RESOLUTION OF INTENTION TO CONSTRUCT IMPROVEMENTS
The Board of Supervisors of the County of Contra Costa
does resolve as follows :
THAT it is the intention of this Board to order the
following work to be done and improvements to be made under the
provisions of the Improvement Act of 1911 (Streets and Highways
Code, State of California ) for Contra Costa County Assessment
District 1961-4:
Construction and installation of curbs, gutters, paving,
and storm drainage facilities on Ichabod Lane, Orinda,
as these improvements are shown on "Map Showing Boundary
of District Proposed to Be Assessed and General Plan of
Improvements, Contra Costa County Assessment District
1961-4", which map is on file in the office of the County
Clerk and is incorporated herein by reference.
THAT this Board hereby finds that the public interest
and convenience require the construction and installation of said.
improvements .
THAT the estimated cost of said improvements is THIRTY-
FIV&' THOUSAND DOLLARS ($35,000.00), including incidental expenses.
THAT such cost shall be assessed upon properties within
said assessment district as shown on the map hereinabove mentioned,
and said map is referred to for the boundaries of said district ,
THAT said improvements be constructed in the area herein-
above described and in the particular locations and at the grades
set forth and shown on said map, together with the construction of
all appurtenances incident thereto, including fittings, trenching,
trading and regrading, excavation and fill, removal of obstructions,
connections to existing facilities, backfilling, reconstruction of
,around surfaces as required, all in the locations and as the same
are shown on the map herein r=eferred to.
THAT the attention of all persons is directed to the fact
that all of said classes of improvements above described may not
be constructed upon all of the street above described in its en-
tirety, but only upon the particular locations as shown on the map
hereinabov:a referred to, to which the attention of all persons is
directed for a description of the work, location of the several

classes of work, a description of the classes of work to be done,
and for all other information contained on said map hereinabove
referred to.
THAT said contemplated worm and improvements, in the
opinion of this Board, is of more than Local or ordinary benefit,
and this Board hereby makes the costs and expenses of said im-
provements chargeable upon a district, which this Board hereby
declares to be the district to be benefited by the improvements
herein described; said district shall include that territory in
tine 0 ounty of Contra Costa, State of California, shown on the
map hereinabove rew'arrad to, which map shoes by a boundary line
the extent of the territory included in the proposed district
and covers all details of the extent of the arra to be assessed;
Excepting; from the area so delineated the area of all
public streets, avenues, lanes, roads, drives, courts, places,
public paras and properties and all easements and rights o±' way
therein contained balonginf to the public, and also excepting.
from the area shown and delineated: on said map all property
owned by the United Mates of America or the Mate of California.
but not exceptin property of any school district.
THAT as a part of these proceedings, this Board intends
to order the; acquisition of f'we title to all that certain property
designated as the roadway right of way and shown as Park. Lane
on the Record o ' Survey of a Portion of R. S. Rhe-em Property,
Contra Costa County, California, filed in Book 14 of Licensed
Surveyors Daps at page 43, which map was filed on April 24, 1951
in the off ice 0.7 the Ilecorder of Contra Costa County., together
with reasonable rights of access, during; construction of street
improvements, over the remaining lands of grantors to permit the
construction of out and fill slopes necessary to construct said
street improvements .
THAT notice is hereby given that serial bonds to repre-
sent and be secured by assessments made under these proceedings,
and to bear interest at the rate of five per cent (5%) per annum,
will b: issued hereunder in the manner provided by the Improvement
Bond Act of l 15 (Division 10, Streets and Highways Code, Mate
of California), and the last installment of such bonds shall
mature twenty-four (24) years from the second day of July next
succeeding ten (10) months from their date.
THAT on Tuesday, November 14, 19061, at 10:00 a.m., at
the Chambers of the Board of Supervisors, Hall of Records, Martinez,
California, any and all persons having any objection to the pro-
posed improvements or any objection to the grades to which said
work is proposed to be done or to the boundaries of the district
proposed to be assessed to pay the cost and expenses of said work,
may appear before this Board and show cause why said improvements
should not be carried out in accordance with this Resolution of
Intention, and may present written protest, not later than the hour
hereinabove set for hearing, against the doing; of said wore, the
grades to which said work is to be done, or the extent of the terri-�
tory to be assessed to pay the cost and expense thereof.

THAT the County Clerk of the County of Contra Costa
shall cause this Resolution of Intention to be published twice
in the ORINDA SUN, published and circulated in the County of
Contra Costa, which is hereby designated as the newspaper in
which shall be printed and published all notices, resolutions,
orders and other matters required to be published in the pro-
eeedin-,s taken pursuant to this lesolution of Intention and under
the provisions of the Improvement Act of 1911, the first publi-
cation of this resolution to be not less than ten (10) days
prior to the date herein fixed for the hearing on this rasolu-
tion.
THAT the 3ngineer of Work shall cause to be conspicu-
ously posted along the line of said contemplated improvements,
and on all the open straets within the assessment district,
notice of the passage of this resolution in the time:, form, and
manner required by law, said posting to be completed at least
tan (10) days prior to the date set for hearing protests or
objections .
THAT the County Clerk is hereby directed to mall a
copy of this resolution, postage prepaid, to all persons owning
real property proposed to be assessed, whose names and addresses
appear on the last :equalized assessment roll or as known to said
clerk, said mailing to be at least w'ifteen (15) days prior to
the day herein .fixed for the hearing on this resolution, all in
the time, form, and manner prescribed in the Improvement Act of
1011.
PASSED AND ADOPTED this 17th day of October, 1961, by
the following vote of the Board:
