The Board of Supervisors, No. 73683 Grit of Mandate) . RESOLUTION NO. 116 The Board of Supervisors of the County of Contra Costa does resolve as follows. THAT the District Attorney has submitted to this Board for their review and approval a Stipulation and. Order Granting Peremptory Writ of Mandate and Peremptory Writ of Mandate in L. P. Scherer and Hobart Properties vs. The Board of Supervisors of Contra Costa County, No. 73683, an action for a writ of mandate directing this Board to pay the amount of a judgment rendered against the Southern Public Utility District, now disincorporated, or if there are funds insufficient in the treasury to the credit of the District to pay such judgment, to Levy a tax from the territory formerly included in this said District purusant to Section 17771 of the Public Utilities Code of the State of California, and THAT said judgment in the amount of $62,000 plus interest was rendered against the Southern Public Utility District in the matter of Southern Public Utility District v. Silva, et al., a condemnation action, on the 12th of April, 1954, and THAT upon the recommendation of the District Attorney's office, after an unsuccessful defense of the action, it is hereby directed and ordered that the District Attorney be and is hereby authorized to execute the above Stipulation and Agreements and take appropriate action to accomplish settlement in the matter of Scherer-Hobart vs. The Board, No. 73683. PASSED AND ADOPTED by the following vote of the Board: AYES: Supervisors James P . Kenny, Mel F. Nielsen, Thomas Jahn Coll, Edmund A. Linscheid, Joseph S Silva. NOES: none. ABSENT: None.
