HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-196 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Improvements to be made in Contra Costa County Assessment District RESOLUTION NO. 1961-3. RESOLUTION ORDERING THE WORK. The Board of Supervisors of the County of Contra Costa does resolve as follows: WHEREAS, the Board of Supervisors of the County of Contra Costa, State of California, on the 31st day of May, 1961, adopted its Resolution of Intention No. 129 to order the therein described work and improvements to be done and made in Contra Costa County Assessment District 1951-3, which Resolution of Intention was duly and legally published in the time, form and manner required by law, as shown by the affidavit of publi- cation of said Resolution of Intention on file in the office of the County Clerk of said County; and WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intention, headed "Notice of Improvement", were duly and legally posted in the time, form, manner, locations and number required by law, as appears from the affidavit of posting said notices, on file in the office of the County Clerk of said County; and WHEREAS, after the adoption thereof, a copy of said Resolution of Intention was duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention, according to the names and addresses of such owners as the same appear on the last equalized assessment roll for taxes prior to the day of such mailing, or as known to the County Clerk of said County, which said copies were duly mailed in the time, form and manner required by law; and WHEREAS, this Board of Supervisors has duly heard and considered all protests to said improvements at the time and place specified in said Resolution of Intention, and has duly overruled and denied all such protests; and WHEREAS, said Board of Supervisors has duly received and considered evidence oral and documentary concerning the juris- dictional facts in this proceeding and concerning the necessity for the proposed work and improvements and the benefits to be derived therefrom, and said Board of Supervisors has now acquired ,jurisdiction to order the proposed improvement, RES OLUT ION NO. 196 NOW THEREFORE, BE IT RESOLVED THAT the public interest and convenience require the improvement herein referred to, and. said Board of Supervisors hereby orders that the work and improvement, as set forth and described in said Resolution of Intention No. 129, adopted by this Board on the 31st day of May, 1961, and in the plans and specifications adopted by this Board on the 5th day of July, 1961, be done and made. THAT the boundaries of the assessment district, and the grades to which said work and improvements are to be con- structed, shall be those set forth and described in said Resolu- tion of Intention No. 129 and in the plans and specifications hereinabove referred to, reference to which is hereby made for all further particulars. THAT sealed proposals or bids for the doing of said work and the making of said improvements herein ordered shall be delivered to the County Clerk of the County of Contra Costa on or before the 25th day of July, 1961, at the hour of 11:00 a.m. of said day, in the office of said County Clerk in the Hall. of Records, Martinez, California, which said time is hereby fixed as the time of a public meeting at which said bids will be publicly opened, examined and declared by the Board of Super- visors of the County of Contra Costa, in the Chambers of the Board of Supervisors at the Hall of Records, Martinez, California. Said bids, after being publicly opened, examined and declared, will be calculated by the Engineer of Fork, his report returned to the County Clerk, and the report of the results of the bidding and the calculations of the Engineer of Work will be reported to the Board of Supervisors of the County of Contra Costa at the next regular meeting thereof. The Board of Supervisors reserves the right to reject any and all proposals or bids should it deem this necessary for the public good, and also the bid of any bidder who has been delinquent or unfaithful in any farmer contract with the County of Contra Costa. THAT the successful bidder will be obligated at the signing of the contract to advance, in addition to other inci- dental expenses, the sum of NINE HUNDRED SIXTY-FOUR DOLLARS ($964.134) to East Bay Municipal €€tility .District, which shall constitute full payment for all water line materials and fire hydrant. THAT the County Clerk of the County of Contra Costa is hereby ordered to give notice inviting such sealed bids in the time, form and manner provided by law. THAT Resolution of Intention No. 129 is hereby ratified, confirmed and finally adopted.
