HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-247 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Policy with reference to the operation RESOLUTION . 24 7' of a work relief program. WHEREAS, under the laws of the State of California, Boards of Supervisors of the counties of this State are required to "relieve and support all incompetent, poor, indigent persons and those incapa- citated by age, disease, or accident, lawfully resident therein . . . . ." . (Sec . 2500, W&I Code); and WHEREAS, Section 2506 of the above mentioned code contains the provision that "work may be required of an indigent who is not in- capacitated by reason of age, disease, or accident, as a condition of relief . . . . ."; and WHEREAS, the County of Contra Costa does, through its Social Service Department, provide financial help to needy employable resi- dents under the General Assistance program; and WHEREAS, it is recognized to be in the best interests of the County of Contra Costa and of those receiving General Assistance that the latter be engaged to the extent of their capabilities in the per- formance of useful work during the times they are receiving General Assistance; NOW, THEREFORE, BE IT RESOLVED that a work relief program be instituted under the following general conditions : 1. Able-bodied male recipients of General Assistance will be required (as needed) to perform labor on approved work projects as a condition of the granting of assis- tance by the County Social Service Department . 2. Future grants of General Assistance shall be terminated by the County Social Service Department if a determina- tion is made that a recipient without good cause : a. Fails or refuses to report for work at the time and place directed by the County Social Service Depart- ment; or b . Abandons or repeatedly absents himself from his work assignment; or c . Fails or refuses to perform the work assigned to him; or d. . Engages in behavior that might be classified as insubordination. RESOLUTION NO. 247 3 . The using agency shall be responsible for providing: a. Qualified supervision for recipients assigned to projects . b . Transportation between designated pick-up points and the projects . c . All necessary tools and equipment essential to project operation. d. Prompt time and performance reporting as required by the Social Service Department . e . Necessary safety devices and safety clothing. 4. The using agency shall exercise diligence in selecting the type of work to which the recipient is assigned to the end that no recipient will be required to perform work beyond his physical and mental capacity. 5 . Recipients assigned to work projects will be covered by Workmen's Compensation Insurance in the same manner as other public employees . 6. Relief recipients will not be utilized on work pro- jects as a substitute for or in lieu of civil service employees . 7. The dollar value of assistance grants shall be the basis for determining the number of days or hours of labor that shall be required of each recipient . Work performed shall be credited to the recipient at the rate of $2.00 per hour, but recipients shall not be required to perform work in excess of eight hours per day nor in excess of forty hours per week. BE IT FURTHER RESOLVED that work relief projects shall be considered for approval by a Project Appraisal Committee composed of the County Administrator, the Public Works Director, and the County Social Service Director, which Committee shall consider the worth, feasibility, and appropriateness of each project, establish priority criteria for selection of projects, and approve or reject requests on the basis of these considerations; and BE IT FURTHER RESOLVED that should requests for considera- tion of work projects originate with political subdivisions other than the County of Contra Costa, such requests shall be processed in the same manner as those originating with county departments , and if approved, labor shall be furnished as available in accord- ance with the provisions of an appropriate contract between the using agency and the County of Contra Costa, said contract to in- clude all of the conditions hereinbefore mentioned in this Reso- lution, and in addition thereto, the requirement that the using agency shall reimburse the County of Contra. Costa fully for all ad- ministrative costs directly related to the furnishing of labor for said projects . 4 PASSED AND ADOPTED this 15th day of August, 1961, by the following vete of the Board: AYES: Supervisors Thomas Jahn Coll) Edmund A .
