HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-192 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Improvements to be made in the Contra Costa County Assessment District RESOLUTION No 1961-3. RESOLUTION FINDING AND DECLARING THAT THE SPECIAL ASSESSMENT IN- VESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 IS INAPPLI- CABLE TO ASSESSMENT PROCEEDINGS IN ASSESSMENT DISTRICT 1961--3. The Board of Supervisors of the County of Contra Costa does resolve as follows: WHEREAS there was filed with the Clerk of the Board of Supervisors of Contra Costa County, on the 12th day of April, 1960, a written petition for the improvement of a portion of Seventh Street, Rodeo; and WHEREAS in accordance with said petition, this Board of Supervisors, on the 7th day of May, 1961, adopted a Resolution of Intention to construct said improvements and to make the cost thereof chargeable against the properties benefitted thereby, through the formation of Contra Costa County Assessment District No. 1961-3, under the provisions of the Improvement Act of 1911; and WHEREAS said petition was signed by all of the owners of more than sixty percent (60%) in area of the property subject to assessment for said proposed improvements; and WHEREAS said owners, by said petition, specifically waived investigation proceedings under the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, NOW, THEREFORE, BE IT RESOLVED: THAT it is hereby found and declared that said Special Assessment Investigation, Limitation and Majority Protest Act of 1931 is inapplicable to these proceedings.
