WHEREAS, John Furtado is liable to the County of Contra Costa in the amount ,of Six Thousand Eight and. 06/100 Dollars ($6,008.06) for goods and services rendered at the County Hospital and has executed a Notice of Lien and Reimbursement Agreement as to all of his property recorded in Book 3625, Official Records at page 27, and now wishes to sell a portion of his real property to K. K. Atkinson; and WHEREAS, K. K. Atkinson has offered to pay Three Thousand Two and 0/100 Dollars ($3,200) to the County in return for a Partial Release of Notice of Lien and.Reimbursement Agreement as to that portion of the Furtado property described in Exhibit A attached hereto, which is a portion of the parcel the deed to which is in Escrow No. 2126 €9 of the California Pacific Title Company, NOW, THEREFORE., BE IT RESOLVED that the offer of K. K. Atkinson is hereby accepted and the Chairman of the Board is auth- orized to execute and place in said escrow on behalf. of the County of Contra Costa a Partial .Release of Notice of Lien and Reimburse- ment Agreement as to that parcel of real property described in Exhibit A attached hereto, with the instructions that said instru- ment may be delivered upon the deposit of said Three Thousand Two and 0/100 Dollars ($3,200) in escrow by K. K. Atkinson. PASSED AND ADOPTED this 29th day of August, 1961, by the following vote of the Board: AYES: Supervisors James P. Kenny, Mel F. Nielsen, Thomas John Coll, Edmund A. Linscheid, Joseph S. RESOLUTION NO DESCRIPTION All that certain real property in the County of Contra Costa, State of California, described as follows : Portion of the Rancho Las: Juntas, described as follows : Beginning at the northwest corner of the parcel of land des- cribed in the deed from John Furtado, to Tony Roman, Jr. , et ux, dated January 18, 1961, recorded March 22, 1961, in book 3829 of Official Records, page 492; thence from said point of beginning along the north line of said Roman parcel (3829 OR 492) as follows ; South 880 46f 32" East, 5.00 feet; northerly and easterly along the are of a nontangent curve to the right having a radius of 20.00 feet, an arc distance of 31.42 feet; easterly along the are of a curve to the left having a radius of 193.24 feet, an are distance of 52.42 feet and North 75" 40' 53" East, 18.91 feet; thence North 10 13' 28" East, 528.40 feet to the south line of the parcel of land described in the deed from John Furtado to Antonio E. Roman, Jr., et ux, dated December 22, 1958, recorded December 23, 19582 in book 3288 of Official Records page 68; thence North 88* 13' 02" West along said south line 95.00 feet to the west line of-the par- eel of land described in the deed from California Pacific Title Company, Contra Costa Division, a corporation, to John Furtado, dated March 21, 1961, recorded March 22, 1961, in book 3829 of Official Records, page 489; thence South l° 131 281; West along said west line to the point of beginning. RESERVING THEREFROM: An easement (not to be exclusive) as an appurtenance to the remaining lands of the grantor for use as a roadway for vehicles of all kinds, pedestrians and animals and as a right of way for water, gas, oil and sewer pipe lines and for telephone, electric light and power lines, together with the necessary poles or underground conduits to carry said lines over and under all that portion of Parcel One above lying within the parcel of land described as Parcel Two in the deed from John Furtado, to Tony Roman, Jr., dated January 8, 1961, recorded March 221, 1961, in book 3829 of Official Records, page 492.
