Resolution Calling Election RESOLUTION NC3l u 4
in the Proposed City of Alamo.
The Board of Supervisors of the County of Contra
Costa resolves as follows:
THAT on the 18th day of April, 1961, after a public
hearing the Board of Supervisors determined that there were
insufficient legally valid protests to the proposedincorpora-
tion of the City of Alamo and called an election on the ques-
tion of incorporation of the City of Alamo and directed the
Clerk to give notice thereof;
THAT on the 25th day of April, 1961, an action.
denominated Richard Dailey, et al., Petitioners, vs. Board of
Supervisors of the County of Contra Costa, et al., Respond-
ents, No. 81775, requesting issuance of a Writ of Mandate to
prohibit such election, was .filed in the Superior Court of
Contra Costa County,
THAT the Superior Court of Contra Costa County on
June 7th, 1961, found and determined that there were legally
valid protests amounting to more than 51% of the total assessed
valuation within the proposed boundaries of the City of Alamo
and said court on dune 7th, 1961, issued its peremptory Writ
of Mandate in the above entitled action, directing that this
Board of Supervisors rescind its order calling an election
for the incorporation of the City of Alamo and to terminate
all proceedings therein.
NOW, THEREFORE, BE IT RESOLVED that the Board of
Supervisors of the County of Contra Costa hereby rescinds its
resolution of April 18, 1961, calling for an election for the
incorporation of the City of Alamo and directs that all pro-
ceedings concerning said incorporation be terminated.
PASSED AND ADOPTED this 13th day of June, 1961, by
the following vote of the Board:
AYES: Supervisors James P . Kenny, Mel F. Nielsen,
Edmund A. Linscheid, Joseph S. Silva.
NOES: Nome.
ABSENT: supervisor Thomas John Coll.
