HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-158 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Requesting the United States of America to Release the County of Contra Costa from the Recapture Clause RESOLUTION NO. in the Instrument of Transfer for Buchanan Field, Concord, California. The Board of Supervisors of the County of Contra Costa does resolve as follows: THAT by Instrument of Transfer dated October 9, 1947, and amended 'July 11, 1951, and February 24, 2953, the United States of America, acting by and through the War Assets Adminis- tration, did convey unto the County of Contra Costa for airport purposes certain property located in said County, known as Buchanan Field, and THAT said Instrument of Transfer contains a clause by means of which the United States Government can summarily repossess leased areas at said airport under certain emergency conditions, and THAT private investors have expressed a great interest in constructing facilities at Buchanan Field Airport in a manner which would be of great benefit to Buchanan Field Airport, Civil Aviation, and the County of Contra Costa, and THAT said recapture clause has made if difficult for private investors to acquire financing to develop facilities at the airport, and THAT the Beard of Supervisors of the County of Contra Costa is of the opinion that technical developments in the field of aviation have rendered the original purpose of said recapture clause inapplicable to Buchanan Field Airport, and THAT military use of said airport by the United States Government can be effected through the negotiation procedures outlined in Paragraph Eight (8) of the Sponsors Assurance Agree- ment whereby the County of Contra Costa obtained Federal. Aid, and THAT the United States government, acting through the Federal Aviation Agency, release Buchanan Field Airport from the provisions of said recapture clause as detailed in Paragraph Four (4) on Page Fifteen (15) of said Instrument of Transfer.
