HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-274 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of the Abandonment of Creekside RESOLUTION OF Drive in Paradise Valley, ABANDO 'NT Unit No. 1 NO. 27 The Board of Supervisors of the County of Contra Costa does resolve as follows: THAT on the 1st day of August, 1951 , the Board of Supervisors of the County of Contra Costa passed a resolution of intention to abandon the hereinafter described County road and ,THAT said resolution fixed Tuesday, the 29th day of August, 19 1 , at ten o'clock a.m. in the chambers of the Board of Supervisors, Hall of Records, Martinez, California, as the time and place for the hearing of said resolution and ordered said resolution to be published and posted, as rewired by law, and THAT affidavits on file herein show that said notice of time and place of hearing was published and posted as provided by law, and THAT said hearing was held on the 29th day of August, 1951 , at the time and place appointed, and THAT the Board at said time and place heard evidence offered concerning the abandonment and duly considered the same, and THAT the Board of Supervisors of the County of Contra Costa does hereby find that the hereinafter described County read dedicated to public use, is actually unnecessary for present or prospective use, and THAT the hereinafter described County read is hereby abandoned. Description: That ,portion of Creekside Drive lying east of the east line of Lucille Lane, as shown on the map of Paradise Valley Unit No. 1. RESOLUTION NO. 274 Creekside Drive is shown as "Private Road" on said map but is dedicated to public use. EXCEPTING AND RESERVING THEREFROM, pursuant to the provisions of Section 959.1 of the Streets and Highways Code, the easement and right at any time or from time to time for the owner of an existing sewer line to maintain, operate, replace, remove, renew and enlarge the existing pipeline and other convenient equipment and fix- tures for the operation of the existing facility, including access to work on the facility and to protect the facility from all hazards in, upon, under and over the easterly five feet of the road to be abandoned, being an extension of the "Sewer reserve 5 feet wide" as shown on Lot 37 of said map of Paradise Valley Unit No, 1. PASSED AND ADOPTED by the following vote of the Bawd: AYES: Supervisors - JAMES P. KENNY, MEL F. NIELSEN, THOMAS JOHN COLL, EDMUND A. LINSCHEID, JOSEPH S. SILVA. NOES: Supervisors NONE.
