HESOLUIPION ORDERING THs' WORK The Board of Supervisors of Contra Costa County does resolve as follows: WTM'r;AS, the Board of Supervisors of the County of Contra Costa, State of California, on the 24th day of November, 1959, adopted its Resolution of Intention to order the therein described work and improvements to be done and made in Contra Costa County Assessment District 1959-3, which Resolution of Intention was duly and legally published in the time, form and manner required by lbw, as shown by the affidavit of publication of said Resolution of Intention on file in the office of the County Clerk of said County; and Wffil- S,after the adoption thereof, notices of the passage of said Resolution of Intention headed "Notice of Improvement's were duly and legally posted in the time, form, manner, locations and number required by law as appears from the Affidavit of Posting said notices on file in the office of the County Clerk of said County; and WHL"S, after the adoption thereof, a copy of said Resolu- tion of Intention_ was duly mailed to all persons owning real prop- erty proposed to be assessed for the improvements described in said Resolution of Intention, according to the names and addresses of such owners as the same appear on the last equalized assessment roll for taxes, prior to the date of such mailing or as known to the County Clerk of said County, which said copies were duly mailed in th time, form and manner required by law; and WI-MREAS,, on the 22nd day of December, 1959, and on the 19th day of January, . 19c" , the Board of Supervisors of the County of Contra Costa duly adopted resolutions setting forth prgposed amend- ments t0 said Resolution Of Intention, which said resolutions :were duly and legally published in the time, fora and manner required by law, as shown by affidavits of publication on file in the office of the County Clerk; and WIEREAS, this Board of Supervisors has duly heard and con- sidered all protests to said improvements at the time and place specified in said Resolution of Intention and in said resolutions setting forth proposed amendments to the Resolution of Intention, and has duly ov�arruled and denied all such protests; and WH&REAS, said Beard of Supervisors has duly received and considered evidence oral and documentary concerning the jurisdictional facts in this proceeding and concerning the necessity 'for the proposed RESOLUTION NO. work and improvements and the benefits to be derived therefrom, and said Board of Supervisors has acquired Jurisdiction to order the proposed improvement. NOW, THS-;IRSFORE, BE IT RES0LVED that the public interest and convenience require improvement herein referred to and said Board of Supervisors hereby orders that the work and improvement as set forth and described in said Resolution of Intention, and said amendments to said Resolution of Intention, adopted by this Board on November 24, 1959, January 12, 1960, and February 16, 1960, and in the plans and specifications adopted by this Board on the 1st day of August, 1961, be done and made. THAT the boundaries of the Assessment District and the grades to which work and improvements are to be constructed, shall be those set forth and described in said Resolution of Intention and said amendments to it, and in the plans and specifications hereinabove referred to, reference to which is hereby mad=e for all urth<er particulars. THAT sealed proposals and bids for the doing of said work and the making of said improvements herein ordered, shall be delivered to the County Clerk of the County of Contra Costa on or before the 22nd day of August, 1961, at the hour of 11:00 a.m. of said day, in the office of said Count; Clerk In the Hall of Records, Martinez, California, which said time is hereby fixed as the time of a public meeting at which said bids will be publicly opened, examined and declared by the Board of Supervisors at the Hall of Records, Martine , California, said bins after being publicly opened, examined and declared will be calculated by the Engineer of Work, and the report of the results of the bidding and the calculations of the Engineer of Work will be reported to the Board of Supervisors of the County of Contra Costa at the next regular meeting thereof. The Board of Supervisors reserves the right to reject any and all pro- posals and bids should it deem this necessary for the public good and also the bid of any bidder who has been delinquent or unfaithful in any former contract with the County of Contra Costa. THAT the bidder to whom the contract is awarded will be obligated at the signing of the contract to advanc=e all incidental expenses incurred up to the time of entering into the contract. THAT the County Clark of the County of Contra Costa is hereby ordered to give notice inviting such scaled bids in the time, form and manner provided by laud. THAT said Resolution of Intention dated November 24, 1959, and said amendm nts to the Resolution of Int=ention dated January 12, 1960, and February 16, 1960, are hereby ratified, confirmed and finally adopted.
