HomeMy WebLinkAboutRESOLUTIONS - 10172007 - RES-117 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of the Abandonment, of Proceedings to establish County RESOLUTION NO, Service Area M-3. The Board of Supervisors of the County of Contra. Costa does resolve as follows: THAT there was filed in the office of the County Clerk of the County of Contra Costa on the 15th day of March, 1961 a petition praying for the establishment of a County Service Area, pursuant to the County Service Area Law to include the territory hereinafter described to furnish maintenance and repair services on the Levees of Bethel Island to include storm drainage and flood control work incident thereto, and THAT it appeared from the certificate of W. T. Paasch, County Clerk of the County of Contra Costa that said petition as so filed bore the signatures of registered voters residing within said territory described in the resolution of intention to est- ablish said service area constituting not less than 10 of the registered voters residing therein, and THAT this Board dial on the 21st day of March, 1961 pass and adopt its resolution of intention to establish said county service area which said resolution contained all of the matters required by Section 25210.15 of the Government Code and did set 1.4.00 a.m. Friday, the 21st day of April, 1961 in the Chambers of the Board of Supervisors, Hall of Records, Main and Court Streets, Martinez, Contra Costa County, California, as the time and place for a public hearing on the establishment of the area, and THAT notice of said hearing was duly and regularly given in the manner prescribed by publication in the Diablo Valley Dews, a newspaper of general circulation circulated in the area on April 6, 1961 as appears by the affidavit of publication on file herein, which said notice contained all of the matters required to be contained therein by Section 25210. 16 of the Government Code, and THAT this Board dial on this date at the time and place set for hearing call for protests as provided by Section 25210-17, and at that time continued the matter until the 27th day of April,, 1961 at 9:30 a.m. , to hear further protests, and at that time continued the matter for decision and determination of protests until the 18th of May, 1961, and 117 THAT on May 18, 1961 at the time and place set for hearing on the determination of whether to establish County Service 'Area M-3, James la. Olsson, Deputy County Clerk appeared before the Board and stated that there were 4706 registered voters in Bethel Island and that 252 valid signatures were affixed to the protest petitions to the formation of said service area.. and Mr. Olsson filed his certification that the number of protestuants exceeded 50% of the registered voters residing in the proposed area to be established as County Service Area M-3, and THAT this Board does find and determine that the protests represent more than 50% of the registered voters residing within the territory proposed to be established as County Service Area M-3, and hereby abandon the proposed establir>hment of the county service area and determines these proceedings closed, as to the territory described as follows: -------------------- 17 BOUNDARY COMMISSION Centra Costa County, California Approved Description DATE 2/21/61 COUNTY SERVICE AREA M-3 FORMATION The area known as Bethel Island in the unincorporated territory of Contra Costa County, more particularly described as follows Beginning at the northwest corner of the bridge con:- strutted in about the year 1915 across the dredge cut at or near the head of what is commonly called Taylor Slough and near the southwest corner of Section 15, Township 2 North, Range 3 East, Mount Diablo Base and Meridian; thence following the Easterly bank of said Taylor Slough with its meanderings to the junction of said Taylor Slough with what is commonly called Piper Slough; thence following the Southerly and Westerly bang of said Piper Slough to its junction with SardMound Slough; thence following the Northerly bank of said Sand Found Slough to its junction with the dredge cut near the large hay barn situate on the lands of E. A. Bridgford, in the northeast quarter of Section 22, "T2N, R3E, I.D.B. & M; thence following the Northerly bank of said dredge cut running westerly to the place of beginning. . . 117 PASSED AND ADOPTED by the following vote of the Board: AYES: Supervisors - JAMS P.
