In the Matter of Amending

The Board of Supervisors of the County of Contra
Costa does resolve as follows.-
THAT
ollows:THAT the agreement between the County of Contra
Costa and East Bay Municipal Utility District, dated May 8,
1959, be amended in accordance with the following:
1. Route B-1 is approved by both parties and County
will immediately order preparation of precise plans for con-
struction. As soon as plans are prepared, County will go to
bid award contract and construct B-1 route. EBMUD will advance
funds for payment in accordance with above agreement.
2. County will order precise engineering and prepara-
tion of cost estimate for construction of B-H route. EBRUD will
pap the cost of precise engineering and estimating for the B-H
route. Upon, completion of engineering, the estimate of the cost
of constructing B-H route will be determined. If County then
determines to build B-H route the total east of design and con-
struction will be paid by EBI&I the same as for route B-1. In
the event the County determines to build route C, the District
will contribute to the County the said estimated cost of con-
struction of route B-H as determined by the engineering cost
estimates above mentioned. The amount so paid or contributed
shall be used by the County only for construction of route B-H
or route C, or such reasonable deviations from such routes as
presently delineated as are required by problems of terrain or
other engineering and cost considerations.
If EBMUD is required to pay owner of Cutter property
severance damages attributable solely to the County determining
to build a route other than B-H, then in that event, such
severance damages required to be paid shall be deducted from the
cost EEMUD would otherwise be obligated to pay. In the event
the Cutter property is acquired by negotiated:_ settlement the
County shall have the right to first approve any sum included in
the settlement as severance damages attributable solely to the
County determining to build a route other than B--H.
3. In addition to other costs, EBMUD agrees to pay
County for lees of use of its present interest in the existing
roads which are closed by construction. This loss of use will
be computed by multiplying the present value of the roads by
interest at the rate of T6 per annum, prorated from date of
closure to date replacement read is open for use.

AYES: Supervisors James P. Kenny Thomas John Doll,
Edmund A. Linscheid, JosepA S. Silva.
NOES: None.
ABSENT: Supervisor Niel F. Nielsen.
