HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-271 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Adoption of a Policy Concerning Assessment RESOLUTION NCS, 7 1 District Proceedings . WHEREAS, there has been an increasing number of requests .for the use of 1911 and 1913 Assessment Act proceedings with 1915 Act Bonds; and WHEREAS, a screening committee was appointed by the Board of Supervisors on August 15, 1961, to consider and make recommenda- tions to the Board of Supervisors concerning the use of Assessment Act proceedings; and WHEREAS, the screening committee has agreed on the need for a policy concerning assessment district proceedings; NOW, THEREFORE, BE IT RESOLVED that the assessment dis- trict policy of the Board of Supervisors is as follows : 1 . Assessment district proceedings will be approved for new subdivision developments only if they are initi- ated before, or at the time, the development work commences . 2. 1915 Act Bonds will be considered3n connection with the new subdivision developments only if a demonstra- ble advantage to the county will inure and if the county's potential liability is adequately secured, 3 . 1915 Act Bonds may be approved for use in bringing developed areas up to present county standards , 4 . Contra Costa County may conduct proceedings through its counsel and shall charge the assessment district for actual and administrative costs incurred in such proceedings . The county may engage engineering as- sistance and other assistance as the Board of Super- visors may deem necessary. AND BE IT FURTHER RESOLVED that all proposals for the use of assessment district proceedings shall be referred to the screen- ing committee, composed of a representative of the Board of Super- visors, the County Administrator, the County Auditor-Controller, the District Attorney, and the Director of Public Works for recommenda- tion to the Board of Supervisors .
