avenue, East Richmond ABANDONMENT
Heights, Contra Costa County N0.--4�0
The Board of Supervisors of the County of Centra Costa
does resolve as follows:
THAT on the 3rd day of October, 1961 , the
Board of Supervisors of the County of Contra Crista passed a
resolution of intention to abandon the hereinafter described
County road
and
THAT said resolution fixed Tuesday, the 14th day of
November, 1961 , at ten o'clock a.m. in the chambers of
the Beard of Supervisors, Hall of Records, Martinez, California,
as the time and place for the hearing of said resolution ,and
ordered said resolution to be published and posted, as required
by law, and
THAT affidavits on file herein show that said notice
of time and place of hearing was published and posted as
provided by law, and
THAT said hearing was held on the 14th day of November,
1961 , at the time and place appointed, and
THAT the Berard at said time and place heard evidence
offered concerning the abandonment and duly considered the
same, and
THAT the Board of Supervisors of the County of Contra
Costa does hereby find that the hereinafter described County
road
dedicated to public use, is actually unnecessary for present
or prospective use, and
THAT the hereinafter described County road
is hereby abandoned.
Description:
That portion of Hercules Avenue between Rosalind
Avenue and the southerly extension of the westerly

line of Lot 5, Block 90, as shown on the map of
East Richmond Heights, Tract No. 2, filed Febru-
ary 21, 1911, in Volume 4 of Maps at Page 90,
Contra Costa County Records.
EXCEPTING AND RESERVING THEREFROM, pursuant to
the provisions of Section 959.1 of the Streets
and Highway Code, the easement and right at .any
time or from time to time for the, .
1i ries for electric power and communication ser-
vices., to maintain, operate, replace, remove,
renew and enlarge existing Lines of pipe, con-
duits, cables, poles, wires and other convenient
equipment and fixtures for the operation of the
existing facilities, including access to work on
the facilities and to protect the facilities from
all hazards, in, upon, under and over the south-
western 60 feet of the southeastern 5 feet of that
portion of Hercules avenue described above.
