In the Matter of Revised
Drainage Maintenance RESOLUTION NO. 366
Policy.
On the recommendation of the County Administrator, and on
motion of Supervisor Call, seconded by Supervisor Kenny, IT IS BY
THE BOARD RESOLVED that the following be and the same is adopted as
the policy on drainage maintenance .
1 . For the purposes of this policy, "channel" shall mean any water-
course, open or closed, natural or man-made, which carries storm
drainage . A "major channel." is one draining more than e square
miles, a "secondary channel" drains more than 1 but less than 4
square miles, and a "minor channel" drains less than 1 square
mile .
2. For the purposes of this policy, work in the "general public
interest 'shall be defined as that needed for:
(a) Protection of County-owned property, e .g. , bridges, cul-
verts, or roads, or
(b) Prevention or alleviation of widespread flooding of public
or private property within the unincorporated areas of the
County, or
(c) correction of a drainage problem which, if uncorrected,
might lead to damages for which the County could be held
liable .
3 . Work under this policy shall be done only in the unincorporated
areas of the County unless
(a) It qualifies under Item 4 below (program for spraying and
removal of vegetation), or
(b) it involves maintenance of improvements within a city
which were built by a storm drainage zone or a storm drain
maintenance district as part of a system of improvements
lying partly within the unincorporated area.
4. In order to deter the growth of vegetation in open channels the
County Department of Agriculture shall annually spray those
channels recommended by the Contra Costa County Flood Control
and Water Conservation District . In cases where it is in the
general public interest, the dead vegetation shall be removed
by County forces after spraying . In the unincorporated areas
this program shall be carried out in all sizes of channels, but
within the cities only in (a) channels which are important seg-
ments of drainage systems serving the unincorporated areas and
(b) channels constructed by storm drainage zones and storm drain
maintenance districts .

Channels to be maintained under this policy shall be restricted
so as to.-
(a)
o.(a) Include secondary and minor channels lying within drainage
easements (including those obtained b Storm Drainage Zones
and Storm brain Maintenance Districts which have been of-
fered for dedication to public use and are occupied by
drainage facilities built in accordance with approved im-
provement plans (the term "built" shall include the leaving
of a channel in its natural state if such was part of the
approved plan), except that when such facilities were not
built in accordance with an approved plan, the work shall
be done only if it is in the general public interest .
(b) Include secondary and minor channels not lying within
drainage easements provided that their maintenance is in
the general public interest or that the work is needed to
allow upstream or downstream channels which themselves are
in easements or County rights of way to function to their
as-built capacity.
(c) Exclude major channels except insofar as the work meets
ie requirements of Item 4 above or insofar as it fits the
description of Item 6 (a) below and is in the general pub-
lic interest . All other work within major channels shall
be financed with the proceeds of tax levies within flood
control zones and subzones .
(d) Exclude local roadside ditches within highway rights of
way .
6 . The work to be done in maintaining channels under this policy
shall be restricted so as to:
(a) Include removal of vegetative growth, sediment accumula-
tions, log gams, fallen trees and debris from channels in
order to restore a previously existing capacity or to pre-
vent a potential loss of capacity if the material involved
were to float downstream.
(b) Include repair or replacement of drainage facilities and
app�enances which have failed with facilities and ap-
purtenances of like capacity.
(c) Exclude increase in capacity of drainage facilities and
appur'tenances beyond a previously existing capacity.
(d) Exclude installation of grade control structures, revet-
me�r other stabilizing facilities to reduce or pre-
vent erosion.
(e) Exclude spraying or removal of vegetation for any purpose
cer than flood control .

(f) Exclude maintenance, other than spraying of vegetation, of
mprovements built largely with federal or state aid (such
improvements to be maintained with the proceeds of tax
levies within the local zone or district which cooperated
in their construction).
(g) Exclude maintenance of "backyard" drainage .
'� . Control over the maintenance of channels shall be exercised in
the following manner;
(a) Maintenance projects shall be planned and their cost esti-
mated by the Flood Control District (with the assistanO6
of the Public Works Department, if necessary) .
(b) Recommendations on maintenance projects shall be submitted
in writing by the Flood Control District to the Public
Works Department (with a copy to the County Administrator) .
(c) All maintenance projects shall be referred by the Public
Works Department to the Board of Supervisors for approval
with a recommendation as to the method of performing the
work (by county highway maintenance personnel or by out-
side contractor) .
(d) Any necessary easement or rights of entry shall be obtained
by the Public Works Department (with the assistance of the
Flood Control District, if necessary) .
(e) Cost control over maintenance projects shall be maintained
by the Public Works Department on a work order basis .
(f) The Public Works Department shall set up a work order to
cover the Flood Control District 's cost of making investi-
gations and recommendations under this policy. The Flood
Control District shall report periodically to the Public
Works Department the amounts to be charged against said
work orders .
(g) At the discretion of the Chief Engineer of the Flood Con-
trol District and in the interests of eliminating "red-
tape" on small jobs, the provisions of (b), (c) and (d)
above need not be followed for jobs estimated to cost less
than $200 each and which can be performed economically
by maintenance forces of that District or under purchase
orders issued by the County Purchasing Agent in behalf of
that District .
(h) To implement the provisions of (g) above, upon recommenda-
tion of said Chief Engineer and approval by the Board of
Supervisors, the Public Works Department shall set up a
work order in an amount large enough to cover a number of
such small jobs . The Flood Control District shall report
periodically to the Public Works Department the amount to
be charged against said work order and shall also report
periodically to the Board of Supervisors concerning the
work performed under said work order.

8. Funds to implement this policy shall be provided by the County
From sales tax revenues . When the funds authorized by the Board
of Supervisors are less than the total needed to cover currently
needed work, priority shall be determined by the degree in which
individual gobs are in the general public interest, regardless
of size of channel or existence of easement .
9 . During; periods of heavy run-off when time is of the essence,
the County Administrator, or his designated representative,
may authorize emergency work meeting the description of work
provided for under this policy up to a limit of $500 (esti-
mated cost) per jobsite . Such action shall be submitted to
the Board of Supervisors for approval as soon as possible
thereafter.
10. The resolution of the Board of Supervisors dated October 23,
1958, and entitled "In the Matter of Drainage Maintenance
Policy" is hereby repealed.
