COSTA COUNTY, STATE OF CA LI]FORN 1A In the Matter of: RESOLUTION NO. 375 Intended Abandonment of Parts of St. Mary' s Road, Canyon Road, DECLARATION OF INTENTION Moraga Road, etc. TO ABANDON WHEREAS: This Board in Resolution No. 2b0 of August 22, 1961, announced its intention to abandon portions of St . Mary' s Road, Canyon Road, Moraga Road and a 60 ft. Road, all in Moraga Center, and duly noticed and held a hearing on October 3, 1961, on this matter, and heard a:nd considered the same including the recommendations of the County Planning Commission thereon, This Board RESOLVES THAT: It intends to abandon the roads and portions of roads at Moraga Center referred to in its file No. 1422 when the following conditions are shown to exist (as recommended by the County Planning Commission in letter of September 22, 1961): 1. The necessary replacement roads have been con- structed by the developer and have been approved and accepted by the county. 2. The replacement roads are to be located and con- structed substantially as indicated on the map .entitled "Proposed Road Abandonments, Moraga Center" prepared by Wilson and Company, dated August, 1961, with the following exceptions and conditions : a. The replacement roads shall be located to conform to the locations shown as the zoning district boundaries of the Retail Business District in Ordinance 1509, except for minor variations which may be required in actual design and construction of the roads. b. The proposed realignment of Moraga Road north or St. Mary' s Road shall be constructed con- currently with the other replacement road construction. This will eliminate the two 90 degree turns which would otherwise exist on this route. c . The proposed new connection of St. Mary' s Road to the realigned Moraga :load shall be moved southerly as necessary to clear the proposed State interchange ramps at the Morava Road--Shepherd Canyon Freeway Interchange. RESOLUTION NO. 372 3. The abandonment, when ordered, shall include reser- vations for all necessary public utility easements. At this date, reservations for one or more utilities are required for all of the areas proposed to be abandoned except the unused right of way shown on the snap between St. Mary t s Road and Moray a Road. It is our understanding that some or all of these utilities will be relocated prior to the abandonment action so that some o_' the present reservations may no longer be necessary.
