In the Matter of Authorizing Sale
of a Portion of Right of Way and
Execution of Conveyance :Deed.. RESOLUTION No- 344
(Valley View Road, No. 1374) .

The Board of Supervisors of the County of Contra Costa
does resolve as follows :
THAT the Board of Supervisors authorized acquisition
of certain real properties for highway purposes described in the
deeds from James E. Harrison, et ux, recorded October 27, 1954,
in Book 240 ' of Official Records at page 442; and from Carlos
H. Mclntier, et ux, recorded .August 15, 1955 in Boar 2595 of
Official Records, at page 128; portions of which were required
for county highway, and
THAT this Board does hereby determine that the remaining
portions of said properties described as Parcel One and Parcel
Two herein, are no longer required for highway purposes, and
MAT, pursuant to Section 960.4 of the Streets and
Highways Code, it is hereby determined that said portions should
be sold to the adjacent property owner and this Board does hereby
authorize and approve the Right of lWay Agreement dated September
21, 1961, for the sale of the property described as Parcel One
in Exhibit "A"; attached hereto and made a part hereof, to Gayton
A. Church and Phylis Church, his rife, and Harvey B. Myhre and
Beulah. J. Myhre, his wife, for the sum of Six Thousand Dollars
($6,000.00) ; and that Parcel Two described in said exhibit "A"
be conveyed to said adjacent property owners, Clayton A. Church,
et al, in exchange for a contiguous. and comparable parcel of
lana required for highway purposes, and
THAT the Chairman of this Board is hereby authorized:
and directed to execute a grant deed for and on behalf of the
County of Contra Costa, and cause the same to be delivered to
the grantees, Clayton A. Church and. Phylis Church; his wife,
and Harvey B. Myhre and Beulah J. Myhre his wife, upon pay-
ment of the said Six Thousand Dollars ($b,000.00) and a deed to
Centra Costa County for said parcel of land exchanged for Parcel
Two.

All that certain real property in the County of Centra Creta,
State of California, described as follows:
Portion of Lot 127 as shown can the map of San Pablo Rancho
filed August 1, 1894, in the office of the County Recorder of
Contra Costa County, described as follows:
PARCEL ONE:
Beginning at the southern corner of the parcel of land des-
cribed in the deed from N. R. Jones, et ux, to R. V. Vogel, et
ux, recorded August 21, 1943 , in Book 749 of Official Records,
page 73 ; thence from said point of beginningalong the southwest
line of said Parcel (749 OR 73) North 400 31 10" West ( said
bearings of North 400 36t 10't West being taken for the purpose
f this description) 61.46 feet and North 30* 17f 10" West
said bearing of North 300 171 10" West being taken for the
purpose of this description) 33.79 feet; thence North 690 071
49" East 80.03 feet; thence easterly along the arc of a tangent
curve to the right having a radius of 20 feet an are distance
of 12.05 feet; thence South 760 20t 95" East 98.38 feet to the
southeast .line of said Vogel Parcel t749 OR 731 ; thence South
560 49* 20" West along said southeast line 149.57 feet to the
point of beginning.
PARCEL TWO:
Commencing at the southern corner of the parcel of land
described in the: deed from N. R. Janes, et ux, to R. V. Vogel,
et ux, recorded August 21, 1943 in Book 749 of Official Records,
page 733 thence from said point of commencement North 560 49'
20" East along the Southeast line of said Parcel (749 OR 73)
152.91 feet; thence South 710 30t 50" East 28.98 feet to the
actual point of beginning of this description; thence from said
actual point of beginning continuing South 710 301 50" East 60
feet; thence North 180 29f 10" East 5.06 feet; thence North 760
201 05" West 60.21 feet to the actual point of beginning.
Parcel One hereinabove described is subject to the condition
that at such time it is improved, grantees, their successors or
assigns shall install a culvert within the existing drainage ditch
on the property being conveyed, together with other frontage im-
provements along said property. Said frontage improvements shall
include the sidewalks, curb, gutter and paving between the edge
of the existing pavement and the new curb line.
It is further understood. the county will execute an appropriate
release upon satisfactory installation of said facilities,
